WHEREAS, the agent, Martin Sendlewski, on behalf of the applicant, submitted a site plan application for approval on December 18, 2007; and WHEREAS, this site plan, for SCTM#1000-84-4-1, a 6.3 acre parcel located on the west side of Cox Lane, and the south side of County Road 48, known as 5455 Cox Lane in Cutchogue, is for the proposed construction of a new one-story, 25,243 sq. ft. firehouse facility with a 15,075 sq. ft. partial basement, and 1,800 sq. ft. mezzanine. The proposed firehouse will include areas for apparatus bays, offices, ready room, communications office, training rooms, meeting rooms, kitchen and support facilities, bathrooms, and storage areas; and WHEREAS, the building will consist of 4,140 sq. ft. of assembly space to accommodate up to 276 people; 26,200 sq. ft. of storage space, 4,930 sq. ft. of office space, and 6,848 sq. ft. for miscellaneous purposes including bathrooms and mechanical rooms, for a total building space area of 42,118 sq. ft., and requiring parking spaces to accommodate 114 cars; and WHEREAS, the Cutchogue Fire District is the owner of the subject property; and WHEREAS, on November 15, 2007, the Southold Town Chief Building Inspector reviewed and responded "The proposed use for a Fire District building is a permitted use in this AC District and is so certified"; and Cutchoque Fire District Page Two February 12, 2008 WHEREAS, on December 18, 2007, the Planning Board accepted this application; and WHEREAS, on December 20, 2007, the Architectural Review Committee reviewed the architectural drawings and made recommendations and the Planning Board accepted these recommendations at their Work Session on January 14, 2008; and WHEREAS, on December 26, 2007, the Cutchogue Fire District responded, after review, stating a new fire hydrant was not necessary at the site due to the proximity of existing fire hydrants; and WHEREAS, on January 4, 2008, the Planning Department suggested revisions to the site plan, and on January 7, 2008, the Planning Board reviewed the revised site plan submitted by the applicant; and WHEREAS, the Cutchogue Fire District Board of Commissioners, acting under the State Environmental Quality Review Act (6 NYCRR, Part 617.5 c), conducted a coordinated review of this Unlisted Action, made a determination that the proposed project will not have significant adverse impact on the environment, and granted a Negative Declaration; and WHEREAS, on January 10, 2008, the Southold Town Engineer reviewed the site plan materials and provided comments, and the Planning Board accepts these comments; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 55, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; be it therefore RESOLVED, that the Southold Town Planning Board, pursuant to Town Code §280-131 B (5)(b), reserves the right to review the parking requirements again if a change of use is proposed; and be it further RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the Planning Board requires the applicant to agree to the conditions listed below; and be it further RESOLVED, that the Southold Town Planning Board grants approval on the site plan prepared and certified by Martin F. Sendlewski, AIA, Architect-Planner, dated February 12, 2008, and authorizes the Chairperson to endorse the site plan with the following conditions listed on the plan: Native shrubs and trees shall be planted in sufficient density to screen the parking areas from the view of passing motorists on Scenic CR 48. Cedars and other native plantings shall be chosen over non-native plants. The shrubs shall be planted in a natural pattern, and a hedge-like arrangement shall be avoided. All outdoor lighting shall comply with the Town Code and be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries, and be "dark-sky friendly." 3. All signs shall comply with the Town Code, and must be issued a permit from the Southold Town Building Inspector prior to posting. Cutchoque Fire District Page Three February 12, 2008 As per the landscape survivability guarantee, the applicant agrees to replace any of the landscaping which is diseased or dead within three (3) years of receiving final site approval after site work is completed; 5. The site plan approval requires that all work proposed on the site plan shall be completed within three (3) years from the date of this resolution. Prior to issuance of the Certificate of Occupancy, the owner or authorized agent must request, in writing, an on-site inspection by the Building Inspector and the Planning Board. 