DECLARATION OF COVENANTS AND RESTRICTIONS THIS INDENTURE made and dated the 4th day of June, 1981 by REYNOLD F. BLUM, residing at 122 Cross Road, Oakdale, New York and WILLIAM A. LITTELL, residing at 705 Blue Ridge D. i r~ve, I I I i ! Medford, New York 11763. WHEREAS, Reynold F. Blum and William A. Littell are the owners in fee simple of a certain tract of land consisting of 4.815 acres and located atCutChogue, in the Town of Southold, County of Suffolk and State of New York, and more fully described I I I j I I I I I I I I in Schedule "A" hereto annexed; and WHEREAS, Reynold F. Blum and William A. Littell have filed with the Town of Southold a formal application for the approval of a Minor Subdivision for the subject property; and WHEREAS, the Planning Board of the Town of Southold has conditioned the approval of the filing of the said Minor Sub- It l-~ division upon the filing of the within Covenants and Restrictions and WHEREAS, Reynold F. Blum and William A. Littell are desirous of placing such Covenants and ! Restrictions upon the sub-! I I ject premises, which said Covenants and Restrictions shall be binding upon the current owners and upon all purchasers and mortgagees of the subject property as well as their heirs, exe- cutors, administrators and assigns; NOW, THEREFORE, THIS DECLARATION WITNESSETH: That the said Reynold F. Blum and William A. Littell, for the benefit of themselves, their successors and assigns, in -1- -, ~ . '.'~ -----...-- --I! . . . . consideration of the premises and for .the purpose of carrying out the intention above expressed, do hereby make known, publish, declare, covenant and agree that the said premises hereinafter described in Schedule "A" shall hereafter be subject to the following Covenants and Restrictions running with the land and 11 binding upon all purchasers and mortgagees and the holders of said premises, their heirs, executors, administrators, successors and assigns: that 1. Any further subdivision of the other property of Reynold F. Blum and William A. Littell of which this subject parcel is a part shall be treated as a Major Subdivision with the requirement of a map being filed in the Office of the Suffolk County Clerk. 2. No lot on this Minor Subdivision Map shall be 'I changed in any manner unless authorized by the Suffolk County Planning Board. 3. Approval of this Minor Subdivision is subject to the owners of the subject property meeting the requirements and standards of the Suffolk County Department of Health Services. 4. No sanitary disposal facility shall be located within one hundred feet of the drainage ditch emptying into Eugene's Creek and the edge of any tidal meadow bordering on the creek. 5. All residental structures shall be located at least one hundred feet back from the edge of the tidal meadow bordering Eugene's Creek. 6. There shall not be any discharge of stormwater runoff resulting from the development and improvement of the lots -2- ..,...",,'J.'....,. "':"'-~~'''-'--''''' 1/ . . . . directly into the drainage ditch emptying into Eugene's Creek or into any tidal wetland bordering the creek. 7. A conservation easement having a depth of fifty i feet shall be established along the tidal wetlands. 8. All of the Covenants and Restrictions as contained herein shall run with the land. 10. Each and everyone of the Covenants and Restriction; contained herein shall be considered to be an independent and separate Covenant and agreement and in the event anyone or more of said Covenants and Restrictions shall for any reason be held to be invalid or unenforceable, all remaining Covenants and Restrictions shall nevertheless remain in full force and effect.
