BARGAIN AND SALE DEED WITH COVENANT AGAINST GRANTOR'S ACTS THIS INDENTURE, made thel5day of February, 2001 and BETWEEN KATHRYN M, REEVE, an individual with an address at 1150 Mason Drive, Cutchogue, New York 11935, party of the first part, and PRISCILLA LEWIN, as Trustee of the KMR Residence Trust, created pursuant to a trust agreement dated February 15, 2001 , with an address at Muchnick, Golieb & Golieb, P.C., 200 Park Avenue South, Suite 1700, New York, New York 10003, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, its 50% undivided interest as a tenant in common, in and to ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Incorporated Village of Cutchogue. County of Suffolk, Town of Southold, and State of New York, more particularly bounded and described as follows: BEGINNING at an iron pipe on the southerly side of Mason Drive distant 75.34 feet westerly from the corner formed by the intersection of the said southerly side of Mason Drive with the westerly side of Broadwaters drive; RUNNING thence south 1 ~ degrees 08 minutes 10 seconds east 274 feet to the highwater mark of Haywaters Cove along land now or fonnerly of Wyedan; THENCE along the said highwater mark of Haywaters Cove along a tie line having a course of south 67 degrees 39 minutes 50 seconds west and a distance of 228.60 feet to land now or fonnerly of Mason: THENCE north 12 degrees 08 minutes 10 seconds west 293 feet to the southerly side of Mason Drive, at an iron pipe therein; THENCE north 72 degrees 254 minutes 30 seconds east along said southerly side of Mason Drive 226.02 feet to the point or place of beginning. The above premises are the same premises conveyed to Kathryn M. Reeve, by the Estate of Roy H. Reeve, by deed dated May 28, 1999 recorded with the Suffolk County Clerk's Office. TOGETHER with all the right title and interest of the party of the first part, if any, of, in and to land below high water mark and under the waters adjacent to said premises. TOGETHER with all right, title and interest, if any, of the party of the first part in and to .any streets and road abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises; and also the estate therein, which the party of the first part has or has power to conveyor dispose of, whether individually; or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law. covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of. the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word 'party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.
