Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the L WRP provided that: I. The installation of a silt boom/turbiditv screen durin!! construction activities is required to minimize turbidity in the water column. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Attached please find an L WRP Consistency Assessment Form being submitted in association with an application to the Board of Trustees for a Town Wetlands Permit to remove and replace (in-place) an existing timber bulkhead with a vinyl bulkhead and incidentally dredge a maximum of 25 cubic yards lost backfill material from a 10-foot area adjacent to the new bulkhead, which shall be used as backfill landward of the new bulkhead. I have indicated that all policies are "Not Applicable," because pursuant to Town Code 995-5(A) and the corresponding definitions of "action" and "minor action" by 995-3, the submission of a L WRP Consistency Assessment Form is not required for this application, as the proposed work entails only "maintenance or repair involving no substantial changes in an existing structure or facility." This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. · Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2.
