~ ~ THIS INDENTURE made the 20th day of February , 1987 by ALICE MARIE
~ BE~GEN, residing at no number Mill Road, Mattituck, New York, 11952,
hereinafter called the Declarant.

WHEREAS, the Delarant is the owner in fee simple of a certain parcel
of land situate at Mill Road, Mattituck, Town of Southold, Suffolk County,
New York, and designated on the Suffolk County Tax Map as District 1000,
. Section 106, Block 9, Lot 8 containing 11.063 acres which premises are described

WHEREAS, the Declarant intends to subdivide said premises for residential

WHEREAS, the Planning Board of the Town of Southold passed a resolution at
its meeting held on September 16, 1985 approving said subdivision sU9ject to the
filing of certain covenants and restrictions as a condition to said approval and
NOW THEREFORE, the Declarant does hereby declare that the aforesaid premtses
and every portion thereof is hereby held and shall be conveyed subject to the
conditions, covenants and restrictions hereinafter set forth, and that every
purchaser of said premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the prQlllises so purchased shall be held
subject to the covenants, conditions, and restrictions hereinafter set forth:

That the property may not be further subdivided without approval of
. the Southold Town Planning Board and, if there be further subdivision, it
must conform in all ways to a major subdivision if required by the Southold
Town' Planning Board and these Covenants and Restrictions shall run with
the land,

All that certain plot, piece or parcel of land, with the buildings

in the Town of Southold, County of Suffolk and State of New York,
being more particularly bounded and described as follows:
BEGINNING at a point marked by a concrete monument on the westerly
side of Mill Road at the southeast corner of the subject premises
and the northeast corner of land now or formerly of Jackson's Landing
Inc.; from said point beginning;running
THENCE north 81 degrees 15 minutes 00 seconds west 325.74 feet
to a concrete post; running
THENCE north 82 degrees 24 minutes 00 seconds west 329.00 feet
to a concrete monument and land now or formerly of Stanley Sledjeski;
running
THENCE north 18 degrees 18 minutes 20 seconds east 796.40 feet
to a concrete monument and land now or formerly of North Fork Creek
