Mr. OriowskJ: Good evening. I'd like to call this meeting to order. The first
order of business, Board to set Monday, January 11, 1999 at 7:30 p.m. at
Southold Town Hall, Main Rd., Southold, as the time and place for the next
regular Planning Board meeting.
Mr. Cremers: So moved.

PUBLIC HEARINGS
Mr. OrlowSkj: 6:00 p.m Richard ReinhardL - This minor subdivision is for 3
lots on 20.3995 acres. Proposed lot #I is for 16.6060 acres of whiCh 14.6060
acres are pending the sale of the development rights. The proposed

subdivision is located on the northeast side of Alvah's Lane, 2873 feet north
of Main Rd. in Cutchogue. SCTM# 1000-102-4-5. I'll ask if there are any
comments on this minor subdivision?
Dorothy Carlson: I live on a contiguous property. I'm looking on the
subdivision map which I was able to pick up from the Planning Board. I just
wanted to be sure that there was no road intention of going across from
Alvah's Lane over to Bridle Lane.
Mr. OrlOwski: No, that will just be to access those two lots off of that cul-de-
sac.
Ms. Carlson: is the cul-de-sac to remain? Because the original map, there
was in intention to eventually I would regain my property from my cul-de-
sac. But now it doesn't look like it, yet I'm still paying taxes on that piece,
and what can I do with it? Nothing.
Mr. Orlowski: Yeah, the access from the cul-de-sac will just be that, an access
for the two lots. The cul-de-sac itself, I don't know how that could be
changed.
Ms. Carlson: There are plenty of dead-end streets that are (inaudible) dead-
end streets. I'm just concerned...what's happened already is that people
that are using that farm road keep cutting my corner closer and closer and
closer and I'm afraid if that cul-de-sac stays the way it is, they'll continue to
do that. I'm not real crazy about it because we have small children in that
area and there are at least 13 small children in that area and they come
shooting out and you really can't see. If they were made to go a little slower
because it's not so wide open, it would slow them down and I just think it
would be a little safer.
Mr. Orlowski: Well, this should pretty much end the thought of ever
connecting to Alvah's Lane and as far as the cul-de-sac goes, I'm not sure
how that works out legally. I see you have the lot to the south or to the
north?
Ms. Carlson: Number 19.
Mr. Orlowski: 197 Well, your lot line runs through the cul-de-sac there
somehow, so maybe you can talk to Ray JaCobs and see what he says about
it, because I'm sure they don,t want to maintain all that cul-de-sac either, so
maybe he can work out something with you.

Ms. Carlson: Well, it never gets plowed. It's really kind of a dead space there.
Mr. Orlowski: That would be for the Highway Superintendent to discuss it
with him and see what they would allow. I know they might not fix it
themselves but might allow you to cut it off.
Ms. Carlson: OK, thank you.
Mr. Orlowski: Any other comments on this subdivision?
Gall Wickham: Abigail Wickham for Mr. Reinhardt. I just wanted to review a
few things that the Board had asked. I submit the affidavit of posting and
mailing, that I'd like to submit for the record, together with a copy of the
Declaration of Covenants and Restrictions that address first the restriction of
planting along Alvah's Lane, or hedges or fences, and secondly the concern
that Mr. Richter had about the driveways from lots 2 and 3 not generating
any road runoff into the Town road and that the driveway aprons not be the
responsibility of the Town of Southold. And those covenants, I think, satisfy
that.
I also would like to submit to the Health Department notice that indicates
the only items remaining in order for them to sign the map are the
submission of a covenant asking for the...since the water passed, just a
standard private well covenant and filing of the map. All the Other items
have been completed. So that is going to be addressed immediately.
Mr. Orlowski: How long before you have these two items?
Ms. Wickham: We have just been advised as to the covenants. They will be
delivered to the Health Department. They have to be signed by Mr. Blakie
~ecause he is technically the owner, and delivered to the Health Department
for County review. In terms of actually getting the signed map, 'm not
going to venture a guess as to when the Health Department wi do it.
would guess two to three weeks, optimistically, to be honest with you.
Mr. Odowski: if need be, we can hold a special meeting or do it at one of our
work sessions since it's a public meeting.
Ms. Wickham: I appreciate the Board's accommodations here. We're under a
very heaw time...in fact we have to have it done by January I and we're
going to have to submit a request for a further extension from these people
to get al this done. Realistically, knowing the Health Departments schedule
over the holidays, I tel you it's going to ~e..

