Re: Request for Wetland Permit for Michael and Robin Drews

Patricia C. Moore, Esq. on behalf of MICHAEL & ROBIN DREWS requests a Wetland Permit to
demolish the existing residence and construct a new residence 71.3' from the existing bulkhead and
add IO'X 20' decking landward of bulkhead. Located: 7425 Nassau Point Rd., Cutchogue.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the denoted following Policy Standards and
therefore is INCONSISTENT with the LWRP.
Policy 6
Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southo/d Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The nronosed structure setback from the ton of bluff line is 33 feet, a minimum setback
distance of 100 feet is required nursuant to Chanter 275-3. Please have the ann lie ant amend
the annlication to further the above Policv to the l!reatest extent nossible.
Furthermore, the locatiou of the two 10 x 20 deck structures immediatelv laudward of the
bulkhead and seaward of the top of bluff line is inconsistent with the above policv; a minimum
setback of 100 feet is reQnired form the top of blnff line.

A. INSTRUCTIONS
1. All applicants for permits' including Town of Sauthald agencies, shall complete this CCAF far
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a detennination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. Ifany question in Section C on this form is answered "yes", then the proposed action may affect
the achievement of the L WRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

orooosed house has been located at a l!reater distance to the bulkhead then the
oril!inal structure. The {lropertv was developed with a year round dwellinl! and
reulacement of the dwellinl! is consistent with Town policies and New York State
uolicies. The distance of the house and sanitary to the wetlands was maximized and
the setback to the bulkhead is in line with adjacent orooerties.
