Mr. Orlowski: Good evening1 I'd like to call this meeting to order. The first
order of business, Board to set Monday, February 23, 1998 at 7:30 p.m. at
Southold Town Hall, Main Rd., Southold, as the time and place for the next
regular Planning Board meeting.
Mr. Ward: Second.

PUBLIC HEARINGS
Mr. Orlowski: 7:30 p.m - Fishers Island Development Corp, - These lot line
changes are to change the layout of 10 existing lots which are shown on the
Fishers Island Development Corp. subdivision which was approved by the
Planning Board on September 9, 1991. The result of the lot line changes will
be a reduction in the number of lots from 10 lots to 8 buildable lots and I

non-buildable wetland lot, which will be retained by F.I.D.C.O. The parcels
are located on the northeast corner of Peninsula Road and East End Road on
Fishers Island. SCTM# 10-5-12.7 [ F.I.D.C.O. lots #44-(17-25) and #44-49]
Mr. Edwards: Mr. Chairman, I'd like to entertain a motion to adopt the
January 7, 1998 Suffolk County Planning Commission's report with the
following amendments (numbers correspond to the numbers in the report):
I. The Planning Board will require, as a condition of final approval, that
deeds be recorded in the County Clerk's office for each revisec~ parcel.
2&3 As written.
4. The Planning Board is requiring that the road shown as "Road
(Unimproved)," which is perpendicular to East End Road, must be
improved to the Town's 16' wide road specifications, as shown in
Drawing No. 15-4 of the Highway Specifications.
5-10. As written.
Numbers 6, 7, 8, 9 and 10 must be presented in a Declaration of Covenants
and Restrictions in proper legal form.
Numbers 2, 3, 5, and 6 (the 100' wetland buffer) must be shown on the final
map

Mr. Edwards: Mr. Chairman, I'd like to offer the following resolution.
WHEREAS, Fishers Island Development Corporation (FIDCO) is the owner of
the property known and designated as SCTM# 1000-10-5-12.7, located on
the northeast corner of Peninsula Road and East End Road on Fishers Island;
and
WHEREAS, SCTM# 1000-10-5-12.7 is shown as 10 building lots (FIDCO Lots
#44- (17-25) and Lot #44-29), on a subdivision map which was endorsed by
the Planning Board in 1991; and
WHEREAS, this proposal, which is being treated by the Planning Board as 7
Lot Line Changes, is to change the layout of the 10 existing lots which will
result in a reduction in the number of lots to 8 buildable lots and I non-
buildable wetland area: and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmenta Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on January 5, 1998; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58,

Notice of Public Hearing, has received affidavits that the applicant has
complied with the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on January 26, 1998; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Sduthold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated November 19, 1997 All conditions must be
met within six (6) months of the date of this resolution:
A Declaration of Covenants and Restrictions must be submitted
containing all of the information noted above ~n regard to the Suffolk
County Planning Commission report. A copy of the draft Declaration
must be submitted for review by the Planning Board Once approved,
the document must be filed in the County Clerlds Office and a copy of
the recorded document must be submitted to the Planning Board.
The fina maps must [ae amended as noted above n regard to the
Suffolk County Planning Commission report.
Revised deeds for each lot must ~)e recorded in the County CleriCs
office. A copy of each recorded deed must be submitted.

Hearings Held Over From Previous Meetings:
Mr. Orlowski: Parker, Betse¥ and Chester Dickerson - This proposal is to set
off a 1.8454 acre parcel from an existing 24.4211 acre parcel The Town has
purchased the development rights on the proposed 22.5757 acre parcel,

The proposal is located on the south side of Old North Rd. and the west side
of Young's Ave. in Southold. SCTM# 1000-55-1-8.1 & 8.3.

resolved to hold the hearing open until final maps with Health Department

Mr. Orlowski: Broadwaters Cove- This site plan is for the expansion of a
concrete block toot shed at an existing marina located on Skunk Lane (Bay
Ave.) in Cutchogue. SCTM# 1000-104-8-2.5
Mr. Ward: Mr. Chairman, t'd like to offer the following resolution.
WHEREAS, the Planning Board had set the final public nearing for the above
project on June 9, 1997; and
WHEREAS, the Board has held the meeting open seven times because it had
not received a decision on the number of uses at the site from the Board of
Appeals and had not received a requested revised site plan from the
applicant; and
WHEREAS, the Planning Board has resolved the number of uses at the site
but has not received the requested revised site plan from the applicant; be it
therefore
RESOLVED. that the Southold Town Planning Board withdraw the resolution
of June 9, 1997, to set the final public hearing, and has determined that a
new public hearing will De scheduled when it receives the requested revised
site plan.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF
APPLICATIONS
Final Determinations
Mr. Orlowski: Stanley & Matra Wiepsynski and Herodotus Damianos - This
lot ine change is to subtract 332 square feet from a 151,480 square foot
parcel and to add it to a 54.4 acre parcel. The parcels are located off
Jennings Road in Southold, SCTM# 1000-54-6-I and 59-3-28.3.
Mr. Latham: Mr. Chairman, I'll offer this resolution. Be it resolved, that the
Southolc~ Town Planning Board authorize the Chairman to endorse the final
surveys dated November 9, 1996 Conditiona final approval was granted on
December 23, 1996.
As per the January 16, 1998 memorandum from Scott Russell, Chairman of
the Board of Assessors, the property conveyed from Wiepzynski to Damianos
has been merged with the property owned by Damianos. This has fulfilled
the Planning Board's condition of approval

APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT

Determinations:
Mr. Orlowski: Peconic Land Trust, Inc. - This minor subdivision is for 4 lots
on 49.5494 acres; Lot number 4 contains 37.63 acres of land on which the
Town has purchased the development rights. The property is located on the
south side of Main Rd. and the north side of Wells Rd. in Peconic. SCTM#
I000-86-I-9.
Mr. Edwards: Mr. Chairman, I'd like to offer the following resolution. Be it
resolved that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, assumes lead agency, and as lead agency
makes a determination of non-significance, and grants a Negative
Declaration.

SITE PLANS
Waivers:
Mr. Orlowski: North Fork Country Club - This site plan waiver is for a 1,380
squaFe foot addition to an existing storage building. SCTM# I000-109-4-8.3.
Mr. Ward: Mr. Chairman, I'd like to offer the following resolution.
WHEREAS, North Fork Country Club is the owner of the property known and
designated as SCTM# 1000-I09-4-8.3 located at Main Road, Cutchogue; and
WHEREAS, a not for profit country club is a permitted use, by special
exception, in this Agricultural-Conservation (AC) zone; and
WHEREAS, an examination has been made of all uses and the existing parking
was determined to be adequate for all uses~ and

WHEREAS, the proposed 1,380 square foot addition to an existing storage
building will not be a more intensive use of this property; and
WHEREAS, the Architectural Review Committee has approved the elevation
drawings on January 22, 1998; and
WHEREAS, any violation of the conditions of this resolution may be grounds
for rescinding this waiver; be it therefore
RESOLVED, that the Southold Town Planning Board grant a waiver of site plan
requirements.
