'd like to call this meeting to order. The first order of business, Board to set Monday, June 14, 1999 at 7:30 p.m. at Southold Town Hall, Main Rd., Southold, as the time and place for the next regular Planning Board meeting. Motion carried. PUBLIC HEARINGS Mr. Orlowski: 7:30 p.m - The Old Barge Restaurant - This proposed site plan is for a 1,308 square foot expansion of an existing restaurant. SCTM# I000- 56-6-8.5. Is there anyone here that has any comments on this? Southold Town Planning Board 2 May 24, 1999 Carol Densen: I'm Carol Densen and have the plan in before the Planning Board. And just a little bit of history I would like to share with you how we've gotten to submit the plans to you tonight. Back in 1938 my parents bought the property that the Barge is located on today. And they brought the Barge in, in about 1946 and many of you I'm sure are aware that it was a U.S. ammunition barge from World War II, that over the years it changed from a fish market into a restaurant, and has been run by my parents for a number of years and then has been leased out to a variety of tenants since about 1961. My mother had been running the business end of it until 1994 when I assumed responsibility. She was 81 at that time and we kind of thought maybe she could take a little relief from the business operation. And at that point I had a couple of goals established. The main mission was to really keep the property in the family as much as we could and in doing that there were three main goals that we look to establish - and this is with my siblings and my mother who is still living. One was to preserve the land, and we've been able to do that. We've bulkheaded that property, had permits for a number of years, but we did complete that last year. The second one is to preserve the building. And that's the stage we're at at this point. The roof needs to be repaired, has been patched since 1946 and has never been replaced. And at this point it needs to be replaced. The third goal is to preserve the business. The business and the building are intertwined of course. In terms of looking at what our options are in terms of the roof, I consulted with Mr. Jim Nelson who is with me tonight, he is an architect who was trained at Cornell University and is licensed in New York State, to help me look at what are our options to keep this as a viable family business. And in doing that, looking at the New York State building code we realized that we could raise the roof and put a small mezzanine on the building. And that's basically the plan that we're bringing forward to you at this point. We have gone through the set of approvals required by the Planning Board. The Health Department has approved the plan, the Trustees, the Army Corp of Engineers is not interested in what we're doing. I'm trying to remember who else was on that list. The Architectural Review Committee has reviewed the plans and we're at the point of submitting it for your approval to hopefully go ahead to the next step. And Mr. Nelson is here to answer any questions that you might have about the specifics of the design. Thank you. Southold Town Planning Board May 24, 1999 Jim Nelson: Good evening ladies and gentlemen. I'm Jim Nelson. I'm an architect and friend of Dr. Densen and her husband Dr. Densen and have had the wonderful pleasure of working with them previously. One of the things that we would like to do in replacing the roof is to make it a more attractive structure. I'm sure all of you know of the Old Barge. I have photographs of it here tonight if you would like to see them again to refresh your memory. It's a very iow slope roof structure. Most of the mechanical equipment and ductwork is exposed on the roof. Over the years the original roof has leaked and it's no wonder with all the ductwork and penetrations. In trying to make it a more attractive structure for Southold, we would like to put a much more steeply pitched roof on the structure as the drawings have indicated to you, and then add dormers coming out of the roof structure. That way we will gain one third of the face base which is allowed by the New York State code and your code in Southold for a mezzanine. In doing that, we will have a stair and a ramp so that we will have egress that will meet fire safety standards and comply with those particular code issues. One of the issues that has arisen I understand, from the Architectural Review Committee was a question about the windows that we have at either gable end of the structure. And we had divided like windows but they followed the slope of the roof because it's a very steeply pitched roof we had windows that went up that would follow the roof line with the cathedral ceiling on the interior. And we thought that would be an