M INU TE~ ~_ A Work SesSion of the Southold Town Trustees was held at 6:30 PM, Tuesday, February 2, 1982, at the Town Hall, Main Road, So~thold~ New York, Present were: President Paul Stoutenburgh Vice President Frank Kujawski Trustee Henry Smith Trustee John Bednoski Trustee John DiVello -' Marian Gpubeaud,~ Clerk , Charles Hamilton~ DEC Ruth 0live, North Fork Environmental Tom Czelatka, Bay Constable /Council In order to work closer with them, the Trustees met with Charles Hamilton of the Department of Environmental Conservation to discuss the views and philosophies of the DEC on projects. On motion of Mr. Stoutenburgh, seconded by Mr. Kujawski and carried, the minutes of the January 5, 198~, meeting, were approved. The next meeting of %he Board will be Ma~ch~2,-1982. On motion made by Mr. Smith, seconded by Mr. Kujawski, it was RESOLVED to approve the application of Walter Sibernagel with the pro- vision the length of the dock will be determined by a maximum depth of 3' at low water at ~he end of the dock but not to exceed the footage requested on the application. Construction is not to begin until after staking and review by the Trustees, which will take plage after thawing. Vote of Board: Ayes: Messrs. Stou~enburgh, Kujawski, Smith, Bednoski and DiVello. On motion made by Mr. Smith, seconded by Mr o Bednoski, it was RESOLVED to recommend to the Southo!d Town Board to approve the wetland application ~83, of Walter Silbernagel as per above application. On motion made by Mr. Kujawski, seconded by Mr. Bednoski, it was RESOLVED to approve the application of Strong's Marina on James Creek to maintenance dredge two contiguous rectangular~areas 70' x 20' and 200' x 20' ~o a depth of 4' below MLW; to ~emove approximately 350. cu yds of material which is to be placed on adjacent upland where it will be pre- vented from reentering the waterway, vote of Board: Ayes: Messrs. Stoutenburgh, Kujawski~,~'smith, Bednoski, DiVello. ' .On motion made by Mr. Kujawski, secondedby Mr. Smith, /it was -RESOLVED to recommend to ~he South01d ToWn Board to approve the wetland application, ~84, of Strong' Marina ~s per above applicat'ion. Vote of Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello. Tom Samuel's~.~inquired~about the-Trustees-.request to remove,the surplus material that was built up during construction of Arthur March'esi's bulkhead in Brush's Creek. He stated the DEC and Army Corps of Engineers said no dredging. Mr. Stoutenburgh told him the Trustees would help him with the permits, if needed. The Board requeste~ letters be Sent to Fred Melin~and Marino Faraguna stating they could place clean upland fill behind their bulkheads on Skunk Lane, Cutchogue. After discussion, bt was agreed by ~he Board that William 'LaM0rte could put the spoils from dredging ~ehind his retaining wall at no charge, as the property being dredged is not'in Town waters. Discussion was 'held on the~ appt'ication of The Lagoon Association for- ~redging. Tom Samuels, stated the firm of Geraghty and Mille~,~had suggested driving well points'eight feet below the bottomlan~ at-various locations in the Lagoon. and then~testing the water quality i~.eaCh well. The logic behind this being ~f there was nothing but salt water bel'ow, no intrusion would take place. The Board requested a letter be sent to Anthony Candela of the DEC stating the above and asking that he oversee it. Mr. Samuels stated and the Board agreed that the well points were to be driven ,in, 'not jetted~in by water. On motio~ made by Mr. Smith, seconded~ by Mr. Kujawsk~i~i it was RESOLVED to approve the application of Cheryl Pagnozzi ~ith the provision the original dock is to be removed and placed on the other side of the railway. Vote of ~oard: Ayes: MeSsrs. Stoutenburgh, Kujawski, Smith, Bednoski and DiVello. On motion made by Mr. Smith, seconded by Mr. DiVello, it was RESOLVED-to recommend to the S0uthOld Town Board'to approve the wetland application, ~85, of Cheryl Pagnozzi as Per above application. Vote of Board: Ayes: Messrs~ Stoutenburgh, Kujawski, Smith, Bednoski, DiVello. On motion made by Mr. Smith, seconded by Mr. Bednoski, it was RESOLVED to approve a quit olaim deed for CLinton A. Hummel. William Smith is to draw up the deed and bring it to Town Attorney Tasker for approval~. After this approval, the Trustees will sign Lt. Vote of ,Board:~ Ayes: Messrs. Stoutenbu~ghl Kujawski, Smith, Bednoski', DiVello. - 477 'On motion made by Mr. Smith, seconded by Mr. Bednoski and carried, all the mooring renewal permits for the month of March were approved. On motion made by Mr. Stoutenburgh, seconded by Mr. Kujawski, it was RESOLVED to recommend to the Southold Town Board to amend the Shellfish Ordinance to include a fee of three dollars ($3.00) per fami!~for resident non-commercial permits and to establish a limit of one-hundred (100)-clams per person per day. Monies collected for fees are to be earmarked ex- clusively for the seed clam program. Vote of Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello. Discussion was held on a letter from the Southold ToWn Baymen's AssociatioK in regard to violations pertaining to lack of permits issued by the Corps of Arm~ Engineers and the Southold Town Board of Trustees for construction projects. In regard to a letter from the Orient Mosquito District, the Board requested a reply be sent stating they must have permits for a drain in Narrow River.Road, as it is partly in Town Waters. The Board requested a reply be sent to.Robert Stewart in regard to his letter concerning the finger piers at Matt-A-Mar Marina. A copy of the letter the Trustees sent to A. Marshall Irving of the DEC is to be enclosed. On motion made by Mr. Kujawski, seconded by Mr. Bednoski, it was RESOLVED that the new fee schedule and amended applications be approved. Vote of Board: Ayes: Messrs. Stoutenburgh', Kujawski, Smith, Bednoski and DiVello. , The Board agreed-a Southold Town Trustee Permit sign be printed.and be displayed at all job sights. Mr. Stoutenburgh is to take care of this. On motion made by Mr. Smith, seconded by Mr. DiVello, it was RESOLVED that docks and floats be .charged by square footage only and not for piles holding the dock and a fee for the'piles holding floats and boats would be charged. Vote of Board: Ayes: Messrs. Smith and DiVello. Nayes: Messrs. Stoutenburgh and Kujawski. Abstain: Mr. Bednoski. -After further discussion, another vote ~was taken-.on, the above matter. Vote of Board: Ayes: Messrs. Smith and DiVelto..- N~yes: Messrs. Stoutenburgh, Kujawski and Bednoski. The motion Was ~defeated. On motion made by Mr. DiVetlo, seconded by Mr. Bednoski, it was RESOLVED a letter be sent to the Southold Town BOard .requesting permission for Trustees Stoutenburgh and Kujawski to attend the Association of Towns meeting in New York City on February 14,15,16,17.
