AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
December 12, 2007, and in consideration of application fee in the sum of $250.00 paid by Jill & Carol Ridim
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
' Wetland Permit to construct a 10'x10.25' extension to the existing
construct a 3'x104' fixed dock with crossover stairways to beach; install two 10"
diameter mooring pilings; remove existing wing retaining wall; construct 116' of new 5
high retaining wall; backfill area behind retaining wall with clean trucked in soil
approximately 50 cubic yards; re-vegetate with Cape American Beachgrass planted 12'~
on center; repair existing stairway up bank as needed in-place; and install concrete
catch basin at top of bank on southwest corner of property, with the condition that
open-grate material be used for the dock decking, and as depicted on the survey
prepared by Costello Marine Contracting Corp., last dated June 29, 2007, and received
on July 31, 2007.
1N WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Jill & Carol Ridini, residing at 805 West Road, Cutchogue, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permit'tee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances wan'ant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the stmctore or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 12, 2007 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of JILL & CAROL RIDINI
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated July 31,2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6 & 9 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: use of an open-grate decking
material for the dock, and
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of JILL & CAROL
RIDINI to construct a 10'x10.25' extension to the existing wooden deck; construct a

At the meeting of the Southold Town Conservation Advisory Council held Wed., August
15,2007, the following recommendation was made:
Moved by Don Wilder, seconded by Chris Kempner, it was
RESOLVED to SUPPORT the Wetland Permit application of JILL & CAROL RIDINI to
construct a 10'X 10.25' extension to the existing wooden deck, install 2-10" dia. mooring
pilings. Remove existing wing retaining wall. Construct 116'+/- of new 5' high retaining
wall. Backfill area behind retaining wall with clean trucked in soil, approx. 50 cy., and re-
vegetate with Cape American Beach grass planted 12" on center. Repair existing
stairway up bank as needed in-place. Install concrete catch basin at top of bank on
southwest corner of property, and to NOT SUPPORT the application to construct 3'X
104' fixed dock with cross over stairway to beach.

The CAC Supports the extension to the deck using appropriate materials. The CAC
does Not Support the fixed dock because there are no other docks in the area. The
CAC also questions the need for a 5' high retaining wall and the size of the catch basin,
and whether or not it's appropriate to stop erosion.

JILL & CAROL RIDINI requests a Wetland Permit to construct a lO'X 10.25' extension to the
existing wooden deck. Construct 3'X 104' fixed dock with cross over stairway to beach. Install
2-10" dia. mooring pilings. Remove existing wing retaining wall. Construct 116'+/- of new 5'
high retaining wall. Backfill area behind retaining wall with clean trucked in soil, approx. 50 cy.,
and re-vegetate with Cape American Beach grass planted 12" on center. Repair existing stairway
up bank as needed in-place. Install concrete catch basin at top of bank on southwest comer of
property. Located: 805 West Rd., Cutchogue. SCTM#110-7-4.
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed actions are INCONSISTENT with the below Policy Standards and
therefore are INCONSISTENT with the L WRP.
1. Construct a 10'X 10.25' extension to the existinl! wooden deck.
2. Remove existinl! winl! retain in I! wall. Construct 116'+/- of new 5' hil!h retain in I!
wall.
3. Install concrete catch basin at top of bank on southwest corner of property.
The proposed above actions are inconsistent pursuant to the followinl! policv:
Policy 6. Protect and restore the quality and function of the Town of South old ecosystem
6.3 Protect and restore tidal and freshwater wetlands.

A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The proposed setback distance from the proposed wooden deck to the existin2 bulkhead is
o feet. the proposed new retainin2 wall to the existin2 bn1khead is 12 feet and the proposed
catch basin is (undetermined) feet from the bulkhead: a minimum setback distance of 100
feet is required pursuant to Chapter Ii 275-3. Findin2s: purpose: iurisdiction: setbacks.
Please require that the applicant amend the application to meet the above policv to the
2reatest extent practical.
The proposed 3'X 104' dock is inconsistent with the L WRP subiect to the below policies.
THE PROPOSED DOCK IS LOCATED IN CUTCHOGUE HARBOR WHICH IS A NEW
YORK STATE DESIGNATED SIGNIFICANT FISH AND WILDLIFE HABITAT AREA.
Po1icv Standard
1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal
location, and minimizes adverse effects of development.
The proposed action is for private (recreational) use and will not support a pattern of
development that enhances community character nor preserves "public" open space.
Additionallv. the applicant does not propose sufficient miti2ative desi2n and construction
best mana2ement practices that will minimize the adverse effects of the action on the
environment. scenic view shed or the use of public waters/lands to the 2reatest extent
possible.
5. Protect and improve water quality and supply in the Town of South old.
The materials proposed to construct the dock have not been specified
The use of the dock must be identified. The installation of the proposed dock mav promote
boat traffic in areas of shallow water depths which could lead to the followin2 ne2ative
impacts:
Impacts to submer2ed aquatic ve2etation.
Contamination from fuel dischar2es (if power vessels are proposed)
Re-suspension of bottom sediments and turbidity
Bottom scarrin2 from vessels accessin2 the dock structure to the west is evident (see below
photo).
6.1 Protect and restore ecological quality throughout the Town of Southold.

