Mr. Orlowski: Good evening. I'd like to call this meeting To order. The first
order of business, Board to set Monday, October 6, 1997 at 7:30 p.m. at
Southold Town Hall, Main Rd., Southold, as the time and place for the next
regular Planning Board meeting.

The development rights have been sold to the Town of Southold on
40.8799 acres of the 42.7253 acre parcel. Lot I is a total of 24.4211 acres,
including a 1.8454 acre area with development rights. Lot 2 is 18.3042 acres
on which all development rights have been sold to the Town. SCTM# 1000-

WHEREAS, on March 4, 1997 the Southold Town Board approved an
Agreement ~:or Modification of Restrictions ~)etween Parker Dickerson, Betsey
Dickerson and Chester Dickerson and the Town of Southold, giving the
Dickersons the right to split off and sell the southerly eighteen (18) acres of
the property with the condition that both resulting oroperties may only be
used for agricultural purposes and that no further subdivision shall occur;
and
WHEREAS, the Dickersons have applied to the Planning Board to subdivide
the 42.7253 acre parcel into two lots; and
WHEREAS, Lot 1, which is a total of 24,4211 acres, includes a 1.8454 acre
area on which the development rights are intact, and Lot 2, which is a total
of 18.3042 acres does not include any development rights; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on June 9, 1997; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York, on September 15, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58,
Notice of Public Hearing, has received affidavits that the applicant has
complied with the notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize
the Chairman to endorse the final surveys dated June 25, 1997.

lots on '8.54 acres, located on the south side of North Bayview Rd. in
Southold. SCTM# 1000-79-8-13. Before I open this hearing 'd like to
entertain a motion that be it resolved to adopt the reduced bond estimate
dated September I~, 1997, which reflects the work completed to date and
to recommend same to the Town Board This reduced bond estimate is in
the amount of S14,250.00.

Mr. Ward: Mr. Chairman, I'd like to offer the following resolution.
WHEREAS, Russell Pellicano is the owner of the property known and
designated as SCTM# 1000-79-8-1:5, located on the south side of North
Bayview Rd. in Southold; and
WHEREAS, this proposed m~nor subdivision is for 4 lots on 18.54 acres; and
WHEREAS, the Planning Board has required that covenants and restrictions
be filed pertaining to the proposed subdivision; and
WHEREAS, the Declaration of Covenants and Restrictions has been filed in
the Suffolk County Clerk's Office in Liber 11796, Page 176; and
WHEREAS, the Planning Board has required that the area located outside of
the building envelope for Lot I be contained in an Open Space Easement,
the terms for which are described in the recorded Declaration of Covenants
and Restrictions; and
WHEREAS, as noted in the Declaration of Covenants and Restrictions, the
Planning Board has required that there shall be no further subdivision of any
lot within the subdivision in perpetuity; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead

Hearings Held Over From Previous Meetings:
Mr. Orlowski: Broadwaters cove - This site plan is for the expansion of a
concrete block tool shed at an existing marina located on Skunk Lane (Bay
Ave.) in Cutchogue. SCTM# 1000-104-8-2,5. The hearing is held open and
'd like to entertain a motion to hold this hearing open since we haven't
heard anything from the Health Bepartment or the ZBA. Does anyone have a
comment while the hearing is open?
William Breene: President of 9roadwaters Cove Association and we've been
to, I think this is my fourth meeting. And how many more meetings before
any action is going to be taken? We're not that.., well, sure we're concerned
about the expansion of his motor repair facility. You've got a site plan and
he wants to add 10 feet or something like that, am I correct up to now?
Mr. Orlowskh Yes.
Mr. Breene: We were concerned that he's in violation of MI zoning, and are
you people the people we should be talking to or not, because the last
meeting I went to, they said if he's in violation that had to do with the Town
Board of Appeals? We went to the Town Board of Appeals and they sen[ it
back to you..."Your request for an opinion regarding a specific application
before the Planning Board is not addressed by the Board due to improper
procedure and lack of proper jurisdiction." And they're requesting that you
if you want a ruling by them that you must file the proper papers.
Mr. Orlowski: Well, in this case I had a conversation with the Chairman of the
Zoning Board and they've since senta letter to the Town Attorney
requesting an interpretation of that pad; of the code that we've used several
times before in regards to them giving us interpretation in this circumstance.
At this point, they seem to be telling us something different from before,
but they have sent 8 letter to the Town Attorney. And since we are waiting
for Health Department, we're going to hold this hearing open until they get
that interpretation and then we'll have to go from there.

