HomeMy WebLinkAboutTR-05/06/1981 44 ~ A regular meeting of the Board of Town Trustees was held at. 7:30 p.m., Wednesday, May 6, 1981, at the Town Hall, Main Road, Southold, New York. Present were: President Anna T. Hataier Vice-President Henry P. Smith Trustee Frank Kujawski, Jr. Trustee Halsey Staples Trustee Paul Stoutenburgh Bay Constable Thomas Czelatka Ruth Oliva, President, No~th Fork Environmental ~ouncil Mr. Gus Wade appeared before the Board regarding the island owned by Mr. Glover which he is under contract to buy. This property is located at the end of East Road in Cutchogue. He has been in contact with Sr. Building Inspector Fisher, the Department of Environmental Conservation and the Suffolk County Department of Health Services. He has specifications for five pools along with a septic system and well. If the water is brackish a reverse osmosis process can be used or a well obtained in a common area such as Cornell's property and have it piped down. Robert Villa of the Health Department has indicated that his department would go along with the DEC criteria. Mr. Wade has spoken to Town Attorney Tasker who indicated there would be no,problem with ~Ccess on the town road but there is a question about the 40' x 70' piece between the town road and the island. Mr. Wade said Mr. Fisher said he could come in by boat for access to the island but would rather see an easement. He requested from the Town Trustees an easement over the property to the island. Mr. Wade will write a letter-to the Trustees indicating same. Mr. Stoutenburgh suggested that a public hearing be held for input from the people in the area. There was no disagreement with Mr. Stoutenburgh's suggestion. '~ Jarvis Verity, President of the Southold Town Baymen's Associaticn, asked if there would be any objection by the Board if a heavy chain was used to loosen up the bottomlands at Narrow River before depositing the uncertified clams. There was no objection voiced. President Hataier made a motion, seconded by Trustee Staples and carried to approve the minutes of the reqular meeting of April 1, 1981 and set the next meeting for June 3, 1981. On motion made by President Hataier, seconded by Trustee Smi-th, it was RESOLVED to approve the application of William Rose to place mushroom mooring off publicly-leased property at.Nar~'ow River. Vote of the Board: Ayes: Hataier, Kujawski, Smith., Staples, Stoutenburgh On motion made by Trustee Stoutenburgh, seconded by Trustee Kujawski, it was RESOLVED to approve the application of John Michael John with the provision that it be an offshore stake with pulley line to' bulk- head at Mattituck Park District all subject to written permission from the Park District Commissioners to do so. Reiter to place offshore stake with pulley line to onshore stake off public property known as the Anchorage at Mattituck Creek. Sheehan to place 250 lb. mushroom anchor off public property at Mattituck Creek with the provision that it does not swing into the channel nor interfere with other boats moored in the area. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh 442 On motion made by President Hataier, seconded by Trustee Smith, it was RESOLVED to approve the application of Paul Giluiano to place 300 lb. mushroom anchor off private property, with owner's permission, at Gull Pond subject' to it not interfering with navigation. Grathwohl~ Jr. to place offshore stake with pulley line to onshore stake off public property at Goose Creek. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, S toute nburgh On motion made by President Hataier, seconded by Trustee Kujawski, it was RESOLVED to approve the application of The Lagoon Association' to maintenance dredge bulkheaded entrance to the lagoon to continue free tidal flow and safe passage for small boats, spoil to be placed north of inlet to provide beach nourishment. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh On motion made by Trustee Kujawski, seconded by President Hataier, it was RESOLVED to recommend to the Southold Town Board that a wetlands permit not be required in the matter Of the maintenance dredging proposed by Mattituck Inlet Marina because there are no wetlands involved. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staple~, Stoutenburgh On motion made by Trustee Stoutenburgh, seconded by President Hataier, it was RESOLVED to table the application of Mattituck Inlet Marina to maintenance dredge until such time as an inspection has been made to determine if the spoil area proposed is suitable and whether there should be a full charge for the spoil. The meeting will take place on May 14 at 1.:30 ~m~ ~ ..... '~ .... Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, ~.Stoutenburgh 443 On motion made by Trustee Kujawski, seconded by President Hataier, it was RESOLVED to recommend to the Southold Town Board approval Of the wetland application to construct a dock off private property of the applicant at Mattituck Creek as applied for by Nicholas Fontana. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh Mr. Fontana is to be informed tha~ he will require a permit from the Town Trustees for the construction taking place below high water mark. On motion made by President Hataier, seconded by Trustee Kujawski, it was RESOLVED to approve the application of W. E. Gallanos to place 300 lb. mushroom anchor off private property at Mattituck Creek with the provision that a stern anchor be placed so that in no circumstance the boat will swing out into the channel. Vote of the Board: Ayes:.~ Hataier, KujaWski, Smith, Staples, Stou tenburgh Mr. Van Name appeared before the board rePresenting Matt-A-Mar Marina in the matter of work being started before permission was given by the Town Trustees to amend the permit. Mr. Van Name apologized for doing the work but explained he thought it was within-the scope of the permit as it was lesser work being done~ The board questioned a spile about which there have been complaints'and will make an examination of same on the 14th of May. On motion made by President Hataier, seconded by Trustee Smith, it was RESOLVED to approve the amendment to the permit of Matt-A-Mar Marina to include the following: 1. Removal< of sixteen mooring piles. 