This letter is intended to summarize the points made during that meeting. The captioned premises consist of 21 acres on the south side of the Main Road between the vacant diner end the former Harry Goldman property southeast of the large NFB complex at Mattituck. The property is zoned R-SO end the property is located within one-half (1/2) mile of the Hamlet Business (HB) District, the Handy Pantry premises at the corner o£ Main Road and New Suffolk Avenue. Accordingly, under Section 100-141, the Town Board upon its own motion may designate these 21 acres as Hamlet Density (HD). Under Section 100-42(a)(1} single family detached residences would be permitted in HD District. T~e proposal here is that residences he constructed on half acre parcels, which is the minimum lot size required under the Density and Minimum Lot Size schedule in the Zoning Ordinance. Incident to this proposal the property owner would convey to the Town the northeasterlymost 4 acres for any municipal use approved by the Town Board, includin~ recreational use. Just to give you alittle background, our request to sub-divide this property began early in 1997. It has been proceeding with the Town Planning Board since our original request. Approximately four months ago, my wife and I attended a Planning Board meeting, with our prior attorney, Charles R. Cuddy. The Planning Board advised us, at this meeting, that everything they needed was submitted and we should get our approval in the next six to eight weeks. They advised us of a few minor items needed, which were given to them by Mr. Cuddy. A Public Planning Board Hearing was scheduled for August 12, 2002 at 6:00 p.m. A copy of letter of notification of this hearing is attached. Unfortunately, I was out of town on business on that date, but my wife attended the hearing with our then attorney, Charles R. Cuddy. It was at this meeting that my wife heard (and later I learned) for the first time that Charles R. Cuddy had been requested by the Planning Board, to make some minor changes to the map. Mr. Cuddy agreed to the changes, but he did not have anew map prepared for the meeting. Apparently, because this wasn't done, our subdivision could not be approved that evening. The Planning Board agreed to accept a new map and leave our sub-division hearing open until the map was presented to them. To date, we have not heard from the Planning Board regarding our conditional approval.. While the comments that were made at this meeting were directed to Mr. Cuddy, it is our family that is being penalized for another's inaction. Charles Cuddy asked Young and Young to prepare another map to reflect the requested changes and I hand delivered the new map to Carol at the Planning Board on August 16, 2002 at 11:20 a.m. Thereatter, a moratorium was adopted and my family is again, waiting for their right to mb-divide the property and build our house, as we have wanted for so long. My youngest daughter has recently come to live with us and it was our hope to have had our home constructed by now since we have been enduring the expense of renting until we can build our home. It is our understanding the Planning Board has all that is needed to approve this sub- division at this time. We respectfully request that a waiver from the moratorium be granted to us and the Town Planning Board approve the sub-division that we have so long been looking forward to. Presently we are in the process of moving to 2260 Wunneweta Road, Cutchogue, N.Y. 11935, and ask that any and all correspondence be sent to this address. We are no longer being represented by counsel and ask that Charles Cuddy not be contacted regarding this matter in the future. The texture of Plymouth soils PlA, P1B, : P1C, PmB3 and ProC3 from 0 to 27 inches is loamy sand, loamy fine sand, gravelly loamy sand and sand. From 27 to 58 inches, the texture is sand and gravel, coarse sand and gravelly coarse sand. The permeability of these soils is rapid. Available moisture capacity of these soils ranges from low to very low. These soils are droughty during periods of low rainfall. Unless irrigation water is applied, deep-rooted crops are better suited. Irrigation water can be applied at a rapid rate but frequent, small applications should be make to reduce the amount lost to downward movement. The organic matter content and natural fertility of these soils is low. Crop response to lime and fertilizer is fair. Maintenance of feElity is difficult because of the sandytexture. Frequent applications of small mounts of fertilizer should be made to reduce nutrient loss by leaching. The sandy surface layer reduces the suitability of these soils for nursery stock.