Mr. Breene: What if the Board of Health approves, then you people make a
decision, approve the site plan if you get approval from the Board of Health,
is that about where we're at?
Mr. Orlowski: Well, it could be, depending on if al the questions are
answered.
Mr. Breene: Well, don't know if we're barking up the wrong tree or not,
because if you know the history, Petucci built that manna and he sold it to
Norman Boos and before he could sell it he qeeded a ruling before the Town
Board of Appeals. And specifically in a letter it says you are not permitted to
store boats, build boats or conduct a retail sake of boats on your premises.
Now, what has changed, that's what we're concerned about?
Mr. Orlowski: What's the date on that letter?
Mr. Breene: Twenty years ago. 1978.
Mr. Orlowski: The zone changed.
Mr. Breene: OK The zone changed and legally that's an, M1 zone. But that
specifically is spelled out in usage by amount of area above the high water
mark. And our major contention is that there are all kinds of violations
because for that size a marina, we consider it has seven uses, and for that
area clearly spelled out in M1, M2 zoning, it's got to do with 4,000 square
feet each usage. And unless somebody else can g~ve us a different
interpretation, this thing is just going to grow into a major marina in a small
residential district, which we're totally opposed
Mr. Cremers: Mr. Breene, we have sent another letter back to the ZBA and
this time we've asked for an interpretation instead of an opinion, and that's
where it stands right now. And the code says that the ZBA should be
answering interpretations from other Boards and that's where we stand at
this point.
Mr. Breene: Well, is it your jurisdiction or their jurisdiction? Who is in charge
of these violations? Last I heard they were going to send some kind of
nspector around...l've got his name, the Building Inspector and he was
going to look at a lot of things And nobody reports back to us. The only
sounding board we have is this meeting and we've never appeared before
the Town Board of Appeals because we're not on their agenda and they kick
it back to you people.

Mr. Cremers: Well, we'vejust kicked it back to them again.
Mr. Breene: Can you see where our frustration comes from? And just to say,
OK, let him build another 10 foot on a marine facility for fixing motors, is not
what we're about. And that seems to be your jurisdiction
Mr. Cremers: That is our jurisdiction. But we're asking them for an
interpretation of the code, and that's their...
Mr. Breene: Will we be alerted to their interpretation? How are we going to
be apprised of this information?
Mr. Cremers: Well, as Mr. Orlowski said, they wrote a letter to the Town
Attorney and they're waiting for an answer back from the Town Attorney on
should they proceed or not.
Mr. Breene: But when I asked what was on the agenda tonight they saiC that
it's an open meeting because the Board of Health hasn't reported back.
What the Board of Health has to do with anything, unless you have to have it
before you can approve his site plan.
Mr. Orlowski: We have to have that before we approve the site plan
Mr. Breene: But say for instance you do approve the site plan, that's still not
what we're majorly concerned with. Sure, it'll expand his faciliW there, but
what about all of the other illegal uses that we contend there are? Who do
we talk to about that?
Mr. Orlowski: Well, we're waiting for that answer. We're going to make the
decision on the site plan, that's our job.
Mr. Breene: That's your job.
Mr. Orlowski: That's our job. The question of the M1 use is, is it an accessory
use or is it a separate use. has to be answered by the Zoning Board of
Appeals That's their job. And it's spelled out pretty specific in the code and
always has been. It isn't a place I guess that you could go to to change their
minds, because they have to make up their own minds by defining the code
for us, which they have done in the past. I'm not sure why in this case
they've sought to seek the Town Attorney's advice on whether they can do
it or not. We're all in agreement that it's very specific in the code that
anybody that asks them a question they should get the answer. When we
find that out, we'll pass that hurdle because that's been the comment at
this public hearing that we have kept open aqd we'll move on from there.

