TERMS AND CONDITIONS
The Permittee Belvedere Property Management LLC. residing at 1251 Avenue of the
Americas. 17fu Floor. New York. NY 10020 as part of the consideration for the issuance of the
Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages. or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Just:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 23, 2008 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting on behalf of BELVEDERE PROPERTY
MANAGEMENT, LLC applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated December 14, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 23, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of BELVEDERE
PROPERTY MANAGEMENT, LLC to install approximately 120' of single row rock wall
utilizing 2-3 ton rocks. Rocks shall be placed on top of filter fabric and 25-50 pound
hardcore stone foundation. Wall shall then be covered with approximately 85 cubic
yards of dewatered and dry spoil from adjacent dredging project. Area will then be re-
vegetated with Cape American beachgrass 12" on center and Rosa Virginica planted 5'
on center and bank shall be maintained and replenished annually as needed, and as
depicted on the site plan prepared by Costello Marine Contracting Corp., last dated
November 30,2007, and received on December 14, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

BELVEDERE PROPERTY MANAGEMENT, LLC requests a Wetland Permit to
install approx. 120' of single row rock wall utilizing 2-3 ton rocks. Rocks shall be placed
on top of filter fabric and 25-50 lb. hardcore stone foundation. Wall shall then be covered
with approx. 85 cy. of dewatered and dry spoil from adjacent dredging project. Area will
then be re-vegetated with Cape American beachgrass 12" on center and Rosa Virginica

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of South old Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT
with the following Policy Standards and therefore is CONSISTENT with the
LWRP.
Policv Standards
4.1 Minimize losses of human life and structures from flooding and erosion
hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:

D. Use hard structural erosion protection measures for control of erosion
only where:
4. Construction of a hard structure is the onlv practical design
consideration and is essential to protecting the principal use.
5. The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessarv
b. based on sound engineering practices
6. Practical vegetative methods have been included In the proiect
design and implementation.
7. Adequate mitigation is provided and maintained to ensure that
there is no adverse impact to adjacent property or to natural coastal
processes and natural resources and, if undertaken by a private
property owner, does not incur significant direct or indirect public
costs.
If the action is approved the following best management practice (BMPl is
recommended:
I. Stabilize the bank between the rock wall and the parking lot with native
vegetation.
2. Locate the wall as close to the existing bank as possible to limit hardened
shoreline structure on the beach.
The BMP will further Policies 5, Protect and improve water qualitv in the Town of
Southold and 6.3 Protect and restore tidal and freshwater wetlands.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits" including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a detenniuation of consistency. "Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to l'I1a1cing a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it "hall not be undertaken.

Responses to LWRP
Applicant: Belvedere Property Management, LLC.
Location: First & Jackson Streets, New Suffolk

The project consists of the applicant's proposal to install approximately 120'
of single row rock utilizing 2-3 ton rocks. Rocks shall be placed on top of
filter fabric and 25-50 lb. hardcore stone foundation. Wall shall then be
covered with approximately 85 c.y. of dewatered and dry spoil from
adjacent dredging project. Area will then be revegetated with Cape
American Beach Grass planted 12" o.c. and Rosa virginica planted 5' o.c
Bank shall be maintained and replenished annually as needed. In 2006 an
application was submitted to the Town Trustees and the N.Y.S.D.E.C. for
this proposed activity. At that time, the project was approved by the Town
Trustees, but the N.Y.S.D.E.C. had requested that the project be modified.
The requested modification was for the "construction" of a sand dune,
planted with native vegetation instead of the rock revetment, with the
assurance that if the sand dune failed, a revetment may be constructed. The
sand dune has failed and approximately 16' of uplands have eroded into
Cutchogue Harbor.
As part of my review of the Town's LWRP Consistency Form Section C,
I offer the following comments regarding the Local Waterfront
Revitalization Policies and this proposed project:
Policy 1. The project as proposed will not result in any negative impacts
whatsoever upon the development pattern desired by the Town of Southold
or shall it result in the loss of the community and landscape character of the
Town of South old.
Policy 2. The project as proposed shall not result in the loss of any
archeological resources. An archaeological report was prepared for the
subject property and no archeological resources have been identified.
Policy 3. The project shall not impair the visual quality or the scenic
resources of Cutchogue Harbor.

Policy 4. The proposed reconfiguration of the existing structure has been
based on sound engineering practices and designed to minimum scale
necessary to manage flooding and erosion. The project shall not negatively
impact public lands or public trust lands.
Policy 5. The project does not involve any direct or indirect discharges that
would cause any negative impacts upon water quality standards. There shall
be no negative impacts upon water quality standards. There shall be no
increase or decrease in the pH, the dissolved oxygen or nutrients in the
waterway and there should be no increase in negative health impacts such as
pathogens, chemical contaminants or toxicity nor shall there be any negative
aesthetic factors involved with the project. The project does not involve
watershed development or the quantity or quality of potable water.
Policy 6. The project shall have no impact upon the ecological quality of
the Town of Southold. There shall be no direct or indirect disturbance to
any significant Coastal Fish or Wildlife Habitats.
Policy 7. I do not feel that this policy is applicable to this project since the
project does not involve any atmospheric deposition of pollutants.
Policy 8. I believe that the project is consistent with this policy. The project
shall not involve the disposal of solid wastes or debris. There are no
hazardous waste or toxic pollutants involved with the project.
Policy 9. I do not feel that this policy is applicable to this project. The
proposed project shall have no impact upon adequate physical public access
to coastal resources, shall not impact any public visual access to any lands
or waters, involve the public interest in and use of lands and waters held in
public trust or to public access of such areas. Nor will the project have
impacts upon the public's right of access along the shoreline.
Policy 10. I feel that the project is consistent with this policy. The project
shall have no negative impacts upon any existing water-dependent
commercial, industrial or recreational uses of the Peconic Bays. Nor is the
project located on Mill Creek of within the Village of Greenport and does
not involve water-dependent uses at those sites.

Policy 11. I feel that the project is consistent with this policy. The project
does not involve aquaculture or the removal of shellfish from uncertified
waters of the Town of Southold nor shall it have a negative impact upon the
long term maintenance and health of living resources.
Policy 12. I do not feel that this policy is applicable to the project because
no agricultural lands are involved.
Policy 13. I do not feel that this policy is applicable to the project since the
project does not involve energy or mineral resources.
