Located: 2820 Shipyard Lane, East Marion. SCTM#38-7-]5 The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the L WRP. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written detemlination regarding the consistency of the proposed action. Infrastructure use is not a factor since the project is to extend an existing erosion-control structure. The project is certainly beneficial in supporting and maintaining an existing use of the coastal 10- cation, without any incremental increase in development in the area. Preserve historic resources of the Town of Southold. D NO D NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly close-shore nature of the pro- ject area is unlikely to have been the site of activities of past civilizations. Enhance visual quality and protect scenic resources throughout the Town of Southold. ~S D NO D NOT APPLICABLE The proposed dune construction, including planting of native species of vegetation, does not involve changes to or the addition of any above-ground unnatural struc- tures and upon its completion its effects will enhance the vista from both land and water. It is compatible with other existing shoreline features and activities in the area, and will not adversely affect the dynamic landscape elements (tidal fluctua- tions, seasonal vegetation changes; seasonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. ~S DNO D NOT APPLICABLE It is intuitively obvious that the likelihood of the activity proposed contributing to increased hazards which could result in the losses listed is minimal. Natural protec- tive features are, in fact, being enhanced and strengthened, and will not be ad- versely affected Policy 5 Protect and improve water quality and supply in the Town of Southold. ~S D NO D NOT APPLICABLE The proposed project does not include any activity which will have a long-term adverse effect on water quality and supply. The placing of the clean sand fill to construct and dune-like area to replace the one lost to erosion may be beneficial in that it will prevent the inundation of a large portion of the lawn area and may re- duce the leaching of salt water into the ground water below the lawn area. Liquid or solid wastes will not be discharged into the water or wetlands before, during, or after the proj ect work. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosys- tem. ~YES D NO D NOT APPLICABLE The area of the project has been damaged by erosion in that an existing dune-like area has been washed away and a portion of the area landward of that has been eroded. The project is intended to restore the.dune-like area and provide protection against ordinary future erosion. During installation existing areas of wetlands vegetation, if any, will be protected insofar as possible. The project is near, but not included in, the Orient Harbor Significant Coastal Fish and Wildlife Habitat. The nature of the project, considering that it is the extension of an existing approved erosion-control feature, is such that there will be no new impacts on any of the re- sources listed in the NYSDOS narrative for the nearby Orient Harbor. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. Policy 7 ~YES Protect and improve air quality in the Town of South old. D NO D NOT APPLICABLE The project as proposed will not result in significant amounts of new air pollution. The purpose of the project is to protect a section of shoreline from further erosion, and it is not the intention of the project to make possible or encourage the docking or mooring of powered watercraft. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. ~ES D NO D NOT APPLICABLE The project as proposed will not result in the generation of any new or additional solid waste. The handling and storage of petroleum products both during the pro- ject operations and upon its completion will be accomplished through the use of approved containers and facilities, and approved methods of handling and storage will be followed. Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Policy 10 Protect Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations.
