unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever,

Suffolk.
TOGETHER with all right title and interest, ifany. of the party of the fI.-st part in and to any

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part wilt receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose. The '..ord "party" shall be

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Hamlet of Matti tuck, Town of Southold, Suffolk Count}',
New York, being botmded and described as follows:
BEGINNING at the southeasterly corner thereof at a point, which marks the
northwesterly corner afthe terminus of Ruth Road and the south"....esterly comer of lands of the
subdivision kno'''TI as "Captain Kidd Estates"; Said point also being distant 89.06 feet
southwesterly from a comer having a radius of25.00 feet and a length of39.27 feet, said comer
forming the intersection of the \vesterly side of Rhoda Road and the northerly side of Ruth Road;
RUNNING THENCE in a southwesterly direction along the northerly line of Ruth Road
the following (2) tv.'O courses and distances:
1.) South 76 degrees .09 minutes 4.0 seconds West 153.26 feet;

AS SET FORTH in Chapter 59 and Chapter 6 of the Town Code of the Town of
Southold open space acquired by the Town pursuant to the provisions of those
chapters shali not thereafter be alienated, except upon the affirmative vote of a
majority of the Town Board after a public hearing and upon the approval of the
electors of the Town voting on a proposition submitted at a special cr biennial
town election. No subsequent amendment of the provisions of those chapters
shali alter the limnations imposed upon the alienation of rights acquired by the
Town prior to any such amendment. This restriction shali run with the land in
perpetuity.

DECLARATION OF COVENANTS
THIS DECLARATION, made this 1-4. day of June, 2004, by

Southold, New Yorl< 11971, hereinafter referred to as "DECLARANT".
WITNESSETH
WHEREAS, DECLARANT, is the owner of a certain plot, piece and parcel
of land situate at 1860 Ruth Road, Mattituck, in the Town of Southold,
County of Suffolk, and the State of New York, known and designated as SCTM#
1000-106-1-7, being more particularly bounded and described as set forth in
Schedule "A", annexed hereto.
NOW, the within DECLARANT does hereby covenant and agree as
follows:
1) The property will remain undeveioped in perpetuity for use as open
space and will be preserved as a wildlife sanctuary. Hunting of any
type prohibited.
2) This covenant/declaration shall run with the land and shall bind the
DECLARANT, his heirs, assigns and successors in interest.