7. If the as-built site improvements vary from the approved site plan, the Planning Board reserves the right to request a certified as-built site plan detailing each deviation. Prior to the issuance of a Certificate of Occupancy, the Planning Board will issue a final site approval in writing following a site inspection, wherein it is determined that the construction complies with the approved site plan Copies of the approved site plan are enclosed for your records. Sendlewski, AIA Re: Cutchogue Fire District Cox Lane & County Rd. 48 Our Job #07-465 Gentlemen: Forwarded herewith are copies of the logs of two borings drilled at the above referenced site. The purpose of the subsurface investigation was to determine the nature and extent of the underlying soil deposits and determine the smmtural engineering characteristics of the soil at the site. A total of two (2) test borings were drilled to a depth of 27 feet each. A 2" diameter, 2'0" long split spoon sampler was advanced into the subsurface by the me of an automatic 140 lb. hammer with a 30" drop. From the drops of the hammer, blow counts required to advance the split spoon sampler over each 6" interval were recorded and are shown on the boring logs. Continuous split spoon samples were taken for the top 6 feet and then every 5 feet thereafter to the final depth. Our investigation revealed that the areas drilled are blanketed by from 18 inches to 30 inches of soft loam, underlain, generally, by a moderately dense naturally bedded sand formation with traces of gravel extending to the deepest depth drilled. No water, either natural or perched, was encountered in the boreholes at the time the work was done. All soils below 3 feet will satisfactorily support foundation loads of 2 tons per square foot. Where I live the Mattituck Firehouse will be closer than the proposed new firehouse. I believe that municipal planning needs to address the issues of cost, community demographics, natural resources, future growth, and safety of a proposed project. The justification and need for a new firehouse to serve Cutchogue has not been demonstrated. Frequent calls for specific information have not been answered because it has been claimed there is not enough space to provide it and representatives who have attended public meetings do not have the information to answer questions. If a legitimate need can be presented the community will consider providing the necessary funding. It seems like the plan of action is to present the case just days before a vote without providing the necessary time to digest the material presented. From a Planning Board perspective it is important that you understand the needs and issues like any other project you consider. We are here today and little or no justification has been provided for this project to the community. In the present financial times we live in the costs of the project is excessive. If the firehouse can be built for $7.5 million the district tax rate for a 30 year bond at prevailing rates will increase 34% to $97 per $1,000 assessed value over this year's rate of a little over $72 per $1,000 assessed value. If the firehouse costs more the rate will be higher. How does Southold protect over $31 million in assessed value for a rate of $50.01 per $1,000 of assessed value while Cutchogue protects $19.6 million in assessed value at the current rate without the new firehouse for $72 per $1,000 assessed value. In my early career I designed structures for municipalities. It was always less expensive to build a 2 story building than a one story building with the same square footage. The information forthcoming from the department is that the new and the old locations will be maintained. In a simplistic approach the existing firehouse has 5 equipment bays and the new has 5 double bays or 10 additional bays. I thought that without a serious purchase of developments the town was envisioned to grow by 20 to 25% over the next few decades. How can a 200% increase in equipment storage be justified? As I view aerial maps of the community on Google Earth it is apparent that the majority of the population is concentrated south of Route 25. I fail to see how the response time for emergencies will be improved as claimed when the new location is so much further to the north. I would not want to be the person having a heart attack to have to wait while the emergency vehicles wait for the train to clear the crossing. The intersection of Cox Lane and Route 48 has a bad reputation for serious accidents even with the traffic lights. Mention has been made that new equipment is getting larger. We have a limit on how high a building can be built. Why would the equipment need to be longer?. There are high shoulders along Cox Lane which would create more danger for those vehicles going the opposite direction than the emergency vehicle. There are plans to extend the water main to the new firehouse. With the water main extended the prospect of increased development in the area will follow. The community deserves to see the facts to justify this exorbitant expenditure. With the facts available a reasonable determination of what's required can be determined. (The meeting will probably run until 5:00 or later, so if you can't make it at 4:00, we can hold your application until you arrive). Lighting a) We typically request a lighting plan that shows the actual illumination rings right on the site plan. From the initial review of the lighting as submitted, we have concerns about the brightness of the site when fully lit, and whether that many lights at that strength are truly necessary. Please consider submitting a lighting plan to demonstrate the necessity for the proposed lights. b) Timing of lights (which lights are tamed on when) is also a consideration. For example, the Orient Fire District installed a bright light for its sign out front, and the residents asked for it to be turned off after a certain time of night to preserve the darkness. Cox Lane is dark now, adding many lights that will