A. Avoid adverse changes to the Long Island Sound and the Peconic Bay ecosystems
that would result from impairment of ecological quality as indicated by:
1. Physical loss of ecological components
Physical loss is often the most obvious natural resource impairment to
identify. It usually results from discrete actions, such as filling or
excavating a wetland or clearing an upland forest community prior to
development.
The dock structure will result in the physical loss of marine habitat. Physical
impacts will include but not be limited to: chronic shadin!! of the substrate where
the dock is located.
B. Protect and restore ecological quality by adhering to the following measures.
1. Maintain values associated with natural ecological communities.
Each natural ecological community has associated values which contribute
to the ecological quality of the Town of Southold. These values should be
assessed on a case-by-case basis.
2. Retain and add indigenous plants to maintain and restore values of natural
ecological communities.
a. Protect existing indigenous plants from loss or disturbance to the
extent practical.
3. Avoid fragmentation of ecological communities and maintain corridors to
facilitate the free exchange of biological resources within and
among communities.
a. Each individual resource area should be maintained as complete
contiguous areas to protect the area's natural resource values.
Specifically, actions that would fragment the ecological
community into separate ecological islands should be avoided.
b. Where fragmentation of ecological communities has already
occurred, the adverse effects of fragmentation can be mitigated by
maintaining or providing connecting corridors to allow exchange
of biological resources.
4. Maintain ecological integrity of particular locales by maintaining
structural and functional attributes, including normal variability, to
provide for self-sustaining systems.
5. Avoid permanent adverse change to ecological processes.
The proposed action would result in a physical loss of ecolo!!ical components as
indicated above.
6.3 Protect and restore tidal and freshwater wetlands.
The proposed action does not comply with S 275-11. Construction and operation standards.
A. Comply with statutory and regulatory requirements of the Southold Town Board of

The applicant has not demonstrated that the followinl! dock standards pursuant to &
275-11. Construction and operation standards have been met
(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the following
harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shell fishing, waterskiing and other water-dependant
activities;
[3] Whether the dock will unduly interfere with transit by the public along the public
beaches or foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, sea grasses including eelgrass (Zostera marina) and widgeon grass
(Ruppia maritima) or shellfish;
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructed;
[10] Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
[II] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and location
of the dock will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.

9.1 Promote appropriate and adequate physical public access and recreation to coastal
resources.
B. Provide convenient, well-defined physical public access to and along the coast for
water-related recreation.
C. Protect and maintain existiml public access and water-related recreation
facilities.
1. Prevent physical deterioration of facilities due to lack of maintenance or
overuse.
2. Prevent anyon-site or adjacent development project or activity from
directly or indirectly impairing physical public access and recreation or
adversely affecting its quality.
3. Protect and maintain established access and recreation facilities.
4. Protect and maintain the infrastructure supporting public access and
recreational facilities.
D. Provide additional physical public access and recreation facilities at public sites
throughout the Town of Southold.
1. Promote acquisition of additional public park lands to meet existing public
access and recreation needs.
2. Provide for public access and recreation facilities on non-park public
waterfront lands as a secondary use.
3. Provide for public access at streets terminating at the shoreline.

