New York. 11566. WIT N E SSE T H : .... WHEREAS. GREGORY SIMONELLI. is the owner in fee simple of certain premises located at Mattituck. Town of Southold, Suffolk County. New York, known and designated on a certain map as subdivision map prepared for GREGORY SIMONELLI at Mattituck, Town of Southold, Suffolk County, New York. and WHEREAS. said GREGORY SIMONELLI. was required by the Southold Town Planning Board as a condition to its approval to said subdivision to impose certain covenants and restrictions upon said property; NOW THEREFORE, GREGORY SIMONELLI. declares that the said premises which is hereafter described/~-~~~WhiCh is annexed hereto and --- ' made a part hereof is subject to the following covenants and restrictions: That there is to be a common driveway for lots number 2 and 3 and that the maintenance and up keep of said common driveway shall be shared equally between the owners of lots number 2 and 3. The owner of lot number 2 shall have an easement for ingress and egress over that portion of the common driveway which is located on lot 3 and similarly the owner of lot number 3 shall have a right of way for ingress and egress over that portion of the common driveway is shown on the subdivision map prepared by Young and Young dated May 1. 1990. These convenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing.