be on all night is not desirable. Please consider suggesting a schedule for which lights will be turned on and when. Landscaping a) Buffers between residential and non-residential uses are typically required to be 25' wide. The single line of arborvitae proposed are a sterile landscape treatment, and do not seem sufficient to provide adequate buffer to existing residences. Native evergreens planted in a wider buffer area would be more desirable. b) The visual buffer between the parking lot and CR 48, a scenic highway, also should be comprised of a natural array (not in a straight line) of native evergreen and other native trees and shrubs (not arborvitae), in a wide band parallel to CR 48. c) Landscaped islands are typically required in the center of parking lots where double rows of parking are proposed. Five foot wide "islands" would suffice along the center of the west and north parking lots, and along the area by the handicapped parking spaces in the east parking lot. 3. County DPW - the Planning Board will require a work permit from the County DPW before final sign-off on the site plan. Please call me with any questions. Otherwise, I will plan to see you Monday. Friemann, reviewed for the Board and those present that due to the increased population in the Cutchogue Fire District, the Fire Department had outgrown the facilities at New Suffolk Road, and there was not sufficient space to add additional facilities at this location, plus the need to provide more efficient and effective response to alarms, approximately two years ago the Fire Commissioners began an extensive search in cooperation with the Fire Chiefs to locate an appropriate'~parcel of prop~y~Lto fulfill the present and future needs of the Fire Distric~ Finally, after an intensive search, a 6.3 acre parcel was located at 5455 Cox Lane, Cutchogue, New York, and as a result of extensive negotiations the Fire District purchased same on October 13, 2006. The Chairman then reported that subsequently, Martin F. Sendlewski, AIA, a specialist in Fire District Planning and Design, was retained by the Board of Fire Commissioners to design a site plan and firehouse facility at this location to fulfill the needs of the Fire District. As a result, during the past year the Fire Chiefs and Board of Fire Commissioners have met numerous times with Martin F. Sendlewski and his staff to develop a cohesive plan for a new firehouse facility at this location to serve the public and, in particular, the residents of the Cutchogue Fire District. As a result of all of these efforts Martin F. Sendlewski has presented to the Board of Fire Commissioners a site plan and floor plans dated October 8, 2007, along with a Full Environmental Assessment Form dated October 8, 2007, for the consideration and approval of the Board of Fire Corm~issioners. The Fire Commissioners, along with the Fire Chiefs, have thoroughly reviewed these materials. The purpose of the subsurface investigation was to determine the nature and extent of the underlying soil deposits and determine the structural engineering characteristics of the soil at the site. A total of two (2) test borings were drilled to a depth of 27 feet each. A 2" diameter, 2'0" long split spoon sampler was advanced into the subsurface by the use of an automatic 140 lb. hammer with a 30" drop. From the drops of the hammer, blow counts required to advance the split spoon sampler over each 6" interval were recorded and are shown on the boring logs. Continuous split spoon samples were taken for the top 6 feet and then every 5 feet thereafter to the final depth. Our investigation revealed that the areas drilled are blanketed by from 18 inches to 30 inches of soft loam, underlain~ generally, by a moderately dense naturally bedded sand formation with traces of gravel extending to the deepest depth drilled. No water, either natural or perched, was encountered in the boreholes at the time the work was done. All soils below 3 feet will satisfactorily support foundation loads of 2 tons per square foot. Soil samples recovered during drilling operations will be stored in our lab for a period of 30 days after which they will be destroyed. During this period we will deliver these samples to any prescribed location upon request. The Secretary reported he had received only three responses which he had read to the Board when he was delivering the correspondence at this meeting. The Secretary then again reviewed the three letters, one from Suffolk County Department of Health Services dated October 19, 2007; one from Suffolk County Department of Public Works dated November 7, 2007; and one from the Town of Southold Planning Board Office dated November 7, 2007. After reviewing the responses with the Board, the Chairman asked the Secretary to give copies of the letters to the architect, Martin Sendlewski, for his comments to the Board. Mr. Sendlewski stated that he had read the letters and then reviewed each letter individually with the Board. Mr. Sendlewski stated that in connection with the comments of the Suffolk County Department of Public Works in its letter of November 7, 2007, he had met with the author of that letter, Mr. Justin Hipperling, and all of the items mentioned in the letter have been discussed and complied with and will