SCTM# 104-7-3 JOHN CORBLEY requests a Wetland Permit to maintenance dredge a 133'+/- portion of an existing boat basin to a depth of -4' referred to NGVD29, with sides sloping upward at approx. 1:2 to existing grade, to an overall area 140' +/- X 29'. Approx. 220 cy. of material will be dredged and moved off-site by truck to an approved upland disposal site not less than 300' from any wetlands. Dredge to same conditions in four additional events over a ten-year period. Located: 680 Mason Dr.,Cutchogue. SCTM#104-7-3 The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the L WRP provided that: 1. If feasible, the installation of a silt boom/turbidity screen durin!?: construction activities is required to minimize turbidity in the water column. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. D NO D NOT APPLICABLE The dredging of a portion of an existing private boat basin is not inconsistent with the character of the waterfront community, and because there are no plans to in- crease the development of the relatively small area it is felt that there is no adverse impact on the desired preservation of open space. It is compatible with other existing shoreline structures and activities in the area, and will not adversely affect the dy- nanJic landscape elements (tidal fluctIJations, seasonal vegetation changes; sea- sonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. ~YES D NO D NOT APPLICABLE It is intuitively obvious that the likelihood of the activity proposed contributing to increased hazards which could result in the losses listed is minimal. Natural protec- tive features will not be adversely affected Policy 5 Protect and improve water quality and supply in the Town of Southold. ~YES D NO D NOT APPLICABLE The proposed project does not include any activity which will have a long-term adverse effect on water quality and supply. During the dredging operation, which will take less than one work day, the bottom within the basin will, of course, be disturbed and turbidity will result, but experience indicates that this will be self- correcting within about another day. Liquid or solid wastes will not be discharged into the water or wetlands before, during, or after the dredging.. Policy 6 Protect and restore the quality and function of the Town of South old's ecosys- tem. ~S D NO D NOT APPLICABLE The area to be dredged is completely devoid of wetland vegetation. During the dredging, the indigenous plants in adjacent areas will be protected insofar as possi- ble. The project is located in a Significant Coastal Fish and Wildlife Habitat, but the nature of the project, considering that it is the maintenance of an existing ap- proved docking area, is such that there will be no new impacts on any of the re- sources listed in the NYSDOS narrative for Cutchogue Harbor and Wetlands. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No excavating or filling is proposed. Policy 7 ~S Protect and improve air quality in the Town of South old. D NO D NOT APPLICABLE The dredging or the use of the dredged boat basin as proposed will not result in significant amounts of new air pollution. The purpose of the dredging is to allow the unimpeded use of the docking facility, and it is not the intention of the project to make possible the docking of additional boats. Policy 8 ~S Policy 9 DYES Policy 10 DYES Policy 11 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. DNO D NOT APPLICABLE The project as proposed will not result in the generation of any new or additional solid waste. The handling and storage of petroleum products both during the dredging and upon its completion will be accomplished through the use of ap- proved containers and facilities, and approved methods of handling and storage will be followed. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold.
