The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
L WRP provided that:
I. The installation of a silt boom/turbidity screen durin!!: construction activities
is required to minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency ofthe proposed action.

Dear Mr. Terry:
Attached please find an LWRP Consistency Assessment Form being submitted in association
with an application to the Board of Trustees for a Town Wetlands Permit to remove and replace
(in-place) an existing timber bulkhead with a vinyl bulkhead and incidentally dredge a maximum
of25 cubic yards lost backfill material from a lO-foot area adjacent to the new bulkhead, which
shall be used as backfill landward of the new bulkhead.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code g95-5(A)
and the corresponding definitions of "action" and "minor action" by g95-3, the submission of a
L WRP Consistency Assessment Form is not required for this application, as the proposed work
entails only "maintenance or repair involving no substantial changes in an existing structure or
facility."

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail, listinl! both sUPDortinl! and non-
supportinl! facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.
A copy of the L WRP is available in the following places: online at the Town of Southold' s website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Incidentally dredge (to recover lost backfill) approximately 25 cubic yards sand from area up to feet off
bulkhead (to maximum depth of -4' ALW) and use spoil for backfill landward of bulkhead. Remove & replace
(in-kind/in-place) existing dockage structures, including a 4' x 6' cantilevered deck, 3' x 16' ramp, and 6' x 20'
float, all a~ dt:picted on the proiect plan prepared by En-Consultants, Inc., dated June 9, 2006.
