Monday, February 14, 2005:

2004 A Local Law in relation to a new Chapter A106 ¥ Subd~/ision of Lan¢of the Code of the
Town of So0thold"; therefore, be it ,/ ~.. ~.
RESOLVED, that pursuant to Chapter A106, the Planning Board hereby classifies this
application as a Standard Subdivision; and be it further
RESOLVED, that the application must be revised and re-submitted to conform with Chapter
A106 - Subdivision of Land of the Code of the Town of Southold" in order for the Planning
Board to process the application.
RESOLVED, that the public hearing is hereby vacated.
Upon written request, the Planning Boar~l may credit previously paid application fees towards
the new application. The determination will be based upon the amount of work that has been
accomplished to date on the application.

Dear Supervisor Horton and Members of the Town Board:
Thank you for permitting my client and me to speak at
your work session on Tuesday April 20, 2004. This letter is
intended to summarize the points made during that meeting.
The captioned premises consist of 21 acres on the south
side of the Main Road between the vacant diner end the former
Harry Goldman property southeast of the large NFB complex at
Mattituck. The property is zoned R-SO end the property is
located within one-half (1/2) mile of the Hamlet Business (HB)
District, the Handy Pantry premises at the corner o£ Main Road
and New Suffolk Avenue. Accordingly, under Section 100-141, the
Town Board upon its own motion may designate these 21 acres as
Hamlet Density (HD). Under Section 100-42(a)(1} single family
detached residences would be permitted in HD District. T~e
proposal here is that residences he constructed on half acre
parcels, which is the minimum lot size required under the Density
and Minimum Lot Size schedule in the Zoning Ordinance. Incident
to this proposal the property owner would convey to the Town the
northeasterlymost 4 acres for any municipal use approved by the
Town Board, includin~ recreational use. A ~urther incident of
any such proposal would be the agreement of the property owner to
pay monies into a fund maintained by the Town for the acquisition

Dear Ms. Liguori:
I would like to take this opportunity to thank you for meeting with me on September 6t~,
and discussing the present status of our subdivision.
Just to give you alittle background, our request to sub-divide this property began early in
1997. It has been proceeding with the Town Planning Board since our original request.
Approximately four months ago, my wife and I attended a Planning Board meeting, with
our prior attorney, Charles R. Cuddy. The Planning Board advised us, at this meeting,
that everything they needed was submitted and we should get our approval in the next six
to eight weeks. They advised us of a few minor items needed, which were given to them
by Mr. Cuddy.
A Public Planning Board Hearing was scheduled for August 12, 2002 at 6:00 p.m. A
copy of letter of notification of this hearing is attached. Unfortunately, I was out of town
on business on that date, but my wife attended the hearing with our then attorney,
Charles R. Cuddy. It was at this meeting that my wife heard (and later I learned) for the
first time that Charles R. Cuddy had been requested by the Planning Board, to make some
minor changes to the map. Mr. Cuddy agreed to the changes, but he did not have anew
map prepared for the meeting. Apparently, because this wasn't done, our subdivision
could not be approved that evening. The Planning Board agreed to accept a new map and
leave our sub-division hearing open until the map was presented to them. To date, we
have not heard from the Planning Board regarding our conditional approval..
While the comments that were made at this meeting were directed to Mr. Cuddy, it is our
family that is being penalized for another's inaction.
Charles Cuddy asked Young and Young to prepare another map to reflect the requested
changes and I hand delivered the new map to Carol at the Planning Board on August 16,
2002 at 11:20 a.m. Thereatter, a moratorium was adopted and my family is again,
waiting for their right to mb-divide the property and build our house, as we have wanted
for so long. My youngest daughter has recently come to live with us and it was our hope
to have had our home constructed by now since we have been enduring the expense of
renting until we can build our home.
It is our understanding the Planning Board has all that is needed to approve this sub-
division at this time.
We respectfully request that a waiver from the moratorium be granted to us and the Town
Planning Board approve the sub-division that we have so long been looking forward to.
Presently we are in the process of moving to 2260 Wunneweta Road, Cutchogue, N.Y.
11935, and ask that any and all correspondence be sent to this address. We are no longer
being represented by counsel and ask that Charles Cuddy not be contacted regarding this
matter in the future.
We would be pleased to meet with the Planning Board if they wish to discuss this matter
with us directly.
It is believing that gets us, as individuals through hard times, and I believe that the
Planning Board will do the fight thing for our family by waiving the moratorium in this
instance and approve the sub-division as submitted.