attractive amenity to the building, and that's the reason why we had done that. We still feel that that's a good idea. It emphasizes, we think, the qualities of the steeply pitched roof and would make it a lot more attractive structure in the long run. We intend to comply fully with the types of materials that are currently in use at the Barge. The German lap siding that's painted blue, we will follow that. The windows which are trimmed in white, we will follow that. We will utilize a heavily textured roof shingle for the shingles along the roof. And all in all we think that it will be a much better building that will help and enhance the appearance of Southold. I'll be glad to answer any questions that you may have. WHEREAS, the C.D. Reiter Partnership is the owner of the property known and designated as The Old Barge Restaurant, located at Old Main Rd. in Arshamomaque, SCTM# '1000-56-6-8.5 & 8.6; and WHEREAS, a formal application for the approval of this site plan was submitted on November 2, 'lgg8 WHEREAS, the Southold Town Planning Board, acting under the State Environmental Quality Review Act, (6NYCRR), Part 617, makes a determination that this project is a Type II action and not subject to the provisions of the State Environmental Quality Review Act, (SEQRA); and WHEREAS, the final public hearing was closed on May 24, 199g; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final Southold Town Planning Board 5 May 24, 1999 approval on the surveys dated August 6, '] 998, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following conditions. These conditions must be met within six (6) months of the date of this resolution: Certification by the Building Inspector. We received the certification from the Building Department late this afternoon. The second one was, as your architect pointed out was the windows. And I had called him and asked him to call the Architectural Review to see if we could reach some kind of agreement. I haven't had any feedback on that. Mr. Nelson: I called. I haven't gotten any feedback either. Mr. Kassner: I see. So that's a minor issue and that should be resolved shortly. Hearings Held Over From Previous Meetings: Mr. Orlowski: Eleanor Sievernich - This minor subdivision is for 2 lots on 3.7648 acres located on the east side of Cox Neck Rd. in MattituCk. SCTM# 1000-I 13-8-5. I guess litigation is still pending: What,s the pleasure of the Board on this one? Mr. Ward: Mr: Chairman, I'd like to offer the following resolution. BE IT RESOLVED to hold the hearing open due to litigation pending in the Southold Town Planning Board 6 May 24, 1999 Supreme Court. The next Planning Board meeting is scheduled for June '14, '1999 at 7:30 p.m. Mr. Latham: Second. Mr. Orlowski: Aisc, Mr. Salvatore has asked for the hearing to be held open too, so both parties have agreed. Motion made and seconded. All those in favor? Proposed lot #'1 is for ~ 6.6060 acres of which the development rights have been sold on '14 6060 acres. The proposed subdivision is located on the northeast side of Alvah's Lane, 2873 feet north of Main Rd. in Cutchogue. SCTM# '1000-'102-4-5. This hearing is held open believe everything right now is all in order to close the hearing. It's been held open since December 14, '1998. I'll entertain a motion to close the hearing, unless anybody would like to make a comment before we dose the hearing. Gall Wickham: May I make just a very brief comment? We are here with Health Department approval several months after we first told you that we anticipated it. Certainly we're glad to have it and I apologize for it taking longer than we expected. I think the C&R's we've submitted to you regarding no visual obstruction from Alvah's Lane and construction of driveway aprons. We did fax you this afternoon a letter requesting waiver of a firewell I'd like to submit the original with a correction in that the actual anticipated expenditure for that firewell would be over S'14,000, rather than the SI0,000. So, i'm awaiting your advice on that issue and the other conditions of what we hope will be the conditional final approval We're ready to submit mylars and prints for signature Thank you. Mr. Orlowski: Have you met with the fire district? Richard Reinhardt: In Highland Estates, there's only one firewell ~n that whole subdivision. So they feel that it's the responsibility of the developer to install Southold Town Planning Board 7 May 24, 1999 a firewell. I somewhat object to it because I'm not creating any roads. They already service that cul-de-sac that's up there. They say if water is going in they'd waive it, but until they find out what Suffolk County Water Authority (SCWA) is going to do, they don't want to spend taxpayer's money. After contacting SCWA, they have no