as to a 35% interest and STACY ANN SHEPPARD, residing at Airw~y Drive, Mattituck,
New York 11952, as to 35% interest, as tenants in common,
party of the first part, and

interest and STACY ANN SHEPPARD, residing at Airway Drive, Mattituck, New York 11952,
as to a 50% interest, as tenants in common,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying
and being iHotlle at Mattituck, in the Town of Southold, County of Suffolk, and State
of New York, being more particularly bounded and described on Schedule "A" annexed
hereto and made a part hereof.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party ofthe first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above

SCHEDULE A
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk, and
State of New York, bounded and described as follows:
BEGINNING at a point which marks the southwest corner of the premises about to be
described, which point is located at the seaward edge of vegetation marked December,
1999, on a survey of property made by John C. Ehlers Land Surveyor, on December 27,
1999, which point lies at the boundary line of the subject premises to the north and land
now or formerly of Henry Dmm and Mary S. Dmm to the south;
FROM SAID POINT OF BEGINNING THENCE the following two courses and distances
along Deep Hole Creek:
(I) North 44038'52" East 60.87 feet to a point and;
(2) North 65002'35" East 39.72 feet to a point;
THENCE, South 62023'30" East 238.06 feet, along land now or formerly of Deborah C.
Celic, to a point which is the line of apparent high water marked on said survey of John C.
Ehlers Land Surveyor, December, 1999;
THENCE, the following two courses and distances, along said line of apparent high water
of the Peconic Bay:
(I) South 44047'49" West 87.55 feet; and
(2) South 53045 '05 " West 58.81 feet, to a point;
THENCE, the following two courses and distances, along land now or formerly of Henry
Drum and Mary S. Drum:
(I) North 34052'00" West 103.48 feet to a pipe; and
(2) North 62052'00" West 136.49 feet to a point at the seaward edge of vegetation of
Deep Hole Creek, the point or place of BEGINNING.
Property known as Suffolk County Tax Map No. 1000-123.00-08.00-028.005
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated June 8, 2001, and recorded at the Office of the Clerk of the County of
Suffolk on September 14,2001 in Liber 12141 of conveyances at Page 551.
