Mr. Orlowski: Good evening. I'd like to call this meeting to order. The first
order of business, Board to set Monday, January 26, 1998 at 7:30 p.m at
Southold Town Hall, Main Rd., Southold, as the time and place for the next
regular Planning Board meeting.
Mr. Cremers: So moved.

PUBLIC HEARINGS

2 Januaw 5,1998
Mr. Orlowski: 7:30 p.m. Conrad $. Ba,qensld - This lot line change between
Carole Kaelin and Conrad and Kathryn Bagenski is to subtract 38,788 sq. ft.
(the area of the 50' r-o-w) from Lot #1 of the approved subdivision for
Conrad and Frances Bagenski and to add it to Lot #2 of the same
subdivision. The property is located on Wagon Wheel Lane in
Cutchogue. SCTM# 1000-108-3-9.1 & 9.2. Are there any comments on this
subdivision?
Charles Cuddy: t'm Charles Cuddy on behalf of the applicants. I submit the
affidavit of posting and receipts. 1'11 be brief so as to not bore the public.. All
this is really, and I've explained once before, but it was a while ago, is to
permit the Bagenskis that own lot number 2, and they're building a house on
it this spring, who actually control the road. And his sister is Carole Kaelin
and she is simply conveying the part of the division which was the road to
Bagenski. So, what is happening is she is subtracting essentially 2 acres from
her lot and giving 2 acres to their lot. They understand that they are going
to get a deed from her and in connection with that deed they will re-deed
the property to themselves so the entire parcel merges together, so the
roadway will be on lot number 2.
Mr. Orlowski: OK. If there are no other comments, any questions from the
Board? Hearing none, I'll entertain a motion to close the hearing.

Mr. Ward: Mr. Chairman, i'd like to offer the following resolution. Whereas,
Carole F. Kaelin is the owner of the property known and designated as
SCTM# 1000-I08-3-9.~, and Conrad & Kathryn Bagenski are the owners of
the property known and designated as SCTM# 1000-I 08-3-9.2, located on
the north side of Main Rd. and Wagon Wheel Lane in Cutchogue; and
WHEREAS, this proposed lot line change, to be known as lot line change
between Carole F. Kaelin and Conrad and F, athryn Bagenski, is to subtract
38,788 sq. ft (the area of the r-o-w) from lot #I of the approved
subdivision for Conrad and Frances Bagenski; and to add it to lot #2 of the

same subdivision; and
WHEREAS, a Declaration of Covenants and Restrictions was filed in Liber
11747, page 723 for the approved subdivision for Conrad and Frances
Bagenski and the same Covenants and Restrictions remain in effect for the
proposed tot line change; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on December 15, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58,
Notice of Public Hearing, has received affidavits that the applicant has
complied with the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on January 5, 1998; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated August 11, 1997, and authorize the Chairman
to endorse the final surveys subject to fulfillment of the following condition.
This condition must be met within six (6) months of the date of this
resolution:
New deeds reflectir~g the tot line change must be filed for each parcel.
Copies of the recorded deeds must be submitted to this office.

Mr. Orlowski: 7:35 p.m. Parker, Betsey and Chester Dickerson - This
proposal is to set off a 1.8454 acre parcel from an existing 24.4211 acre

parcel. The Town has purchased the development rights on the proposed
22.5757 acre parcel. The proposal is located on the south side of Old North
Rd. and the west side of Young's Ave. in Southold. SCTM# 1000-55-1-8.1 &
8.5 Are there any comments on this set off? Hearing none, at this point I'd
like to entertain a motion to hold the hearing open until the final maps with
Health Department approval are submitted.

Hearings Held Over From Previous Meetings:
Mr. Odowski: Broadwaters Cove - This site plan is for the expansion of a
concrete block tool shed at an existing manna located on Skunk Lane (Bay
Ave.) in Cutchogue SCTM# 1000-104-8-2.5.
Mr. Cremers: Mr. Chairman, I'll offer this resolution. Be it resolved that the
Southold Town Planning Board hold the hearing open pending receipt of a
revised site plan.

MAJOR AND MINOR SUBDIVISIONS. LOT LINE CHANGES AND SET OFF
APPLICATIONS
SeLLing of Final Hearings:
Southold Town Planning Board 5 January 5, 1998
Mr. Orlowski: Fishers Island Development Corp. - These lot line changes are
to change the layout of I 0 existing lots which are shown on the Fishers
Island Development Corp. subdivision which was approved by the
Planning Board on September 9, 1991. The result of the lot line
changes will be a reduction in the number of lots.from 10 lots to 8
buildable lots and I non-buildable wetland lot, which will be retained by
F.I.D,C.O. The parcels are located on the northeast corner of Peninsula Road
and East End Road on Fishers Island. SCTM# 10-5- 12.7 [ F.I.D.C.O. lots #44-
(17-25) and #44-49].
Mr. Cremers: Mr. Chairman, I'll offer the following resolution. Be it resolved
that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, do an uncoordinated review of this
unlisted action. The Planning Board establishes itself as Lead Agency, and as
Lead Agency makes a determination of non-significance, and grants a
Negative Declaration.