intentions of going up that subdivision in the near future, so I don't understand why they have a moratorium if SCWA is not going to go up there. Plus the location of the firewell that I would put in really wouldn't be as advantageoUs as if it was further into the Highland subdivision. I'm going to be on the fringes of the subdivision. Mr. Orlowski: Have you discussed that with them? Mr. Reinhardt: I have. ' 'e Mr. Orlowski: There have been different Qmes when they v agreed to, instead of taking the total to take a share of the cost. I've seen that before. Mr. Reinhardt: Which I'm not opposed to. Mr. Orlowski: We've never overridden any of these in the past or waived the firewell since it is a safety issue. At this time we're ready to approve it subject to that as one of the conditions, but if you go back and talk to them, they have in the past...if there's so many lots up there and you only have two of them, I think that might be worth pursuing. Because they have done that. Mr. Reinhardt: I'm going to have to talk to them. Mr. Orlowski: OK. Mr. Orlowski: Motion made and seconded to close the hearing. All those in favor? Mr. Ward: Mr. Chairman, I'd like to offer the following resolution. WHEREAS, Richard Reinhardt is the owner of the property known and designated as SCTM# 1000-102-4-5, lOcated on Alvah's Lane in Cutchogue; and Southold Town Planning Board 8 May 24, 1999 WHEREAS, this minor subdivision, to be known as minor subdivision for Richard Reinhardt, is for 3 lots on 20.3995 acres; and WHEREAS, proposed lot #I is for a total of 16.6060 acres, of which the development rights have been sold to the Town on 14.6060 acres; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on November 16, 1998; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on May 24, 1999; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold will have been met upon fulfillment of the following conditions; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated April 12, 1999, and authorize the Chairman to endorse the fina surveys subjec~ to fulfillment of the following conditions. All conditions must be met within six (6) months of the date of this resolution: The Declaration of Covenants and Restrictions must be revised in accordance with condition Number 2 below, and must be recorded the Gounty Clerk's office. A copy of the recorded document just be submitted to this office. The Cutchogue Fire District, in a letter dated November 15, 1998, recommended that a fire well be installed for the subdivision. The location of the fire well must be indicated on the final subdivision map. The fire well must be installed by the developer, and conveyed to the Fire District, prior ~o the issuance of any building permits for the lots within the subdivision. The condition in regard [o the issuance of building permits must be included in the Declaration of Covenants and Restrictions. The Park and Playground fee of S6,000.00 (S2,000.00 per vacant lot) must be submitted. Southold Town Planning Board 4. 9 May 24, 1999 Final maps (five paper copies and two mylars) must be submitted. All maps must contain the liber and page number of the recorded Declaration of Covenants and Restrictions and a valid stamp of Health Department approval. Mr. Cremers: Second the motion. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS Setting of Final Hearings: Mr. Orlowski: BabalJs-Hartofilis - This lot line change is to subtract 1.18 of an acre from a 2.55 acre parcel, SCTM# 1000-21-4-14 and add it to a 0.29 acre parcel, SCTM# 1000-21-4-9; and to subtract I A7 of an acre from the same 2.35 acre parcel and add it to a 0.41 acre parcel, SCTM# I000-31-2-3. SCTM# 1000-21-4-9 & 14 and 31-2-3. I'll enteffcain a motion in regards to the SEQRA. Mr. Latham: Mr. Chairman, I'll offer this. BE IT RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, do an uncoordinated review of this unlisted action. SITE PLANS - STATE ENVIRONMENTAL QUALITY REVIEW ACT AdOpt Findings Statement: Southoid Town Planning Board 15 May 24, 1999 Mr. Orlowski: Beachcomber Motel I!- This proposed site plan is for the construction of 42 additional units on a 48.2 acre parcel which contains an existing motel with 36 units, 3 apartments and a restaurant. SCTM# 1000-83-2-1, 2 & 17. Mr. Edwards: Mr. Chairman, I'd like to offer the following resolution: WHEREAS, the Planning Board conducted an environmental review of the aforesaid described site as a contiguous entity; and WHEREAS, the Statement of Findings pertains to a 42 unit expansion (representing a reduction of 4 motel units from the original application) on three subject parcels, which total 48.2 acres; be it therefore RESOLVED that the Southold Town Planning Board hereby adopts the Statement of Findings dated 24 May, 1999.
