A regular meeting of~the ~Board of Town TrUstees wa's held at
7:30 p.m., Wednesday, january 2., 1980, at the Town Hall, Main Road,

Trustee Kujawski made a motion, seconded by Trustee~

Trustee Kujawski made a motion that the nominationsbe closed.
Trustee Smith seconded the motion and it was carried.
Trustee Staples called for the vote~ Trustees Smith, Staples,
and Hataier cast their votes for Trustee Hataier. Trustees
Kujawski and Stoutenburgh abstained. Trustee Staples declared
Trustee Hataier chairman.

President Hataier made a motion designating Muriel Tolman as, '-
clerk of ~he Board'.of Southold'Town Trustees. Trustee Staples ~
seconded the motion and it was carried. ~ .... ~ '
President Hataier made a motions-designating the Chemical Bank
of SOuthold as depository for the Board of Southold Town Trustees.
Trustee Smith .seconded the motion and it was carried.~ ~

Margaret Braatz - ,referral from the Southold T0~ Board for .report~
on Wetland Application #43 to erect bulkhead and dredge at W~mUeweta
Pond. Present were Abigail Wickham, attorney for Mrs. Braatz~ David
Cohn, representin~Dr. John Hansen who is an~ adjoining owner; Mr.
Gardner, property owner of adjacent~property. Ms. Wickdaam stated
that this would join an existing bulkhead and one to be erected by
M~. Gardner. Mr. Gardner has all necessary permits and intends to
erect the bulkhead before the permit expires or to seek an extension
if the time if he is unable to do 'it before expiration. David Cohn
appeared on behalf of Dr. Hansen and'~stated Dr. Hansen is in opposition
to the project. He also stated that Mrs. Braatz had written to the
association for support and Ms. Wickd~am said the reply was favorable
conditional on Mrs. Braatz doing a considerable amouut of dredging.
Trustee Stoutenburgh voiced his objection because Of salt water
intrusion which according to a study he has shows this area to be
critical one.
~On motion ~made by Trustee Kujawski, seconded by Trustee Staples,
RESOLVED to recommend to the Southold Town Board disapproval of
Wetland ~pplication #43 of Margaret Braatz to construct a 78 foot
timber bulkhead and dredge-approximately 150 cubic yards of sand to
be placed behind bulkhead at pri~ate property of the applicant at
Wuune~eta Pond, Nassau Point, CutchOgue, for the following reasons:
1. This is an unspoiled piece of wett~ands.
2. This is a critical area inregard to saltwater intrusion.
-3. ~Oncemarsh grass and Peat bog and root system is removed,
the~fragite interface moves inland.
4. This will start a precedent in the area for bulkheading.
Vote of the Board: AyeS:Hataier, KU~awski, Smith, Staples
Abstain: Stoutenburgh
Mr. Stoutenburgh stated that he abstained ~ecause Mrs. Braatz is a
personal friend and he is involved with her through Nature Conservancy
and he does not'want .to prejudice his good standing with her.
Trustee Staples made a motion, seconded by Trustee KuOawski
and carried to table action on the application of Thomas S. Blankle_~
to maintenance dredge off .private property of theapplios/at at
Jockey Creek because all of-the trustees have not had an opportunity
to make an inspection. ~-~
On motion made by Trustee Stoutenburgh, seconded by"Trustee
Staples~ it was
RESOLVED to recommend to the Southold Town Board approval of
tha Wetland Application #44'of David S. Strong for~maintenance
dredging Of private marina.

The applications of Margaret Braatz to place bulkhead and
dredge at Wu-rmeweta pond ~ere tabled. .
On motion made by Trustee Staples, seconded by Trustee Smith,
it was~
RESOLVED to approve the application of Arthur David to place
dock'-off private property at'East Creek with the condition that it
be built so that it is from twelve to .eighteen inches above the
existing grass.

On motion made by TrUstee~ Stoutenburgh, seconded by Trustee
Smith, it was
RESOLVED to approve the issuance by the Board of SoUthold To~a
Trusveesof a quitclaim deed to Ra!oh and Anna Laviniafor ~hatever
proper~y the towntrustees may have claim to between Richmond Creek
~nd land of the Lavinias.

The matter. of the application of Jeanne Galligan for a. quitc!aim
deed to filled in property at Mattituck Creek was discussed. It
was the consensus of the Board that it wouldbe in agreement with
this if there were a covenant that the property will not be
subdivided. President Hataier will con~act the attorney for Ms.
Galligan to see if this is agreeable.

Trustee Staples made a motion, seconded by Trustee Xujawski
and carried to approve the minutes of the regular'meeting of' December
4, 1979 with thef~llowing amendments:
Page 378 - in the matter of Lavinia., the location of the property
if Richmond Creek rather than Mattituck Creek
Page 378 - in the matter of Zeidler~ the following is to,be
added in the condition oft approval. "Any excess ·
spoil above that being placed behind the bulkhead
will ~be placed on the beach on the east side of the
mouth." ~ ·
A letter~ was received from the owner of Matt-a~Ma~regarding
the area in front of the retaining wall which runs from the ~lift pit
to Wickham Avenue. The Board does not feel that the wording is
strong enough and the contractor will be so advised. The permit
will not be issued until the letter is received with the proper

Trustee Stoutenburgh made a motion that the following moorings
be renewed for the month of January pending the $5 fee. Trustee

Trustee Stoutenburgh made a motion that the following moorings
be renewed for the month of February pending the $5 fee. Trustee

On motion made by Trustee Stoutenburgh, seconded by Trustee
Kujawski, it was
-RESOLVED that the Board-of Southold Town Trustees set $2.00
per cubic yard as thevalue of the creek bottom if it ,is:-~aken
out and used for private use. If the fill is placed on public
property,with the approval of the Board of Town Trustees to enhance
the area, there would be no aharge.

A letter was read from the Fleet's Neck Property Owners Assn.
in which they request that the illegally placed fill be removed
from the end of East Road in Cutchogue. There will be an
inspection of the area by the Trustees at ,2 pYm. on Suuday, January
6, 1980. President Hataier will contact the Association.
There mas discussion regarding getting information~ to'the
residents of the Town as to what is going on and what kind of~
permits are required. Enforcement was discussed and a guideline
book for the boardwas mentioned. The Board does not"w~nt permits
issued without the requirement that after the workis done ~he
Board is noti£ied.
Trustee Stoutenburgh made a motion to write a letter to the
Town Board and ask them if the Bay Constable could be given time
off from his day to attend the one meeting a month of the Board of
Town Trustees so he and the Board can have a closer relationship
of what goes on in the town creeks. Trustee Ku~awski~seoonded the
motion and it was carried.

Trustee Kujawski made a motion that a letter be sent to the
Southold Town Board reminding them that the lease of the Narrow
River property expires in 198Z and requesting that consideration be
given to acquiring land in the Narrow River area for public access.
Trustee Staples seconded the motion and it was carried.
The Board discussed checking with the Town Attorney~ Robert
Tasker, about the possibility of maintenance bonds when large
construction work is being done in the creeks.
There being no further business to come before the Board,
Trustee Staples made a motion, seconded by Trustee Kujawski and ·
carried to adjourn the meeting. Meeting adjourned at 9:25 p.m.