be included in the formal application for the required permits from the Department of Public Works. Concerning the letter from the Suffolk County Department of Health Services, Mr. Sendlewski indicated that he reviewed the technical requirements mentioned in the letter with the Health Department and that both he and the Department are in agreement on the sanitary flow calculation of 4,116 gallons per day, and that when the formal application is made to the Department of Health Services the Fire District's plans and specifications will be in conformance with Chapter 6 and 12 of the Suffolk County Sanitary Code. Mr. Sendlewski then reviewed the content of the November 7, 2007 letter from the Southold Town Planning Director. The first comment made in the letter specifically refers to page 3 of Part 1 of the EAF, which questioned acreage of the roads, buildings and other paved surfaces which was listed at 2.2 acres. Mr. Sendlewski did not know why this was questioned as a check of the drawings and the calculations clearly indicates that these items will comprise 2.2 acres. As to the second com~ent concerning question 4 on page 5 of Part 1 of the EAF, it is true that this line was left blank as it was determined by the Fire Commissioners that it would not be applicable as no vegetation will be removed from the site, so to be perfectly correct, ~zero acres" should have been inserted. The next comment was on item 11 on page 6 of Part 1 of the EAF wherein the District had stated the project will not require any relocation of any projects or facilities. Chairman Friemann interjected that the answer to -1- this question is properly "no" as stated since there are no other projects and the Fire District is not going to relocate the existing firehouse on New Suffolk Road, as it is to remain as the principal firehouse of the Fire District. Mr. Sendlewski then stated that the last item in the Southold Town Planning Director's comments was on page 8 of Part 1 of the EAF questioning why approval would not be required of the Southold Town Planning Board, indicating if site plan approval was required that the Planning Board ~typically assumes lead agency". Mr. Sendlewski stated he was surprised to see this comment because in his 22 years of specializing in designing and building firehouses for over 60 different fire districts, the local boards, including planning board and building inspector's office, do not want lead agency status, deferring to the needs and expertise of the fire district as the design, location and associated site plan of the firehouses as they are considered critical buildings and have special requirements under the New York State Building Code which have to be certified the architect and/or professional engineer as to structure, design, drainage, location, ingress and egress, and other such issues. The result being, planning boards do not want to get involved with the site plan, firehouse design, location and layout, realizing that these are firematic functions and rely on the expertise of the fire district to do what is best for the residents of its district. This is especially true when considering the location and design of the firehouse in connection with firematic functions and emergency response times. Martin Sendlewski stated that since the Cutchogue Fire District is the agency that approves the project, funds the project and is undertaking the project, it should be the lead agency under SEQR. Commissioner Friemann then stated that all of the comments received during the coordinated review period with the involved agencies have been considered. Any anticipated impacts concerning this project, which are minimal at best, are set forth in the Full Environmental Assessment Form (EAF) which was prepared by Mr. Sendlewski in coordination with the Fire District and its Building and Liaison Committee. Any impacts are strictly of local significance. Since the Cutchogue Fire District is the sponsor and principally responsible for the design, funding, construction and overseeing of the project, to keep delays at a minimum in making any changes or adjustments in response to any potential impacts they might occur during the construction phase, the Fire District with its Construction Manager, Architect, engineers and other experts is in the best position to handle any problems that arise on an efficient basis. In reviewing the Full Environmental Assessment Form (EAF) Part 1 dated October 8, 2007, along with the site plan, floor plan and mechanicals, layout and building plans, the Cutchogue Fire District and its Board of Fire Commissioners are the most knowledgeable to determine what is necessary for the residents of the Fire Districts and what impacts this new firehouse will have on the community. -2- A detailed discussion was held among the Fire Commissioners, and upon motion of Chairman Friemann, seconded by Commissioner Brewer, it was RESOLVED, that the Cutchogue Fire District declare itself lead agency pursuant to New York State Environmental Quality Review Act (SEQRA) concerning the New Firehouse Facility to be located at 5455 Cox Lane, Cutchogue, New York. The question of the adoption of the foregoing resolution was put to a vote on roll call, which resulted as follows: Sanford H. Friemann voting