Ritchie Latham Kenneth Edwards William Cremers Valerie Scopaz, Town Planner Melissa Spiro, Planner Robert O. Kassner, Site Plan Reviewer Martha Jones, Secretary Absent: Richard G. Ward Mr. Orlowski: Good evening. I'd like to call this meeting to order. The first order of business, Board to set Monday, November 3, 1997 at 7:30 p.m. at Southold Town Hall, Main Rd., Southold, as the time and place for the next regular Planning Board meeting. Mr. Cremers: So moved. Mr. Latham: Second. Mr. Orlowski: Motion made and seconded. Any questions on the motion? All those in favor? Ayes: Mr. Orlowski, Mr. Latham, Mr. EdWards, Mr. Cremers. PUBLIC HEARINGS Mr. Orlowski: Bayview/South Harbor Partnership - Phase 2 - This clustered major subdivision is for 4 lots on 12.49 acres located on the east side of Southold Town Planning Board South Harbor Rd. in Southold 2 October 6, 1997 SCTM# 1000-75-4-8 & 22.'1. Mr, Croteau, do you have our park and playground fee? Michael Croteau: Yes 1 do. (Applicant submitted park and playground fee.) Mr. Orlowski: I will ask if there are any comments on this subdivision? Hearing no further comments, any questions from the Board? Mr. Latham? Mr. Latham: No. Mr. Orlowski: Mr. Cremers? Mr. Cremers: No Mr. Orlowski: Mr. Edwards? Mr. Edwards: None. Mr. Edwards: I'd like to entertain the following motion WHEREAS, Bayview South Harbor Partnersh p is the owner of the property Known and designated as SCTM# 1000-75-4-8 & 22.~, located on the east side of South Harbor Rd. and the west side of Main BayView Rd. in Southold; and WHEREAS, the Planning Board has classified the current application as a Southold Town Planning Board October 6, 1997 major subdivision since there have been prior subdivisions on the subject lot and the current application brings the total number of lots to 5; and WHEREAS, Lot Number 2 of the subdivision approved by the Planning Board on October 24, 1994 included a total area of 12.5472 acres of which 9.3741 acres'is located within a conservation easement and 3.1731 acres is located within a development area; and WHEREAS, the subdivision before the Planning Board is for a clustered subdivision of 3 lots within the 3.1731 development area; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on November 25, 1996; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on OCtober 6, 1997; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final surveys dated September 25, 1997. (Chairman endorsed surveys) Mr. Orlowski: Corso-Steele-Modlin: - This application, which is for 4 lot line changes, is to subtract 51,020 sq. ft. from a 17.94 acre parcel and to add 1,188 sq. ft. to existing Lot I; 17,554 sq. ft. to existing LoT 2; 13,802 sq. ft. to existing Lot 3; 18,476 sq. ft. to existing Lot 4, and to relocate an existing Soul:hold Town Planning Board 4 October 6, 1997 50 foot wide r-o-w to run along the southeasterly line of the revised parcels. The parcels are located on the north side of Oregon Rd. in Cutchogue. SCTM# 1000-83-2-10.2, 10.3, 10.4, 10.5 & 10.6. I'll ask if there are any comments on this? Mr. Cremers: Mr. Chairman, I'll offer the following resolution. WHEREAS, Louis Corso and others, Timothy and Jeanne Steele, and Irvin and Maria Modlin are the owners of the properW known and designated as SCTM# 1000-8:5-2-10.1, 10.3, I0.4, 10.5 & 10.6, located on the north side of Sout;hold Town Planning Board 5 October6,1997 Oregon Rd. in Cutchogue; and WHEREAS, this application which is for 4 lot line changes, is to subtract 51,020 sq. ft. from a 17.94 acre parcel and to add: 1,188 sq. ft. to existing Lot I, 17,554 sq. ft. to existing Lot 2, 1:5,802 sq. ft. to existing Lot 5, 18,476 sq. ft. to existing Lot 4, and to relocate an existing 50 foot wide r-o-w to run along the southeasterly line of the revised parcels; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on September 15, 1997; and WHEREAS, as noted in a letter dated September 18, 1997 from Patricia Moore, Mr. Corso intends to relocate the existing road to the proposed location