The building envelope indicated on lot # 7 has been changed. The maps previously
approved by the Planning Board indicated the proposed building area to be immediately
adjacent to the southerly property line of lot # 6. This Building area location should be
verified by the Planning Board.
The construction of the common driveway for lot's # 2,3 & 4 should be 16' wide Blue
Stone Blend compacted~to a thickness of two (2") inches and should be a requirement of the
proposed construction.V In addition, a turnaround area with a forty-four (44') foot radius
should be established at the terminus of the common drive.
The flag access to lot # 6 should is proposed to be 16' wide.V/The access to lot # 7
appears to be 34' wide. (No dimension has been given.) For emergency access capability,
both flags should have covenants to permit one common driveway that would extend from
the roadway to the South Western corner of lot # 6./The Front Yard building envelope

The required DOT Work Permit dated 10/20/98 has been submitted to my office. A

As per your request, enclosed please find my review of the above referenced project.
The building envelope indicated on lot # 7 has been changed. The maps previously
approved by the Planning Board indicated the proposed building area to be immediately
adjacent to the southerly property line of lot # 6. This Building area location should be
verified by the Planning Board.
The construction of the common dr'veway for lot s # 2,3 & 4 should be 16' wide Blue
Stone Blend compacted to a thickness of two (2") inches and should be a requirement of the
proposed construction. In addition, a turnaround area with a forty-four (44') foot radius
should be established at the terminus of the common drive.
The flag access to lot # 6 should is proposed to be 16' wide. The access to lot # 7
appears to be 34' wide. (No dimension has been given.) For emergency access capability,
both flags should have covenants to permit one common driveway that would extend from
the roadway to the South Western corner of lot # 6. The Front Yard building envelope
setback for lot # 5 from the common driveway (to lot # 6 & 7) should also be 50'. (Not the
20' indicated on the plan)
The required DOT Work Permit dated 10/20/98 has been submitted to my office. A
Bond Estimate has been reviewed, revised and enclosed for your use. Please note, that the
estimate submitted does not include work within the State Right-of-way.

Objective:
The landowner is considering installing a perennial greenhouse operation on
this property. The land had previously been cleared of trees and all that
remains is stumps and regrowth at the base of the stumps. All brush, limbs,
and stumps should be chipped or removed from the property to facilitate the
installation of over wintering houses.
The greatest concern in an operation such as this is the control of runoff
generated from the impervious roof surfaces. It will be very important to
design and install an appropriate roof runoff management system to avoid
future erosion and sediment problems as well as eliminate potential flooding
concerns.
The proposed plan is a working document and should be revised and
updated as the landowners goals and objectives change.

from accumulating in the containment area.
Fuel tanks shall have a fuel level gauge and all piping and
connections to tanks should be at the top conterline of the tank
to avoid leaks. Install automatic shut off valves on electHcally
operated dispensers.

where movement of odors toward neighbors will be minimized.
Buffer areas, vegetative screens, and neturel landscape features
can help minimize the effects of odors. Divert surfaco runoff
from outside drainage areas around the compost facility and
dispose of it properly. Windrowed piles should be triangular to
)arebolic in cross-sectional form with a base to height ratio of
about 2 to 1. Increased surface area increases
evaporation and natural aeration. Aligning piles north to south
and maintaining moderate side slopes maximizes solar
warming. Windrows should bo aligned to avoid accumulation of
)recipitation. Do not locate compesting facilities on soils with
seasonal high water tables or within 100 feet of wetlands or
surface waters.

