Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that: I. The installation of a silt boom/turbidity screen durin!!: construction activities is required to minimize turbidity in the water column. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Greenport Dear Mr. Terry: Attached please find an L WRP Consistency Assessment Form being submitted in association with an application to the Board of Trustees for a Town Wetlands Permit to remove and replace (in-place) an existing timber bulkhead with a vinyl bulkhead and incidentally dredge a maximum of 25 cubic yards lost backfill material from a 10- foot area adjacent to the new bulkhead, which shall be used as backfill landward of the new bulkhead. I have indicated that all policies are "Not Applicable," because pursuant to Town Code ~95-5(A) and the corresponding definitions of "action" and "minor action" by ~95-3, the submission of a LWRP Consistency Assessment Form is not required for this application, as the proposed work entails only "maintenance or repair involving no substantial changes in an existing structure or facility. All applicants for permits. including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. * Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revita1ization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of South old Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the L WRP policy standards and conditions contained in the consistency review law.