in the spring of 1998, and the new road will be constructed in the same manner as the existing road. The new road will connect to the existing access/driveway on the Modlin property and the Modlins will continue to have uninterrupted access over the proposed right-of-way; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on October 6, 1997; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated August 20, 1997, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. The condition must be met within six (6) months of the date of this resolution: New deeds must be filed for all parcels involved (Corso, Modlin and Steele) reflecting the lot line changes. All Hearings Held Over From Previous Meetings: Mr. Orlowski: Broadwaters Cove - This site plan is for the expansion of a concrete block tool shed at an existing marina located on Skunk Lane (Bay Ave.) in Cutchogue. SCTM# 1000-104-8-2.5. This is another hearing we'll hold open at this time because we haven't gotten anything back from the Health Department. I'll entertain that motion. Mr. Edwards: So moved. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS Preliminary Extensions: Mr. Oriowski: Peconic Development (a.k.a Harvest Homes) - This major subdivision is for 13 lots on 14.9 acres located on Oaklawn Ave. and Wells Ave. in Southold. SCTM# 1000-70-3-22. Mr. Cremers: Mr. Chairman, I'll offer the following resolution. Be it resolved that the Southold Town Planning Board grant a six month extension of preliminary approval from September 30, 1997 to March 30, 1998. Setting of Final Hearings: Mr. Orlowski: Sallie Wells and James & Mary Ellen Ruhr - This proposed lot line change is to subtract 0.31 acres from an existing 17.88 acre parcel, and to add it to an existing 0.87 acre parcel. The parcels are located on the south Side of Westphalia Rd., approximately 24 feet west of the intersection of Bennett's Pond Lane and Westphalia Rd., in Mattituck. SCTM# I000-113-13- I&2. Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board set Monday, November 3, 1997 at 7:30 p.m. on the final public hearing on the maps dated January 24, 1997 Mr. Cremers: Second the motion. Motion carried Mr. Edwards: Mr Chairman, I further move that the Southold Town Planning Board, acting under the State Environmental Quality Review Act to an uncoordinated review on this unlisted action. The Planning Board establishes itself as Lead Agency and as Lead Agency makes a determination of non- significance and grants a Negative Declaration Mr. Latham: Second. October 6, 1997 SITE PLANS Waivers: Mr. Orlowski: Donna Dinolfo - This site plan waiver request is for a lingerie business on Main Rd. in Southold. SCTM# 1000-62-3-2.1. Mr. Cremers: Mr. Chairman, I'll offer the following resolution. WHEREAS, Donna Dinolfo is the lease holder of the property known and designated as SCTM# 1000-62-3-22.1 located at 56340 Main Rd. in Southold, and; WHEREAS, a retail store is a permitted use in this Hamlet Business zone; and WHEREAS, an examination has been made of all uses and the existing parking was determined to be adequate for all uses; and WHEREAS, the proposed change from a former use as used clothing sales to lingerie sales will not be a more intensive use of this property~, and WHEREAS, any violation of the conditions of this resolution may be grounds for rescinding this waiver; be it therefore RESOLVED, that the Southold Town Planning Board gran~ a waiver of site plan requirements. SITE PLANS - STATE ENVIRONMENTAL QUALITY REVIEW ACT Southold Town Planning Board Lead Agency Coordination: 9 October6,1997 Mr. Orlowski: Peconic Landing at Southold, inc. -This application is to amend an approved site plan for construction of 118 single family detached cottages; 132 apartment units; 24 unit assisted living center; and 32 bed skilled care center with supporting amenities. SCTM# 1000-35-~-25. Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board start the Lead Agency coordination process on this Type ~ action. Mr. Cremers: Second the motion rvlr.
