SCTM# 35-6-29
ANNA COOPER requests a Wetland Permit to remove and replace 48' of existing bulkhead
with vinyl sheating. Truck in 15-20 cy. of clean sand/topsoil and place landward of the bulkhead
as backfill. Excavate area landward of the bulkhead as required and replace excavated material in
same place as fill. Located: 565 Osprey Nest Rd., Greenport. SCTM#35-6-29
The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to L WRP
review pursuant to Chapter 95 of the Town of Southold Town Code. This review will address
the backfilling of the bulkhead with 15-20 c. y. offill landward of bulkhead.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards aud therefore is
CONSISTENT with the L WRP provided the following best mauagement practice is
applied;
1. To further the intent of the LWRP and the policies, assess the proiect area for the
nse of a Iloatin!! turbiditv screen siltfboom durin!! re-constrnction activities of the
structure to minimize the potential turbiditv in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

of the bulkhead as required and replace excavated material in same place as fill.
DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
Our proposal is an in-place construction. This structure has been in existence for a number of years
and is failing. To prevent further deterioration of the bulkhead and erosion of her property, our client
is merely maintaining her property.

Our project does not involve any historic resources of the Town of Southold.
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The present condition of the bulkhead is failing. A new bulkhead will be much more aesthetically
pleasing than its present state.
NATURAL COAST POLICIES

As this structure conditions to age, it will completely fail subjecting this property to erosion.

This proposal will have no effects on the water quality or supply in the Town of Southold.
Protect and restore the quality and function of the Town of Southold's ecosystem.
The scope of our proposal is minimal. There will not be a significant amount of disturbance to the
ecological components. All excavating and filling will take place behind the bulkhead. This project
will not increase siltation, change the community composition, or increase the pollution.
Protect and improve air quality in the Town of Southold.
This proposal will have no effects on the air quality or supply in the Town of Southold.
Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and
hazardous substances and wastes.
Our proposal will not degrade the Town of Southold with solid waster or hazardous substances and
wastes. Our proposal will not produce any solid waste and hazardous substances will not be involved
in this project.
PUBLIC COAST POLICIES
Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and
public resources of the Town of Southold.
Our proposal is for in-place construction. Public access will not be increased or decreased due to this
proposal.
WORKING COAST POLICIES
Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
Our proposal is in place construction. It is our client's intention to maintain her property so that her
family can safely access the water from this property to enjoy water-dependent activites.

There are no commercial fishing opportunities in Gull Pond. Our proposal will have a minimal effect
on the wetlands and breeding grounds. Any disturbance will be recovered within in one season.
There is historically limited shell fishing opportunities in Gull Pond.

This proposal will have no effects on the agricultural lands in the Town of Southold.