Mr. Breene: But what do we do, say for instance their interpretation is
different than ours? Do we hire an attorney and do we have a forum where
we can argue our position?
Mr. Orlowski: Article 78.
Mr, Breene: Well, I've heard of that before. I(rupski told me to get a copy of
Article 78 and we haven't hired an attorney, wejust want to know how to
proceed to see that these violations are corrected and there's no expansion
if it's illegal. It's kind of just a fair position,
Mr. Orlowski: We agree with you and we're not trying to throw you back and
forth, we just need the Zoning Board's interpretation of the code for
ourselves. We're going to make the decision.
Mr. Breene: We've gotten no satisfaction honestly, and that's what we're
looking for, to know what direction we should proceed in. We have the
president of Nassau Point Association which is a lot bigger than our
association. He's here tonight. Xavier, do you want to ask some questions?
Xavier Fleming: I don't know again if this is an aopropriate time to bring this
to light. There have been all Kinds of objections to expanded use in the last
few years with respect to this property by Mr. Breene's association and the
Nassau Point Property Owner's Association. And it's our fear that someday
we'll have Port of Egypt on Bay Ave. with multiple level boat storage racks
and huge fork lifts anc~ over the last 30 years it's getting closer and closer to
that.
My specific question is, on the site plan that's been submitted, what Kind of
parking facilities are in there on the site plan that's been submitted by
Broadwaters Cove Marina?
Mr. Orlowski: Well, have you taken a look at the site plan itself?
Mr. Fleming: I have not, no.
Mr. Orlowski: It's hanging outside and it does show parking and that stuff.
Mr. Fleming: Because back in 1979 when, I thought it was the ZBA, gave
Petrucci a non-conforming residential zoning status. He was alloWed 35
boats 24 feet or less. Since then it has expanded to close to 50 boats. With
the MI zoning he's required to have one parking spot per boat and one
parking spot per employee. So with the continued growth of the marina the
parking situation should be in consideration with the site plan. Because if ne
puts 100 boats there he's obviously not going to be able to accommodate

them with the legal requirement of the parking spaces. They're required by
law and that appears to be black and white. I don't think that needs
interpretation
Mr. Orlowskh No, that will be interpreted by our site plan reviewer in the
Planning Board office.
Mr. Fleming: That was my only specific comment in addition to what Mr.
Breene had to say. Thank you.
Mr. Orlowski: We're go~ng to hold this hearing open so we'll be back here
again on October 6. I don't mean to run you around but we would like to
get an interpretation to do this all right. ~'II entertain a motion to hold the

changes, is to subtract 51,020 sq. ft. from a 17.94 acre parcel and to add
1,188 sq. ft. to existing Lot I, 17,554 sq. ft. to existing Lot 2, 13,802 sq. ft.
to existing Lot 3, 18,476 sq. ft. to existing Lot 4, and to relocate an existing
50 foot wide r-o-w to run along the southeasterly line of the revised parcels.
The parcels are located on the north side of Oregon Rd. in Cutchogue.

following conditions:
The contract between Posillico Construction Company, Inc, and the
owners of the subject property, which allows for the right and privilege
of ingress~and egress over a portion of August Lane, must be recorded.
A copy of the recorded document must be submitted to the Planning
Board office.
The Planning Board has allowed the proposed subdivision to be
designed.with lots exceeding the required zoning requirements rather
than requ~nng that the lots be cluste, ed, w~th the requ~remen that no
lot shall be further subdivided in oerpetuity. A Declaration of
Covenants and Restrictions must be recorded stating that there shall
be no further subdivision of any lot in perpetuity.
The subdivision has been designed with a road which shall be built in
accordance with the Town Highway SPecifications. The four (4)
prOposed lots are to have access from this proposed road. There shall
be no access to Lot 3 from Island View Lane. This restriction shall be
included in the Declaration of Covenants and Restrictions.
Building envelopes are to be shown for all lots.
A setback of seventy-five feet (75) for all buildings must be shown
on the map around the pond area. There shall be no clearing or
grading allowed within this area. This statement shall be included in the
Declaration of Covenants and Restrictions.

authorize the Chairman to re-endorse the final surveys dated August 14,
1995. This subdivision was endorsed by the Chairman on April 8, 1996.
However, the maps were not in proper form to be recorded in the County
Clerk's office and had to be redrawn.

Chairman to endorse a Certificate of Correction for this approved
subdivision. SCTM# 1000-121-3-2.
Mr. Ward: Mr. Chairman, I'd like to offer the following resolution.
WHEREAS, the major subdivision of Farmveu Associations was filed in the
Suffolk County Clerk's Office on September I, 1989; and
WHEREAS, a Certificate of Correction has been submitted by Werner Adel,
General Partner of Farmveu Associates, to correct a survey error of one of
the south lines and one of the west lines of the flied subdivision, as
described in the Certificate of Correction; be it therefore

RESOLVED that the Southold Town Planning Board authorize the Chairman to
endorse the Certificate of Correction before a Notary.