System flow rate evaluations should be performed to determine
actual application rates. This information is critical when
determining how long to operate the system. Soil moisture
monitoring devices such as tensiometers and the neutron
gauge can be useful in determining when to irrigate and how
~uch water to apply.
I 12 acres Land Clearino (AC) (460) - Remove trees, stumps, brash and
other vegetation to improve the ;u..ability of the land.
The trees that are cut and removed can be used as timber or
firewood. The wood shall be stacked as not to cause any
hazards to persons, property or wildlife. Brash, leaves, stumps
and limbs will be chipped and/or composted on site or removed
i=rem the property. All applicable state and local laws shall be
followed. Once cleared, the land will be left in a ~ea~ and sightly
condition that will facilitate the planned use and treatment of
lhe land. If the land will lay idle for one month or more a cover
crop should be planted to protect the soil from erosion.
1 12acres Nutrient Manauement (590) - Apply lime and fertilizer according
to annual soil test results. Calibrate fertilizer equipment
annually to ensure that recommended ~a~e$ are applied.
Additional concerns when applying fe~riii=e~ include:
I. Making adjustments to rate, timing, placement and method
of application. This may include split applications, slow
release fertilizer and nutrient inco~
2. Use of cover crops to take up excess nutrients and prevent

The implementation of this conservation practice aids in the
interception of sediment, nutrients, pesticides and other
materials in-surface runoff, and reduces nutrients and other
~ollutants in shallow subsurface water flow ~mun(tweter).
In addition, the woody vegetation in buffem provides fond and
cover for wildlife and slows flood flows.
A maintenance plan for this buffer should consider:
1. Periodic harvesting of forested areas according to a
prescribed schedule to maintain buffer health.
2. Now plantings should be protected from grazing and high
traffic during establishment.
I as needed Roof Runoff Manaoement (558) - Installation of a system to
collect and convey runoff from all roof areas including over
wintering houses and outletting to a stable outlet such as
vertical drains or underground outlets. By centmlling runoff
from each individual greenhouse flooding, erosion and sediment
~reblems are greatly reduced.
I as needed Vertical Drains (630) - This practice is applicable in locations
where subsurface soils can receive and transmit or store runoff
from surface or subsurface drainage systems.
VVhen installing vertical drains the following should be
censidemd:
1. The number and size of vertical drains need to be
adequate enough to handle the designed dminege flow.
2. A suitable filtering system for removal of sediment, pdor
to entedng the drain should be installed.
3. Materials should be of adequate strength to Sewe the

PI Plymouth Soils (PLA, P1B, P1C, PmB3, PmC3, PsA, PsB)
Plymouth soils consist of deep, excessively drained, coarse-textured soils that formed in a layer of loamy
sand or sand over thick layers of stratified coarse sand and gravel. The texture of Plymouth soils PlA, P1B,
: P1C, PmB3 and ProC3 from 0 to 27 inches is loamy sand, loamy fine sand, gravelly loamy sand and sand.
From 27 to 58 inches, the texture is sand and gravel, coarse sand and gravelly coarse sand. The
permeability of these soils is rapid. Available moisture capacity of these soils ranges from low to very low.
These soils are droughty during periods of low rainfall. Unless irrigation water is applied, deep-rooted
crops are better suited. Irrigation water can be applied at a rapid rate but frequent, small applications
should be make to reduce the amount lost to downward movement. The organic matter content and natural
fertility of these soils is low. Crop response to lime and fertilizer is fair. Maintenance of feElity is
difficult because of the sandytexture. Frequent applications of small mounts of fertilizer should be made
to reduce nutrient loss by leaching. The sandy surface layer reduces the suitability of these soils for nursery
stock. Because of the above limitations, these soils are only fairly well suited to crops commonly grown in
Suffolk County.
PlA Plymouth loamy sand, 0 to 3 percent slopes. This soil is nearly level but it is somewhat undulating in
! places. The erosion hazard of this soil is slight, although runofffrom adjacent frozen areas causes severe
i gullies in places. A cover crop in winter is needed to protect the surface layer from erosion by wind and
: water.
CuB Cut and fill land, gently sloping. Consists of gently sloping areas that have been altered by
i grading operations for housing developments, shopping centers and similar non-farm uses. On
site investigations are necessary to determine the soil characteristics for a given site.