AYE Arthur H. Brewer votinq AYE Robert J. The Chairman then polled the Board and it was agreed that Mr. Sendlewski review in detail the 20 questions in Part 2 of the EAF. Mr. Sendlewski then reviewed Part 2 in detail and answered any questions the Board members had in reviewing Part 2. With the exception of question #5, it was agreed by the Board that there would be no environmental impacts. As to question #5, although it was answered ~yes" that the proposed action would affect the surface water or groundwater quality, the Suffolk County Water Authority has tentatively given its approval to supply water to the property. The proposed New Firehouse Facility will require a discharge permit from the Suffolk County Department of Health Services for the cesspools on the property and will require a permit and approval to store the petroleum and chemical products on the premises. The Chairman then reviewed Part 2 with the Board and it was agreed, following the guidelines of the Suffolk County Department of Health Services concerning these items, there will be no impact and this was noted in response to question #5 on EAF, Part 2. On motion by Chairman Friemann, seconded by Commissioner Brewer, it was -3- RESOLVED, to adopt Part 2 Project Impacts and Their Magnitude of the Full Environmental Assessment Form (EAF), as proposed, and explained by Mr. Sendlewski, and further discussed by the Board of Fire Commissioners, and that the Secretary of the Cutchogue Fire District is directed to file same with the District's records. Chairman Friemann then commented that since Part 2 of the EAF indicated there was no significant impact, the completion of Part 3 was not necessary. Mr. Sendlewski then stated that since all Board members were present, as well as the Fire Chief and some of the members of the Liaison Committee who were all very instrumental in developing the plans for the New Firehouse Facility at 5455 Cox Lane, Cutchogue, New York, that the Board should review the criteria as set forth in Section 617.7(c) of the State Environmental Quality Review Act (SEQR) to determine the significance, if any that the New Firehouse Facility would have on the environment. Chairman Friemann agreed and the Board reviewed the criteria as set forth in Section 617.7(c) with Mr. Sendlewski, the Fire Chief and members of the Liaison Committee, and after thorough review and a question and answer period, upon motion made by Chairman Friemann, and seconded by Commissioner Brewer, it was RESOLVED, as follows: 1. The proposed New Firehouse Facility to be located at 5455 Cox Lane, Cutchogue, New York, has been evaluated in accordance with the Criteria for Determining Significance as contained in SEQR 6NYCRR Section 617.7(c). The proposed action has been evaluated through review of the following materials: (a) The proposed site and floor plans. (b) Independent site inspection. -4- (c) Board of Fire Commissioners' deliberation includ- ing Department Project Liaison Committee Members related to proposed project program and design and input from a professional consultant to the Board. (d) Part 1 and Part 2'of the Environmental Assessment Form (EAF). (e) Analysis of site resource maps and available environmental data information. Based upon this thorough review, the Board of Fire Commissioners did not identify any sensitive or unique environmental impacts in connection with the proposed project. The criteria for Determining Significance are specifically evaluated as follows with respect to this action of the proposed construction of a New Firehouse Facility at 5455 Cox Lane, Cutchogue, New York. The criteria are first stated followed by an evaluation of the significance with respect to the project. (a) Criteria: Substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels; increase in solid waste production; a substantial increase in erosion, flooding, leaching or drainage problems. Evaluation: The overall project area is 6.3 acres in size, is in a rural area and was previously used for many years for agricultural farming purposes, but has been long abandoned. Although the proposed action will change the existing use and operations conducted at the site, no adverse impacts to air quality, groundwater, or surface water quality, traffic, noise levels, solid waste production, flooding, erosion, leaching or drainage problems are expected. The proposed use has been designed with on site drainage containment for the proposed impervious areas. The Part 1 EAF contains information outlining characteristics of the proposed project and provides information to assess the potential impact that the project may have on the environment and surrounding community. Review of this information indicates that the proposed project will not cause a significant change or adverse impact with respect to environmental and community resources and will be in compliance with the long-range planning for increases in population and decreases in emergency response time of the Cutchogue Fire District. -5- (b) (c) (d) Criteria: The removal or destruction of large quantities of vegetation or fauna; substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species; or other significant adverse impact to natural resources. Evaluation: The site at 5455 Cox Lane, Cutchogue, New