HomeMy WebLinkAboutTR-12/02/1981A regular meeting of the Board of Southold Town Trustees was held at 7:30 PM, Wednesday, December 2, 1981, at the Town Hall, Main Road, Southold, New York. Present were: .... President Anna T. Hataier Vice President Henr~ Smith ~ Trustee Halsey Staples Trustee Paul Stoutenburgh Trustee Frank Kujawski Trustee-elect John Bednoski ~ Trustee-elect John DiVetlo Ruth Oliva, North Fork Environmental Council Marian Goubeaud, Clerk WORK SESSION: Discussion was held on the bulkheads of Fred Melin and Marino Faraguno. It was agreed that, due to an error on Mr. Faraguna,s permit, he be allowed to leave his bulkhead as is. As Mr..Melin's is right next to it, he, too. will be permitted to leave his. A letter from the Southold Town Baymen's Association about there being a flagrant disregard for the laws governing the installation of bulkheads, docks,' pilings, etc. and suggestions to eliminate this problem was dis- cussed. The Board requested copies of the letter be sent to the Town Board and Attorney Tasker, requesting they return written comments on it. William B. smith was present to discuss a quit .claim for Eugene Spalinger of Inlet Drive, Greenport. The Board agreed ~to meet with Mr. Smith_at the site on Thursday~ December 10, 1981, at 3:00 P. M. President Hataier called the me~ting to order at 7:40 PM. On motion of Mrs. Hataier, seconded by Mr~ S~ith and carried, the minutes of the November 4, 1981, meeting were approved. The next meeting of the Board will be January 5, 1982. On motion made by Mrs. ~ataier, seconded by Mrs. Stoutenburgh, it was RESOLVED to approve the application of Strong's Marine Center to construct 190' section of bulkhead in line with and connected to partially completed existing bulkhea~ and backfill with approximately 40~cu yd of clean sand fill to be trucked in ~rom upland source. ~his bulkhead will be in inner portion of marina. Also, to construct a total of 70' of timber bulkhead to connect to existing bulkhead on outer portion of marina to control scouring of backfill from existing bulkhead~in James Creek, Mattituck. Vote of Board: Ayes: Mrs. Hataier, Messrs. Smith, Staples~ Stoutenburgh and Ku~awski. On motion made by Mrs. Hataier, seconded by Mr. Smith, it was R~SOLVED to recommend to the Southold Town Board to approve the wetland application, ~78, of Strong's Marine Center as per above application. Vote of Board: Ayes: Mrs. Hataier, Messrs. Smith, Staples, Stoutenburgh and Kujawski. On motion made by Mrs. Hataier, seconded by Mr. Staples, it was RESOLVED to approve the application of Sal McCarthy to construct a 48' x 4'~fixed elevated (3' above grade) catwalk, 16' x ~' hinged ramp~and 6~ x 40' floating dock secured by 2 piles with the provision the dock C does not extend beyond docks of adjacent property owners, both east and west, at Mattituck Creek, Mattituck. Vote of Board: , Ayes: Mrs. Hataier, Messrs. Smith, Staples, Stoutenburgh and Kujawski. On motion made by Mr. Stoutenburgh, seconded by Mrs. Hataier, it~was RESOLVED to recommend to the Southold Town Boa,rd to approve ~the wet- land application ~7~, 'of Sal McCar.thy as per ~above application. Vote of Board: Ayes: Mrs. Hataier, Messrs.~ smith, Staples, Stoutenburgh and Kujawski. On motion made by Mr. Stoutenburgh, seconded by Mrs. Hataier, it'was RESOLVED to approve the application of Neit. Simon to construct approximately 190' of timber bulkhead generally above lin'e of MHW excep~on southerly side where it will tie into the~corner of existing bulkhead. A 10' return is proposed on northerly side. Approximately 200 cu yd of clean sand fill will' be .trucked in for backfill°in'man ~ade basin at Harbor Lights Drive, Bayview, Southold. ~Vo~ of~Board: Ayes: Mrs. Hataier,. Messrs. In the mean time, the applicant is.to investigate as to