THIS INDENTURE, made the ~ day of Mamh, Two Thousand
BETWEEN
JAMES R. WHEELER, residing at 3020 Moore's L~ne, Cutchogue, New York 11935, as
surviving tenant by the entirety;
party of the first part, and
ZOUMAS CONTRACTING CORPORATION, a New York corporation having its principal
place of business at 18 Deerfield Drive, Wading River, New York 11792
party of the second part,
WlTNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:-
BEGINNING at a point on the southeasterly side of Chestnut Road, distant 350.00 feet
easterly from the corner formed by the intersection of the southeasterly side of Chestnut Road
and the easterly side of Kenny's Road;
RUNNING THENCE along the southeasterly side of Chestnut Road the following two (2)
courses and distances: (1) North 50 degrees 53 minutes 30 seconds East, 221.58 feet; (2)
North 52 degrees 23 minutes 30 seconds East, 21.84 feet to land now or formerly of Rizzo;
THENCE South 41 degrees 28 minutes 40 seconds East along said land, 104.51 feet (deed)
104.53 feet actual to land formerly of Rizzo, now or.formerly of Helen Conway;
THENCE South 47 degrees 41 minutes 10 seconds West along said land, 242.99 feet to land
now or formerly of Dickerson;
THENCE along said land, North 42 degrees 18 minutes 50 seconds West, 119.10 feet (deed)
North 42 degrees 20 minutes 34 seconds West, 118.70 feet (actual), to the southeasterly side
of Chestnut Road at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
and Margaret C. Wheeler, by deed from Florence Moffat dated 1/9/67 and recorded in the
Suffolk County Clerk's Office on 1/13/67 in Liber 6100 cp 157.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party ~ofthe second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

first above written.