4. Provide access and recreation facilities to all members of the public
whenever access or recreation is directly or indirectly supported through
federal or state projects or funding.
4. Retain a public interest which will be adequate to preserve public access
and recreation opportunities in publicly owned lands immediately adjacent
to the shore in any transfer of public lands.
The proposed action will impede public access of public lands.
9.4 Assure public access to public trust lands and navigable waters.
B. Ensure that interference with passage along the shoreline is limited to the
minimum extent necessary to gain access from the upland to the water.
E. Provide access to, and reasonable recreational use of, navigable waters and
public trust lands under water.
I. Provide for free and unobstructed public use of all navigable waters below
the line of mean high water for navigation, recreation, and other public
trust purposes, including the incidental rights of public anchoring.
The proposed action has not demonstrated that it meets or furthers the above sub-
policy.
4. Structures extending bevond the mlmmum necessarv for access to
navigable waters impair public trust interests and open space values
associated with the water's surface. Allow such structures onlv in the
following circumstances:
a. when necessary for practical and convenient operation of water-
dependent industry or commerce, and provided that obstruction of
commercial navigation does not result.
b. for commercial recreational boating facilities provided that:
(i) the loss of navigable waters and use of underwater lands is
offset by sufficient public benefit, and
(ii) obstruction of commercial navigation does not result.
c. when the principal purpose ofthe structure is necessary:
(i) to provide public access for recreational uses
(ii) for improvements for navigation
(iii) for protection from coastal hazards, or
(iv) for essential public transportation and transmission
facilities.
C. Protect and maintain existing public access and water-related recreation facilities.
\. Prevent physical deterioration of facilities due to lack of maintenance or
overuse.
2. Prevent anyon-site or adjacent development project or activity from
directly or indirectly impairing physical public access and recreation or
adversely affecting its quality.
3. Protect and maintain established access and recreation facilities.
4. Protect and maintain the infrastructure supporting public access and
recreational facilities.

9.5 Provide access and recreation that is compatible with natural resource values.
A. Provide appropriate access and associated recreational activity that will avoid
potential adverse impacts on natural resources. Use the following factors in
determining the potential for adverse environmental effects:
1. intensitv ofthe associated recreational. scientific. or educational activitv.
2. level of likelv disturbance associated with the proposed activitv. The
following types of access or associated activities are listed in decreasing
order of potential for disturbance:
a. motorized activities,
b. active. non-motorized activities. including water-dependent and
water -related uses,
c. passive activities,
d. avoidance of the area.
3. Sensitivitv of the natural resources involved and the extent of the
ecological benefits associated with avoidance of the area.
B. Limit public access and recreational activities where uncontrolled public use
would lead to impairment of natural resources.
1. Establish appropriate seasonal limitations on access and recreation in
order to minimize adverse impacts on fish and wildlife species.
2. Provide stewardship that is capable of controlling anticipated adverse
impacts before providing public access.

3. Physically limit or avoid provision of public access to natural resource
areas whose principal values are based on the lack of human disturbance.
D. Provide access using methods and structures that maintain and protect open
space areas associated with natural resources. Determine the extent of visual
and physical impairment by structures extending through these open space areas
based on:
1. the value of the open space as indicated by un-fragmented size or mass of
the wetland or other natural resources, distance to navigable water, and
wetland value.
2. the size, length, and design of proposed structures
The applicant currently enjoys access to public waters through the location of the
waterfront parcel. The applicant has not demonstrated that the proposed action meets the
above listed policies.

Southold Town Trustees and Mark Terry
Construct 10'x10.25' extension to existing wooden deck. Construct a 3'x104' fixed dock with
crossover stairways to beach. Install two 10" diameter mooring pilings. Remove existing wind
retaining wall. Construct 116' on new 5' high retaining wall. Backfill area behind retaining wall with
clean trucked in soil approximately 50 cubic yards. Re-vegetate areas behind walls with Cape
American beach grass planted 12"0.c. Repair existing stairway up bank as needed, in-place. Install
concrete catch basin at top of back on southwest corner of property.
DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
The dock will be used by the property owners and their families to engage in water dependent
activities such as fishing, swimming and boating. The size of the dock is very modest in size and the
retaining wall will help the homeowners use this area of their property more efficiently.

This property has no significant historic resources.
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The project location is in Cutchogue Harbor which has been developed similar to our request. The
retaining wall should have no effect on the visual quality and the proposed dock is consistent with the
area. It will not look out of place or contradict the present aesthetics of the area.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
This shoreline is mostly reinforced with erosion control structures. The new retaining will not
increase flooding or erosion in this area. The proposed dock will not have any ill effects on life,
structures or natural resources.

The only appropriate place for a dock is off a waterfront piece of property. The proposed dock will
be used by the property owners and their families to access the water and engage in water-

This proposal will have no impact on the marine resources in the Town of Southold. There are no
vegetative wetlands in this area. Initially driving the piling into the ground will stir the area but in a
