ACTIVITY: Construction of a 4-foot-wide by 16-foot-long ramp onto a 4-foot-wide by
60-foot-long fixed dock; a 6-foot-wide by 20-Foot-long floating dock with a
4-foot-wide by 4-foot-long access platform; and a 32-inch-wide by 20-foot-
long seasonal ramp.
The purpose of this project is to provide boat dockage for the owner.

As this is minor in nature, authorization may be by Letter of Permission. This is in
accordance with current Federal Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the issuance of a Letter of Permission,
your review of the enclosed drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended (16
U.S.C. 1465 (c)(3)(A)), the applicant has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state coastal zone management
program.
To allow for the timely processing of the subject application, your comments are requested
within 20 days of the date of this letter. If you have any questions, please contact Leo Strogach, of

TERMS AND CONDITIONS
The Permittee Eve Seber. Contract Vendee, residing at 80 Franklin Street. Apt. 2, New York.
New York, as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
L That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold,
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 14, 2007 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of EVE SEBER, AS
CONTRACT VENDEE applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated September 24,2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: a turbidity screen is installed around
entire area during construction, use of open grate material on the dock, and

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirem!3nt imposed above, the Board of Trustees deems the action to be
Consistent with th,e Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the South old Town Code, and,
RESOLVED, that,the Board of Trustees approve the application of EVE SEBER, AS
CONTRACT VENDEE to construct a 4' x 16' ramp onto a 4' x 50' fixed dock with a
32" x 20' seasonal aluminum ramp onto a 6' x 20' seasonal floating dock with a 4' x 4'
access platform to be installed no earlier than April 1st and removed no later than
December 1st of each year, and install two 8" diameter anchor pilings, with the condition
of a turbidity screen is installed around entire area during construction, and use of an
open grate material on the dock decking, and as depicted on the site plan prepared by
Costello Marine Contracting Corp., last dated December 12, 2007, and received on
December 17,2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

10,2007, the following recommendation was made:

CONTRACT VENDEE to construct a 4'X 16' ramp onto a 4'X 50' fixed dock with a 32"X
20' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock with a 4'X 4' access
platform, and install two 8" dia. anchor pilings.

There was an error on the recently submitted plans for Eve Seber which was noticed by
John Costello after the plans were mailed out. The Trustees requested that a turbidity
curtain be used during construction. In pure ignorance the draftsman and I thought a
turbidity curtain was similar to a splashboard. So after a brief education and a good
laugh, the plans have been revised once again. Enclosed you will find these revised
plans. Please disregard the previously submitted plans.

seasonal floating dock with a 4'X 4' access platform, and install two 8" dia. anchor pilings.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review ofthe
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
To further the above policv and to reduce turbidity in the event that the proposed action is
approved. the followin!! Best Mana!!ement Practice is recommended:
The encirclement of the entire proiect area durin!! construction with a silt
boom or floatin!! turbidity screen to control the dispersal of suspended
solids in the water column.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems
including Significant Coastal Fish and Wildlife Habitats and wetlands.
6.1 Protect and restore ecological quality throughout the Town of Southold.

6.2 Protect vulnerable fish, wildlife, and plant species, and rare ecological
communities.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
I. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The nronosed dock extends beyond the "nier line" of the adjacent docks in
the waterway. It is recommended that the Board annlv the below listed
section of & 275-11. Construction and oneration standards.
(2) Docks.

residential dock. the Trustees shall seek to maintain lenl!ths
consistent with the other docks (i.e.. nier line) in the waterway
which meet the requirements of this chanter.
In addition the anplicant must demonstrate that the followinl! dock standards
pursuant to & 275-11. Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the following
harmful effects:
[I] Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shell fishing, waterskiing and other water-dependant
activities;
[3] Whether the dock will unduly interfere with transit by the public along the public
beaches or foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
The construction materials (type of timber) of the pronosed dock has not been
identified. It is recommended that the Board require the apnlicant identify the
.

construction materials. The use of "!!rid" material for the fixed dock will minimize
shadin!! of the creek bottom.
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, sea grasses including eelgrass (Zostera marina) and widgeon grass
(Ruppia maritima) or shellfish;
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructed;
[10] Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
[1 I] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and location
ofthe dock will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.
Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and
public resources of the Town of South old.
9.4 Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable waters and
public trust lands under water.
1. Provide for free and unobstructed public use of all navigable waters
below the line of mean high water for navigation, recreation, and other
public trust purposes, including the incidental rights of public anchoring.
Piers, docking facilities, and catwalks must not result in
an unnecessary interference with use of public trust lands.
Alternatives to long piers or docks include use of dinghies
to reach moored boats and mooring in nearby marinas.
Dredging solely to accommodate the draft of larger boats
is not a recommended alternative.
c. by extent and characteristics of the developable adjacent upland
area and its ability to support in-water development for the water-
dependent use.
c. by potential adverse effects on natural resources and their uses,
and
d. by potential adverse effects on public safety.
4. Structures extending beyond the minimum necessary for access to
navigable waters impair public trust interests and open space values
associated with the water's surface. Allow such structures only in the
following circumstances:
. .
a. when necessary for practical and convenient operation of water-
dependent industry or corrunerce, and provided that obstruction
of corrunercial navigation does not result.
b. for corrunercial recreational boating facilities provided that:
(i) the loss of navigable waters and use of underwater lands is
offset by sufficient public benefit, and
(ii) obstruction of corrunercial navigation does not result.
c. when the principal purpose of the structure is necessary:
(i) to provide public access for recreational uses
(ii) for improvements for navigation
(iii) for protection from coastal hazards, or
(v) for essential public transportation and transmission
facilities.
The proposed action is proposed as private,
noncommercial and will not support a pattern of
development that enhances community character nor
preserves "public" access or provides a public benefit
and therefore does not meet the above policv and sub-
policies.
Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic
Estuary and Town waters.
C. Foster the occurrence and abundance of the Town's marine resources through:
1. protection of spawning grounds, habitats, and water quality,

to the extent practical.

proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization ,Program, A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Tovm). .
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy

Our proposal is consistent with this policy in that it a dock structure that will be utilized by the
property owner to access his boat in order to access larger bodies of water. Our proposal makes

will adhere to any special conditions placed on this project in order to protect the wetlands on this

WORKING COAST POUCIES
Policy 10 protec.t the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
This is a waterfront piece of property. With the addition of this dock facility the property owner will
be able to access his boat to engage in water-dependent activities such as kayaking, fishing, site
seeing, water-skiing and swimming.
Policy 11 Promote sustainable use of living marine resources in the Town of Southold.
Our proposal is minimal in size so there won't be much impact on the living marine resources. The
dock will be only be 4' wide minimizing the shading of the existing vegetation. The structure will also
be constructed a minimum of 3 Y2 feet over grade allowing for significant sunlight penetration. With
adequate sunlight penetration, the wetlands will continue to thrive allowing them to maintain their
function of providing food and shelter for small fish.
