HomeMy WebLinkAboutTR-06/03/1981447 MINUTES BOARD OF SOUTHOLD TOWN TRUSTEES A regular meeting of the Board of Southold Town Trustees was held at 7:30 PM, Wednesday, June 3, 1981, at the Town Hall, Main Road, Southold, New York. Present were: Vice President Henry P. Smith Trustee Halsey Staples ~ ~ Trustee Paul Stoutenburgh . Bay Constable Thomas Czelatka _ Ruth Oliva, North Fork Environmental Council Marian Goubeaud, Secretary Absent: Trustee Kujawski On motion made by Mr. Stoutenburgh, seconded by Mr. Staples and carrie% to approve the minutes of the regular meeting of May 6, 1981, with the following exceptions: On page 443, in resolution to approve the amendment to the p~rmit of Matt-A-Mar Marina, the statement "There will'be overall chan~e in length" be amended to read "There will be no overall change in length" On page 445, the resolution recommending to the Southold Town Board T · the approval of wetland permit ~65 of Carol K. uthitl be amended by adding thereto a stipulation the catwalk be three feet (3~'). Mr. Stoutenburgh inquire~ as to whether or not a blanket permit was issued for the 1981 season to the Suffolk County Department of Public Works for all dredging projects in the Town of Southotd with the understanding that ail future projects must have a permit from the Board of Town Trustees. This .is to be looked into. On motion made by Mr. Staples, seconded by Mr. Stoutenburgh, it was RESOLVED to approve the application of Florenco A. Gomez to place floating dock off private property of the-applicant at Goose Creek. Vote of the Board: Ayes: Ayes: Mr. Smith, Mr. Staples, Mr. Stoutenburgh. On motion made by Mr. Smith, seconded by Mr. Stoutenburgh, it was RESOLVED to approve the application of Joseoh Radich to place t00 lb. mushroom anchor off public property at Goose Creek with the provision that it does not impede navigation or interfere with other boats in the area. Vote of the Board: Ayes: Mr. Smith, Mr. Staples, Mr. Stoutenburgh. On motion~made by Mr. Stoutenburgh, seconded by Mr. Smith, it was RESOLVED to approve the application of Thomas D. MacDougali to place offshore stake with pulley line to onshore stake off private property of the applicant at Arshamoma~ue Pond. Vote of the Board: Ayes: Mr. ~mith, Mr- Staples, Mr. Stoutenburgh. 448 /~ On motion made by Mr. Stoutenburgh, seconded by Mr. Staple~ it was RESOLVED to recommend to the Southold Town Board approval of the wetland application of Marino Faraguna, ~66, for a permit to con- struct an aluminum alloy bulkhead with the provision that it be three (3) feet from the .property line rather than the seven and one half(7~) feet as requested. Vote of the Board: Ayes: Mr. Smith, Mr. Staples, Mr. Stoutenburgh On motion made by Mr. Smith, seconded by Mr. Staples, it was RESOLVED to approve the application of Marino Faraguna to place aluminum alloy bulkhead at private property of-the applicant at Mud Creek with the provision his wetland application is~approved by the Southold Town Board. Vote of the Board: Ayes: Mr. Smith, Mr. Staples, Mr. S[outenburgh On motion made by Mr. Staples, seconded by Mr. Stoutenburgh, it was RESOLVED that in review of application of John Wickham for quit claim deed for certain property located at West Creek, it was proposed that a ninety-nine (99) year lease be issued with the provision the property be used for agricultural purposes only. A letter is to be sent to Mr. Wickham to this effect. Mr. Staples will confer with Attorngy Tasker as to the legality of this ~agre~ement Vote of the Board: Ayes: Mr. Smith, Mr. Staples, Mr. Stoutenburgh On motion made by Mr. Stoutenburgh, seconded by Mr. Staples, it was RESOLVED that the approval of the application of John Michael John with the provision that it be an offshore stake with putley line to bulkhead at Mattituck Park District, all subject to written permission from the Park District Commissioners to do sQ be amsnded to read: RESOLVED to approve the application of John Michael John with the provmsion that it be moored off the west end of the bulkhead, does not moor off shore, and does not interfere with other boats in the area, all subject to written permission from the Park District Commissioners to do so. Vote of the Board: Ayes: Mr. Smith, M~o Staples, Mr. Stoutenburgh. Mr. Smith introduced a letter written, to Councilman John Nickles and forwarded to.him zn regard to a complaint from Bernard R. Dempsey of Stillwater Avenue, Cutchogue, N. Y., concerning a run off pmpe that has been dumping silt and other matter into East Creek adjournzng his property. The Board requested that.'this letter be sent to Superinten- dent of Highways Raymond Dean with a covering letter asking him to look into the matter and possibly offer some help to Mr. Dempsey. Also, the Board stated in the letter to Mr. Dean that at such time as maintenance is needed at that drainage pipe, they would be more than willing to issue a permit for same. Discussion was held on the possibility of having speed limit signs posted in the Creeks. Discussion was held in regard to maintenance dredging at Mill Creek and Corey Creek. The trustees instructed that a letter be written to John R. Gutdi of the Suffolk County Department of Public Works with 449 the suggestion that the spoil be put on the west side of Corey Creek and that dredging be held off in Mill Creek until such time as the 1500 pair of nesting terns leave the area. Also in Mill Creek, to inquire if it would be possible to knock the point off the east side of the entrance, as the accumulation interferes with boats going in~o Arshamomaque Pond. Mr. Stoutenburgh requested that a copy of a letter written by him to Mr. John O'Neill, Fisherman's Beach, Nassau Point, Cutchogue, N. Y., be forwarded to John R. Guldi of the Suffolk County D~partment of Public Works. The letter was in regard to dredging of East Creek be- tween Fleets Neck in Cutchogue and Fisherman's Beach at Nassau Point, that the sand be placed along the west side of Nassau Point north of Landings Road (from the cove south), and that while dredging at the mouth of East Creek, they remove the point of land that has formed to the north of Fisherman's Beach as a result of spoil being put on it by the last dredge. A discussion was held on the final draft of the proposed Trustee Brochure. At the request of the Baymen's Association, the number of day~ the creeks are closed will be changed from thirty (30) days to twenty- five (25) days. The Suffolk County Department of Environmental Conservation states they must be closed at least twenty-one (21) days for purging after the planting of the seed clams. Mill Creek and Goose Creek are to be seeded and closed June 5, 1981, and are to be re-opened July 2, 1981. Hallock's Bay will be seeded and closed June 9, 1981, and is to be re-opened July 2, 1981. A discussion was held on the complaint of New York State Conservation Offic~ Philip Obenauer against George Sweeney to remove spoils from wetlands. Action will be taken but no decision was arrived at. Mr. Stoutenburgh suggested that when new permit forms are needed, a tear-off affidavit be applied to the bottom. This affidavit is to state that the work is done accordinq to specifications and that the mooring and/or pe~zt number is displ~ed on the mooring and/or dock so that it is visible from both the bay s~de and the road side. This portion of the permit must be returned to the Trustees Office. Also, when new application forms are needed, in addition to the present information required, the name of the Creek, the draft of the boat and the applicant's telephone number should be included. A suggestion was made that Mr. Staples check with' Town Attorney Taster in regard to Guide Lines for the Board of Trustees such as-r-u!es and regulations in book form.
