Tuesday, November 9, 1982, at the Town Hall, ~.~ain Road, Southold, New York.

President StoutenburKh called the meeting to order at 7:30 PM. On motion made
by Mr. Smith, seconded by Mr. Bednoski and carried, the minutes of the October
5, 1982, meeting were approved.
Mr. Stoutenburgh requested a letter be sent to Edwin Latson in regard ~o the
stones and debris in the area where he is going to construct his retaining wal
In regard to the complaint of Mr. O'Connor that Bennett's Pond is closing in,
Bay Constable Tom Czelatka reported he spoke to Superintendent Raymond Dean,
as the cause is a pipe that's under the road, therefore it's a problem of that
department. Mr. Dean will follow up on it, make a survey of the area and
report to Mr. O' Connor.
Mr. Kujawski gave a report on the meeting held at his home on October 20, 1982
in regard to the survey and inventory of Mattituck Creek. The structures on
the creek were broken down into four categories: ~) constructed in compliance
with the permit and the permit number is posted; 2) constructed in compliance
with the permit but the permit number is not posted; 3) have a permit but not
constructed in compliance with the permit; 4) have no permits. Mr. Kujawski
stated that over half do not-have permits. Those older than ten years will be
given permit numbers through the "Grandfather" clause.
On motion made by Mr. Kujawski, seconded by Mr. Smith and carried, the
mooring renewal permits for the month of December were approved.
On motion made by Mr. Smith, seconded by Mr. DiVello, it was
RESOLVED.to recommend to the Southold Town Board approval of the wetlands
application #109 of Philip Obenauer to fill and raise grade of lot off branch
of West Creek, Cutchogue, as long as it is graded properly; no fill at any
time will extend pass an imaginary line ~arallel to waterway between the two
cement boundary markers; fill will be graded to slope and to conform with
existing terrain. Vote of Board: Ayes: Messrs. Stoutenburgh, Kujawski,
Smith, Bednoski, I)iVello.
On motion made by Mr. Bednoski, seconded by Mr. Smith, it was
RESOLVED to approve the application of Frederick Raymes to construct 85 ft of
timber bulkhead extending from corners of adjacen~ existing bmlkhemds to
points 12 ft from mu~uat property line; 8 ft returns to be built at this point
allowing a 24 ft o~en area which will be sloped for .use as a launching ramD,
providing no asphalt is used for the launching ramp; to maintenance dredge an
area 20 ftx 110 ft to 4 ft below MLW offshore of proposed bulkheads and
resultant 250 cu yds of spoil to be placed upland in Fordham Canal off Gull
Pond, Green~ort. Permit number should be displayed On front bulkhead. Vote
of Board: Ayes: Messrs. St outenbur~h, Kujawski, Smith, Be dnoski, DiVe llo.
On motion made by Mr. Bednoski, seconded by Mr. Smith, it was
RESOI~ED to recommend to the Southold Town Board approval of wetland
application #Il0 of Frederick Raymes as per above application. Vote of
Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Kujawski, seconded by Mr. DiVello, it was
RESOLVED to table the applications of George Sabino- and Frederick Gagen to
place moorings in Gull Pond, Greenport, until Mr. Mandel clears up with the
To~vn Attorney jurisdiction in Gull Pond. Vote of. Board: Ayes: Messrs.
Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Smith, seconded by Mr. DiVello, it was
RESOLVED to table the application of James Bitses as the Trustees objected
that the bulkhead went through a healthy .viable marsh. Mr. Bimses will
re-submit a permit for a retaining wall in back of the marsh. Vote of
Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski~ DiVello.
On motion made by Mr. DiVello, seconded by Mr. Kujawski, it was
RESOLVED to approve the application of Richard Cappello to place a 50 lb
mushroom mooring and a 20 lb chain in East Creek, Cutchogue, providing the
boat does not swing into the channel or interfere with other boats. Vote
of Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Smith, seconded by Mr. DiVe!lo, it was
RESOLVED to recommend to the Southo.ld Town Board approval of the wetlands
application #tll of The Lagoon Association to maintenance dredge an
irregular shaped area within The Lagoon to depth 4 ft below MLW and place
approximately 14,000 cu yds of spoil on beach north of bu!kheaded canal as
nourishment. No spoil to be placed on private property. Vote of Board:
Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Stoutenburgh~ seconded by Mr. Kujawski, it was
RESOLVED to table the application of Pierre Wagner to ~lace a mooring in
Mattituck Creek until the Trustees research the area ~ see how many boats
are moored in this area. Vote of Board: Ayes: Messrs. Stoutenburgh,
Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Kujawski, ~seconded by Mr. Bednoski, it was
RESOLVED that all structures older than ten years will be granted a
grandfather's clause which merely requires the applicant to file an
application and pay a $5.00 filing fee. Ail structures after January 1, 197
to the present shall pay the standard fee required for all such structures.

The above grandfather clause was implemented to facilitate an orderly
inventory of the Town's waters. All structures (docks, bulkheads, etc.)
shall comply with the Trustees regulations of being approved and a permit
issued.
On motion made by. Mr. Kujawski, seconded by Mr. Smith, it w~s
RESOLVED to issue to Lawrence Brani~an a grandfather permit for a dock as
submitted in his application. Vote of Board: Ayes.: Messrs. Stoutenburgh,
Kujawski, Smith, B~dnoski, DiVello.
On motion made by Mr. Stoutenburgh, seconded by Mr. tfujawski, it was
RESOLVED to table the application of Phil Marco to construct a dock, ramp,
and floating dock in Little Creek, Peconic, for further review. Bay
Constable Tom Czelatka will take the Trustees, Mr. William Peters and
Mr. Marco or his representative out at low tide to take the depth of the
water. Vote of Board: Ayes: Messrs. Stoutenbur~h, Kujawski, Smith,
Bednoski, DiVello.
Charles Wittmer asked to take over Antone Kru~ski's mooring permit in
Richmond Creek, stating Mr. Krupski no longer wanted it. Mr. Wittmer will
have to bring in a letter from Mr. Krupski"releasing the permit.

RESOL~TED to table until the next meetin~ the request of Marvin and
Sarah Rauch to obtain title To the creek a~jacent to their property so the
Trustees can review and visit the area. Vote of Board: Ayes: Messrs.
Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Kujawski, seconded by Mr. Smith, it was
RESOLVED to issue ~o J. Edwi, n Dinner a grandfather permit for a dock as
submitted in his application. Vote of Board: Ayes: _~essrs. Stoutenburgh,

RESOLVED to adopt the insurance form as submitted by Town Attorney Tasker
on any major projects the Trustees consider necessary. Vote of Board:
Ayes: Messrs. Stoute~burgh, Kujawskl, Smith, Bednoski,-DiVello.
A letter was received from Donald Bin~ham, Subdistrict Chief, U. S. Dept.
of the Interior, Geological Survey, stating he will be happy to discuss
the problem of guidelines for dredging with the Trustees. Mr. Stoutenburgh
is to follow up on this.
In regard to the letter from John Yickham concerning eel ~rass, Mr.
Stoutenbur~h reported he s~oke to Jerry Churchill from Adelohi exotaining
the Trustees interest in t~e transplanting of eel gras.s. Mr. Churchill ~
will be in touch by letter gs to the poss~bilities"and ramifications of
such a projecm.
There being no further business ~o come before the Board, Mr. Kujawski
made a motion, seconded by Mr. Bednoski and carried to adjourn. Meeting
adjourned at 10:00