Sketch Determinations:

Mr. Orlowski: Peconic Land Trust, Inc. - This minor subdivision is for 4 lots
on 49.5494 acres. Lot number 4 contains 37.63 acres of land on which
the Town has purchased the development rights. The property is located on
the south side of Main Rd. and the north side of Wells Rd. in Peconic.
SCTM# 1000-86-1-9.
Mr. Cremers: Mr. Chairman, I'll offer the following resolution. Whereas, the
proposed minor subdivision Pefore the Planning Board is to divide the
49.5494 acre parcel into four (4) lots; and
WHEREAS, Lots I, 2 and 3 are 2+ acres ~n area as shown on the proposed
subdivision plan, and Lot 4 is 41.2849 acres n area, on which the Town of
Southold has purchasec~ the development rights on 3'7.2849 acres; be it
therefore,
RESOLVED that the Southold Town Planning Board start the lead agency
coordination process on this unlisted action.

Mr. Cremers: Be it further resolved that the Southold Town Planning Board
grant sketch approval on the map dated December 15, 1997, with the
following conditions:
Covenants and Restrictions shall be placed on proposed Lots fl, 2 and
3, stating that there is to loc a seventy-five (75) foot wide wetland
buffer area adjacent to the wetland area. Grading within: this area shall
be prohibited and clearing and cutting shall be limited to that
necessary for proper maintenance and removal of diseased, decayed
or dead material and obnoxious plant species. Additional covenants
and restrictions regarding the 75 foot buffer may be required upon
receipt of [ne review from the Board of Trustees
Lots 2 and 3 shall be accessed by a common driveway, as indicated on
the proposed subdivision ;}lan. The Declaration of Covenants and
Restrictions shall provide for an access agreement and maintenance

auto repair shop on County Road 48 in Cutchogue. SCTM# 1000-96-1-19.
Mr. Ward: Mr. Chairman, I'd like to offer the following resolution.
WHEREAS, Arl;hur V. Junge is the owner of the properl;y known and
designated as SCTM# I000-g6-1-I g, located on County Road 48 in
Cutchogue; and
WHEREAS, an au'co repair shop is a permitted use n 'chis Light Indus'crial (LI)
zone; and
WHEREAS, an examination has been made of all uses and the existing parking
was determined to be adequate for all uses; and
WHEREAS, the proposed change from a former use as an'auto repair shop to
the same use wi not be 8 more intensive use of this property; and
WHEREAS, any violation of the conditions of 'chis resolution may be grounds
for rescinding this waiver; be Jt therefore

in Cutchogue. SCTM# 1000-84-1-26.2.

WHEREAS, the parcels known as SCTM# 1000-106-1-41 and 48 are shown as,
Lot #10 on the Map of Captain Kidd Estates which was filed in the Suffolk
County Clerk's office on January 19, 1949, and
WHEREAS, on September I, 1970, the Planning Board approved a subdivision
of Lot #I0 into two lots which are shown on the Suffolk County Tax Map as
lots 106-I-41 and 106-I-48; and
WHEREAS, on August 20, 1980, the Planning Board aoproved a change of
right-of-way as shown on the map dated January 21, 1980; and
WHEREAS, Efthalia Katos is the owner of both lot number I06-I-41 and lot
number 106-1-48; and
WHEREAS, Efthalia Katos has merged lots I06-I-41 and '06-I-48 into one
parcel as described in the deed dated December 12, 1997, which has been
sent to the Suffolk County Clerk's office for recording; and
WHEREAS, Efthalia Katos has asked the Planning Board to remove the part of
the right-of-way which is located on part of lot 106-I-41 and part of lot
number 106-I-48 since the lots #41 and 48 have been merged and the
merged parcel has access from Summit Drive; and
WHEREAS, a Certificate of Correction has been submitted to eliminate the
right-of-way as shown on the survey dated November I0, 1997 from AES
Corp.;be it therefore
RESOLVED, that the Southold Town Planning Board authorize the Chairman to
endorse the Certificate of Correction To eliminate the right-of-way located
on part of lot number 106-1-41 and part of lot 106-I-48.
