J 1.3 - (,,02/~ , FEB 2 6 2008 Petition to Southold Town Board We, the undersigned residents of South old Town call upon Southold Town Board to take action to halt development of the 139 residential dwellings proposed as Heritage at Cutchogue. The proposed density and total number of residences are out of scale with Cutchogue Hamlet and with Southold Town. Building so many houses on so little land, results in innumerable negative impacts on public health and safety, quality of life and values of other properties. On July 19, 1983 this area was rezoned to high density residential. The rezoning was not done in accordance with any sound planning initiative, rather it was tailored for the benefit of this single property. Despite the rezoning, on Jan. 7,1985 the Planning Board denied an application for site plan approval. Now, in connection with another application for a development on the same property almost a quarter of a century later the spot zoning is being treated as sacred. Under New York State Law neither sitework with bulldozers, nor subdivision and site plan approvals vest any interest in zoning, zoning can be changed at any time until actual building construction has begun. Church Lane was rezoned, This area can also be rezoned. To allow time for a possible rezoning, we ask the Town Board to immediately enact a moratorium on all major commercial and residential development projects. We need a moratorium to prevent any construction beginning before the zoning of this property, and of other nearby properties which are also facing imminen~ development, can be considered and if a rezoning is decided on it can be adopted and implemented by the Town Board.