whether others have use of the right-of-way. If so, Mr. McCarvill must present a letter-of permission from them. He is also,to mark the right-of-way on his application, so the Trustees can find.it ..... Vote of Board: Ayes: Mrs. Hataier, Messrs. Smith, Staples, Kujawski and Stoutenburgh. On motion made~by-Mrs.. RESOLVED to approve the appliCation.of Charles DeSuca to-construct a- catwalk, ramp and float to moor a private boat at Richmond Creek, ~Peconic, with the provision that the catwalk over the marsh is 3' wide, dock over the water is~ 4' wide and 3' above high watero~ Vote of Board~: Ayes:-- ~rs. Vote of Board: Ayes: Mrs. Hataier, Messrs. Smith, Staples, Kujawski and Stou~enbur~h. ~ On motion made by Mrs~ Hataier,-seconded by Mr. Smith, it was RESOLVED to approve.the application of Frederick Cowan to construct an 85' open.piling dock, 16' ramp, 40' floating dock with related mooring piling and 55' x 5' catwalk at Mapes Creek off Mattituck Creek, Mattituck, with the provision the dock is 4' wide. Vote of 470' Board: Ayes: Mrs. Hataier, Messrs~ Smith, Staples, Stoutenburgh and Kujawski. ~ ~ - ~ ~ - _ On motion made by Mrs. Hataier, seconded by Mr. Staples, it was RESOLVED to recommend to the Southold .Town Board to approve the'- wetland application, ~76, of-Fred Cowan, as-per above application. Vote of Bo'ard: ~ Ayes: Mrs. I{ataier, Messrs. Smith, Staples,~ Kujawski and Stoutenburgh. On motion made by Mrs. Hataier, seconded by Mrs. Smith, it was RESOLVED Go table the application o~f The Lagoon Association until the Board has more information. It was requested the applicant be.notified to have studies done by an impartial source as the Board is concerned about the saltwater that might come from any dredging. Also, the Board asked a letter be sent to the State requesting ~ead agency on this application. .When all information comes in, the Board will set up a Work Session to discuss it. On motion made by Mrs. Hataier, seconde~ by Mr. Stoutenburgh, it was RESOLVED to recommend to the Southold Town Board to hold in-abeyance decision on the wetland application, ~72, of The Lagoon Association, as the Trustees, need mors information. ,.Vote of Board: Ayes: .Mrs. Hataier, Messrs. Smith, Staples, Stoutenburgh and Kujawski. After conferring with Attorney Tasker, ~he Board finds their hands are tied in the Case of Donald DeLalla. There isn't anything they can do about Mr. DeLal~a Charging a fee for boats moored at his dock. In the case of Matt-A-Mar Marina, they must make application for the piling they have in Mattituck Creek witho'ut a permit. Discussion was held on the hoist and piles Agnes Pagnozzi has put in Jockey Creek illegally. The Board requested a letter be sent to Mrs. Pagnozzi stating she has until May 1, 1~982, to ramove the~ but in the mean time, she is not to use the 'hoist. The Board requested the following letter be sent to Mrs. Artemas' Ward: Dear Mrs.. Ward: In regard :t0 Husing Pond, we have contacted ever~yone we could and are pursuin~ the matter. ,If required, we will a:sk the Town for a wetlands permit. The way things a~e, there is not enougk volume of-water for decent flushing action. Therefore, a Corps of Army Engineers permit is required, which the Town must apply for. We will keep in touch with you and if you'have any new ideas, we will be~ glad to consider them. Yours tr. uly, /s/ Anna T. On motion made by M_rs. Hataier, seconded by Mr. Stoutenburgh and carried, all the mooring renewal permits for the month of January were approved. On behalf of all the Board members, Mr. Stoutenburgh presented a bouquet of roses to our outgoing member and president, Anna Hataier. There being no further business to come before the Board, Mr. Kujawski made a motion, seconded by Mrs. Hataier and carried, to adjourn. The meeting closed at 9:30 PM.