York is presently fully cleared land which was previously used for farming. There are no areas of natural vegetation, except weeds and insignificant grass areas. The soil is classified as HaA and HaB Haven Loam with 0% to 6% slopes in the Suffolk County Soil Survey. Construction of the proposed project will maintain 4.10 acres of lawn areas and landscaping on the property. There will not be any significant adverse impacts to wildlife and vegetation. Criteria: The impairment of the environmental characteristics of a Critical Environmental Area as designated pursuant to subdivision 617.14(g) of SEQR. Evaluation: The subject site is not within a Critical Environmental Area (CEA) and therefore will not impact resources associated with a specific CEA. Criteria: The creation of a material conflict with a community's current plans or goals as official approved or adopted. Evaluation: The Board of Fire Commissioners has thoroughly evaluated the proposed New Firehouse Facility at this location and has evaluated it in terms of land use, zoning, population density and emergency response time. The site plan of the proposed New Firehouse Facility indicates it will be located within the central portion of the site and will sit approximately 150 feet from the C.R. 48 and 160 feet from Cox Lane. A supplemental landscape buffer will be installed along the property lines which abut the two adjacent residential properties to buffer and provide a vegetated transition from adjacent residential uses and the proposed facility. The proposed new building will conform to all applicable provisions -6- (e) (f) (g) of the Building Code of the State of New York for a firehouse facility. After a thorough review, the project conforms with the Cutchogue Fire District's immediate and long-term goals considering the potential growth of the population and demands for decreasing response times, and this New Firehouse Facility will serve the Fire District for many years into the future. The Board of Fire Commissioners has previously determined that a new facility is a high priority in the Fire District's plan to provide updated and adequate facilities to ensure proper fire protection and emergency rescue services for the residents of the Cutchogue Fire District. It has been determined that the proposed New Firehouse Facility will be an important community asset which will meet the needs of its residents, both presently and in the long term future. Criteria: The impairment of the character or quality of important historical, archeological, architectural or aesthetic resources or of existing community or neighborhood character. ~valuation: The subject site does not contain any historic or archeological resources. There are no historical, archeological, architectural or aesthetic resources which would be impaired or impacted by the proposed project. The building is designed to have a scale and use of materials that are consistent with the character of the surrounding area. Criteria: A major change in the use of either the quantity or type of energy. Evaluation: The proposed project involves use of energy for facility operations. The project will not result in a major change in the use of either the quantity or type of energy and adequate energy resources are available from LIPA and other necessary service and communication providers. Criteria: The creation of a hazard to human health. Evaluation: The proposed project will not result in the generation of any hazards to human health and will in fact benefit the safety within the community through improved fire and EMS response. -7- (h) (i) (j) Criteria: A substantial change in the use, or intensity of use, of land including agricultural, open space or recreational resources, or in its capacity to support existing uses. Evaluation: The action will not result in a change in the use of lands for agricultural, open space or recreational purposes. The property is no longer utilized for farming purposes and commercial development has proceeded on the northerly side of C.R. 48 in this area. In terms of land use, the development of the project will provide a beneficial amenity which will enhance the fire protection and emergency services provided by the Fire District. The project will maintain an ingress only from C.R. 48 and shall have ingress and egress on Cox Lane. A pre- submission review has been conducted with Suffolk County Department of Public Works, Suffolk County Department of Health Services and Suffolk County Water Authority, and the proposed New Firehouse Facility and its plans appear to be in compliance with all of their applicable rules and regulations. Parking facilities will be adequate to meet the Fire District's needs and appropriate traffic control measures will be utilized to maintain safe traffic access within the vicinity of the site. Criteria: The encouraging or attracting of a large number of people to a place for more than a few days compared to the number of people who would come to such place absent the action. Evaluation: There is no action proposed in connection with this project or project site that would attract a large number of people for more than a few days with the exception of staging purposes for emergency response during a natural or man-made disaster