2. Change from approved fourteen 24' x 30" finger piers each with pile on end to eleven 27' x 48" finger piers each with pile on end. 3. Width of bays to be changed from 25' to 30' 4. Elimination of 3' wide "bib" due to change There will be overall change in length. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh 444- On motion made by President Hataier, seconded b~f Trustee Stoutenburgh, it was RESOLVED to approve the application of the Suffolk County Department of Public Works to reconstruct bridge carrying New Suffolk Avenue over Downs Creek. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh On motion made by President Hataier, seconded by Trustee Stoutenburgh, it was RESOLVED to approve the application of the Suffolk County Department of Public Works to reconstruct bridge carrying New Suffolk Avenue over Mud Creek. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh On motion made by President Hataier, seconded by Trustee Stoutenburgh, it was RESOLVED to recommend ~o the Southold Town Board approval of the wetland application of the Suffolk County Department of Public Works #63 for a permit to reconstruct bridge carrying New Suffolk Avenue over Downs Creek in the Town of Southold. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh On motion made by President Hataier, seconded by Trustee Stoutenburgh, it was RESOLVED to recommend to t he Southold Town Board approval of the wetland application of the Suffolk County Department of Public Works #62 for a permit to reconstruct bridge carrying New Suffolk Avenue over Mud Creek. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh A letter will be sent to the Suffolk County Department of Public Works asking them to consider erecting a fishing pier on the bridge over West Creek if any work takes place in the future in that area. 445 On mction made by President Hataier, seconded by Trustee Kujawski, it was RESOLVED to recommend to the Southold Town Board approval of the wetland application of Carol K. Tuthill #65 for a permit to construct catwalk, ramp, float and platform at private property of the applicant at Gull Pond. Vote of the Board: Ayes: Hataier, kujawski, Smith, Staples, Stoutenburgh The application of Carol K. Tuthill came in originally under the name of Marion Pell. Both people own the property. The two applications are not the same and it will be necessary to file for an amendment to the original application to the trustees. On motion made by Trustee Staples, seconded by Trustee Kujawski, it was RESOLVED that Hallock Bay, Arshamomaque Pond and Goose Creek be closed for shellfishing for a period of thirty days from the date of the planting of uncertified clams. Vote of the Board: Ayes: Hataier, Kujawski, Smith~ Staples, Stoutenburgh The Town Clerk will be requested to make an announcement of same in the local papers so the people of the Town will know why the creeks are being closed. Dorothy Redden wrote a letter to the board complaining about the location of a mooring in Little Creek being used in the summer by Stewart Sanderson. The boat is not in the creek now so it is difficult to see Mrs. Redden's problem. If she will let the board know when the boat is in a member will make an inspection. On motion made by President Hataier, seconded by Trustee Staples, it was RESOLVED to issue a blanket permit for the 1981 season to the Suffolk County Department of Public Works for all dredging projects in the Town of Southold with the understanding that all future projects must have a permit from the Board of Town Trustees. Vote of the Board: Ayes: Hataier, Smith, Staples, Stoutenburgh Mr. Kujawski had left at this point. The Board would like the County to consider starting the application process now for the dredging of the mouth of Richmonds Creek as it is felt this is a priority item. 446 On motion made by President Hataier, seconded by Trustee__ Stoutenburgh, it was RESOLVED to approve the renewal of the following permits: Frank Begora Ever~ S. GUndersen Vote of the Board: Ayes: Hataier, Smith, Staples, Stoutenburgh *** A report was made for the record on the meeting held at the invitation of the Town Board on May 5, 1981 with John Guldi of the Suffolk County Department of P~nblic Works. It was the understanding at the meeting that for the 1981 season the Board of Town Trustees would issue a blanket permit for work contemplated by the County in the mouths of the creeks. In the future the trustees will be responsible for setting up a priority schedule with comments and cooperation welcome from the Town Board. A request for a quitclaim deed has been received from Allen S. and Alice L. Dawe for 'filled' property adjoining the property of the applicant. The deed will be sent to the town attorney to insure that it is in proper order. The request of John Wickham for a quitclaim deed was discussed~ The town attorney has advised the board that there should be a detailed survey of the area in question. Mr. Wickham is to be asked if he would consider a covenant that nothing will be done with the land other than farming. The Board is in receipt of a proposed change in the Code of the Town of Southold involving enforcement provisions. This will be sent to the Town Board for action. The Board would also like a provision that the use of the creek bottoms be limited to taxpayers and residents. When new forms are needed for mooring applications, Trustee Stoutenburgh requested that there be a space for phone numbers and the draft of the boat. There being no further busines~O come before the Board, President Hataier made a motion, seconded by Trustee Stoutenburgh and carrzed to adjourn. Meeting adjourned at 9:50 p.m.