Mr. Orlowsld: There's nobody there now. They left already. Well, we'll hold
the hearing open.
Ms. Wickham: OK, subject to getting the signed maps from Health. The
other thing I wanted to mention was on the firewell, Mr. Reinhardt has
spoken to the fire commissioners and if they can come with some other
better alternative, they will waive a firewell, but at this point it does seem to
be a requirement until we can find some other way (inaudible)
Mr. Orlowski: Are there any wells on Alvah's Lane?
Richard Reinhardt: There's a well on Alvah's Lane. They meet tomorrow
night and one of the things we're going to talk about is access from Alvah's
to the two tots, for fire. Also and eight inch agricultural well on the property
that i'm going to fix up and put a new motor on, that I told them they can
have use of any time, so between those...
Mr. Orlowski: Well, I don't see them getting access off of Alvah's Lane for
those two lots. I would come off of Bridle Lane and everything is much
easier.
Mr. Reinhardt: Unfortunately, Crown Landing and Highland, that whole
subdivision, is only serviced by one firewell, so I think I'm going to be
supplying the other.
Mr. Orlowski: Well, I think you could probably make a good pitch in the fact
that you're preserving 14 acres there or 16, whatever it is, and you're only
adding two lots and you said you have a well there, so you might want to try
that.
Mr. Reinhardt: Thanks.
Mr. Orlowski: Good lucK. Anyone else, any comments? Hearing none, any
questions from the Board? I think we probably should hold it open until we
get everything else.

Mr. Orlowski: 6:05 p.m. Hare/and Janet Hohn - Public hearing in regard to
allowing the construction of a 6' by 6' platform and stairs underneath the
rear door of the existing house to occur outside of the building envelope
designated for Lot Number 2 in the Harry and Janet Hohn subdivision.

Rob Hermann: Rob Hermann of En-Consultants in Southampton. I'm here
representing Mr. & Mrs. Hohn. I'm anticipating this is a fairly straightforward
request, but just to clarify why we are here before the Board. There is a
proposal which has been approved both by the DEC and issue of waiver
letter by the Southold Trustees for a 6x6 platform and steps to serve a rear
door to the house that's not currently served that way.
The reason we're in front of this Board is because the Declaration of
Covenants and Restrictions from the original minor subdivision map stated
that there could not be any more construction regardless of how small,
outside of the original building envelope that was approved during that
subdivision process, it does allow a modification to those covenants based
on a vote by a majority plus one of the Board after a public hearing.
So we are here petitioning the Board to allow a modification of those
covenants to allow the construction of this platform as proposed on the site
plan in front of you.
Mr. Orlowski: Thank you. Any other comments? Any questions from the

WHEREAS, the Planning Board required a Declaration and Covenants and
Restrictions as a condition of subdivision approval for the Minor Subdivision
of Harry and Janet Hohn; and
WHEREAS, a Declaration was filed in the County Clerk's Office in Liber 11343
page 237; and
WHEREAS, Condition Number 3 of the Declaration states that "Houses and
their accessory uses, structures, and facilities, including, but not limited to
the access driveways for the subdivision lots, shall be sited and constructed
only within the building envelopes and driveway areas shown on the
subdivision map."; and
WHEREAS, the owners of Lot Number 2 in the Hohn subdivision have asked
the Planning Board to allow the construction of a 6' by 6' platform and stairs
underneath the rear door of the existing house as shown on the September
30, 1998 site plan for Lot Number 2; and
WHEREAS, the proposed construction is outside of the building envelope for
Lot Number 2; and
WHEREAS, the applicant received a waiver for the proposed construction
from the Town Trustees on October 21, 1998; and
WHEREAS, the applicant received a permit for the proposed construction
from the NYSDEC on October 13, 1998; and
WHEREAS, the Declaration requires that any modification to the Declaration
be approved by a majority plus one of the Planning Board after a public
hearing; and
WHEREAS, the Planning Board, pursuant to Chapter 58, Notice of Public
Hearing, has received affidavits that the applicant has complied with the
public hearing notification provisions; and
WHEREAS, the public hearing to allowing the construction of a 6' by 6'
platform and stairs underneath the rear door of the existing house to occur
outside of the building envelope designated for Lot Number 2, as shown on
the site plan dated September 30, 1998, was held on December 14, 1998,
and closed on the same day;
be it therefore RESOLVED that the Planning Board approve the request to
construct the 6' by 6' platform and stairs underneath the rear door of the

existing house outside of the building envelope as shown on the September
30, '1998 site plan for Lot Number 2.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF

Sketch Extensions:
Mr. Orlowskh William J, Baxter - This proposed minor subdivision is for 4 lots
on 2.78 acres located on the nOrtheast side of 0tiffing St. and the southeast
side of School House Rd. in Cutchogue. SCTM# '1000-I 02-5-9.3.
Mr. Cremers: Mr. Chairman, I'll offer the following resolution.
BE IT RESOLVED that the Southold Town Planning Board grant an additional
six month extension of sketch approval from November 16, ~998 to May
~999. Conditional sketch approval was granted on May '18, '1995.
Mr. Edwards: Second the motion.