or terrorist attack for the benefit of the protection of the community. Criteria: The creation of a material demand for other actions that would result in one of the above consequences. Evaluation: This project will not create a material demand for other actions that would exacerbate or create other impacts. (k) (1) Criteria: Changes in two or more elements of the environment, no one of which has a significant impact on the environment, but when considered together result in a substantial adverse impact on the environment. Evaluation: There will be no significant alteration of multiple elements of the site nor is this project associated with another project such that would cause cumulative effects. Therefore, the proposed project will not result in combined environmental impacts with any other action. Criteria: Two or more related actions undertaken, funded or approved by an agency, none of which has or would have a significant impact on the environment, but when considered cumulatively, would meet one or more of the criteria. In the first instance, issues regarding the financing/bonding of the project, the need for the project, and like concerns, are not within the Planning Board's purview. While it is ~ikely that the Board may receive some comments or inquiry regarding these issues, it is the District's duty to satisfy the public with respect to them, and the Board should defer to that public process. The New York Court of Appeals (in the Monroe/City of Rochester case) has set forth a "balancing test" to determine whether other municipal entities, such as fire districts, need to obey and seek approvals under Town zoning ordinances (e.g., site plan). Court decisions following the Monroe case have upheld various Town's requirements that fire districts may be subject to some level of site plan review. However, those cases have also stated that the fire districts enjoy a "limited, rather than absolute, immunity" from local zoning and site plan rules. In saying so, the courts have also implored the Towns to act quickly and expeditiously in the review, as it is the taxpayers who ultimately pay for any delays. In view of this precedent, it is my advice that the Planning Board should exercise a limited site plan review of the proposed project, on as fast track of a schedule as is practicable. I have spoken with Dick Lark, counsel for the District, who committed to me today that the District would submit the application materials and plans right away. Based on that commitment, if the Planning Board is able to put this matter on its January 14, 2008 hearing schedule, it may be possible to have such an expedited review of the site elements that are found to be important and necessary. I am available to discuss these matters with anyone who needs further clarification, and will also update the Town Board on this proposed approach tomorrow, for its input. In our review of Part 1 of the Environmental Assessment Form (EAF) you submitted, we noted several items to be addressed on the form itself. On page 3 of 21, the acreage amount of coverage for "roads, buildings, and other paved surfaces" should reflect an accurate amount as shown on the site plans. On page 5 of 21, number four (4) was left blank and should be filled out. On page 6 of 21, number eleven (11) should be reconsidered and possibly answered yes with further explanation. The last item of note, on page 8 of 2 l, the check-box for Planning Board approval of a site plan was marked "No." It is possible that Town approvals such as a site plan approval by the Planning Board may be required. We recommend the district check with the Town's Zoning Administrator in the Building Department for clarification on this issue. If site plan approval is required, the Planning Board typically assumes lead agency in the SEQR review of the site plan approval process. Allowing the Planning Board to establish itself as lead agency for the SEQR review of the site plan would help us avoid possible segmentation of the SEQR process if the Planning Board is not able to able to adopt the Fire District's SEQR determination. Finally, after an intensive search, a 6.3 acre parcel was located at 5455 Cox Lane, Cutchogue, New York, and as a result of extensive negotiations the Fire District purchased same on October 13, 2006. The Chairman then reported that subsequently, Martin F. Sendlewski, AIA, a specialist in Fire District Planning and Design, was retained by the Board of Fire Commissioners to design a site plan and firehouse facility at this location to fulfill the needs of the Fire District. As a result, during the past year the Fire Chiefs and Board of Fire Commissioners have met numerous times with Martin F. Sendlewski and his staff to develop a cohesive plan for a new firehouse facility at this location to serve the public and, in particular, the residents of the Cutchogue Fire District. As a result of all of these efforts Martin F. Sendlewski has presented to the Board of Fire Commissioners a site plan and floor plans dated October 8, 2007, along with a Full Environmental Assessment Form dated October 8, 2007, for the consideration and approval of the Board of Fire Commissioners. The Fire Commissioners, along with the Fire Chiefs, have thoroughly reviewed these materials.
