Patricia C. Moore, Esq. on behalf of THOMAS LUNIEWSKI requests a Wetland Permit to construct a
4'X 32' dock, 4'X 12' ramp and 6'X 20' floating dock. Located: 470 John's Rd., Mattituck. SCTM#122-
3-25.2
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the L WRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with
the L WRP provided that the reviewing agency demonstrates the action meets Chapter 97 specifically S
275-11. Construction and operation standards:
I Policy 6
Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction.

(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[I] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel
congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating,
fishing, shell fishing, waterskiing and other water-dependant activities;
[3] Whether the dock will unduly interfere with transit by the public along the public beaches or
foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or
near the dock;

[5] Whether the dock will cause degradation of surface water quality and natural resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife
habitats;
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. Ifany question in Section C on this form is answered "yestt, then the proposed action may affect
the achievement of the L WRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of South old's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and
the Town Clerk's office.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances
community character, preserves open space, makes efficient use of infrastructure, makes
beneficial use of a coastal location, and minimizes adverse effects of development. See L WRP
Section III - Policies; Page 2 for evaluation criteria.

Discussion (if appropriate): Waterfront residence wishes to place residential dock for
private use. Dock proposed which will enable a small pleasure boat to be used by a
family.
Policy 2. Protect and preserve historic and archaeological resources of the
Town of Southold. See L WRP Section III - Policies Pages 3 through 6 for evaluation criteria

Discussion (if appropriate): Parcel is not on Archeolo~ical inventory map. The dock will
enhance the historic maritime culture. Recreational boaters support the coastal
culture and promote preservation of historic lil!hthouses. The dock promotes the
economic revenue of the maritime economy.

Discussion (if appropriate): Location of dock is sensitive to the {lreservation of tidal
wetlands. The dock is elevated to preserve and protect the natural resources. The
dock is limited in size to protect scenic resources. The size and location is in keepinl!
