Project Description: To conduct construction activity in the area beyond 75'
landward of the wetland boundary for the construction of a single-family dwelling
located 105' from the wetland boundary, to hand-trim a 4' wide access path down
to the water, and maintain a 50' non-disturbance buffer.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
survey stamped approved on December 14, 2007 by the Board of Trustees.
Conditions: A line of staked haybales and silt fence shall be installed along the
landward edge of the 75' construction access line at commencement of the
activities and remain in place until project is completed.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

Dear Mrs. Russell:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft Corwin
dated November 28, 2007 and determined the proposed construction of a single-family dwelling
and sanitary system to be out of the Wetland jurisdiction under Chapter 275 of the Town
Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff, without further
authorization from the South old Town Board of Trustees pursuant to Chapter 275 and/or
Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions
are taken to prevent any sedimentation or other alteration or disturbance to the ground surface
or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may
result from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your
project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

GENERAL CONOmONS
General Condltton 1: Facility InspectIOn by the Oepartment
The permitted site orfecility. including relevant records. is subject to inspection at reasonable hours and intervels
by an autllO~d representative of the Department of Environmental Conservetlon (the Department) to determine
whether the permittee is complying with this permit and the EeL. Such representative may order the work suspanded
pursuant to ECL 71-0301 end $APA401(3).
The permittee shall provide II person to accompeny the Departmenfs representative during an Inspection to the
permit ,rea when requested by the Department.
A copy of this permit. including all reterenoeo maps. drewtngs and special conditions, must be available for
inspection by the Department at all times at the project site or facility. Failure 10 produce e copy of the permit upon
request by a Department representative IS a violation of this permit.
General Condition 2: Relat\Onshlp of this Permit to Other Department OrdeB and Oetermlnatlons
UnleSS expressly provided for by the Department. Issuance of tllls permit does not modify, supersede or rescind
any order or determination previOusly iSllued by tlle Depertment or any of tlle termS, conditions or requirements
contained In such order or determination.
General Condition 3: Applications fOr Permit Renewala or Modifications
The parmlttee must submit a separate written eppllcatlon to the Department fOr renewal, modiflcetlon or trensfer
of this permit. Such application must Include any forms or supplemental Information the Depertment requires. Any
renewal, modification or trensfer g....nted by the Department must be In writing. .
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits fOr Stete pollutant OlllCharge eliminatIOn syvtem (SPOES).
Hazardous Waste Management Facilities (HWMF), major Air pollution Control (APC) and Solid Waste
Menegement Facllities (SWMF); and
b) 30 days before expiration of all otller permit types.
Submission of appllcetlons fOr permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the oepartment
The Department reserves the l'Ight to modify, suspend or revoke this permit. The groundll fOr modification,
suspension or revocetlon Include:
a) tlle scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the EeL and pertinent regulationS is fOuno;
b) the permit was obtained by misrepresentation or failure 10 disclose relevent facts;
c) neW material information Is diSCovered; or
0) environmental conditions. relevant technology. or applicable law or regulation have materially
chengeo since the permit waS issuad.

1. If future operations by the State of New York require an alteration In the position of the structUre or work herein
authorized. or if. In the opinion of the Oepartment of Environmental Conservation It shall caU68 unreasonable
obsttUctlon to the free navigation of said wete~ or flood flows or endanger the heelth, safety or welfare of the
people of the State. or cause loss or destruction of the netural resources of the State. the owner may be ordered
by the Department to remove or alter the structural work. obstructions. or hazards caused thereby without expense
to the Slate. and If, upon the expiration or revocation of this permit. the sirUcture. fill. excavation. or other
modification of the watercourse hereby aulhorlZed shall not be completed. the owners. shall. wlthout expense to
the State. end to such extent and in such time and menneras the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structUre or 1111 and restore to Its former condition the
navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on
ecoount of any such removal or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the 6lrUctUre or work herein
authorized which may be caused by or result from future operations undertaken by the Slate for the conservation
or improvement of navigation. or for other purposes. and no claim or right to compensation 8hell accrue from any
such demage.
3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission.
consent or approval f1'OIT1 the U.S. ArmY Corps of Engineers, U.S. eoast Guard. New York Slate Office of Generel
Services or local government which may be required.
4. All necassary precautions shall be taken to preclude contamlnetion of any wetlend or weterW8Y by suspended
solids, sediments. fuels, solvents, lubricants. epoxy coatings. paints. concrete, leachate or any other
environmentally deleterious materials assoCIa~d with the project.
5. MY material dredged In the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holee that may heve a tendency to ceuse
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authoOzed.
7. If upon the expiration or revocation of this permit, the project hereby authort%ed hes not been completed, the
eppllcant shall, without expense to the State, and to such extent and In such time and manner as the Depertment
of Environmental Conservation may require, remove all or any portion of the uncompleted sirUctl.lrIl or fill and
restore the lite to Its former condition. No claim shell be made egalnst the State of New York on account of eny
such removal or alteration.
8. If granted under llNYCRR Part 608. the NYS Department of environmental Conservation hereby certifies that the
subject project will nol contravene effluent limitations or other limitations or standards under SectIOns 301, S02.
303. 306 end 307 of the Clean Water Al;t of 1971 (PL 95-217) provided that all of the conditions listed herein are
met.
9. AI least 48 hours prior to commencement of the project. the permittee and contraCtor ahall sign and return the top
portion of the enclosed notlltcetlon form cartlfylng that they are fully awere of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bOttom portion of the form must elso be
signed and retumed. along with photographS of the completed work and. if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plana submitted by the
applicant or his agent es part of the permit application.

SPECIAL CONPmONS
1. Durlng construction. concrete or leachate shall not esl:8P8 or be dischargeo. nor shall washings from transit mix
trucks. mixe~, or otner devices enter tidal wetlands and or protecteo buffer areas.

2. Any debrts or excess meterlal from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris 15 pI!IITTIitted in tidal we~ands and or
plOlaGled buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
ac;tlvity.
4. All areaS of soil disturbance resulting from this projec;t shall be stabilized Immediately following project completion
or prior to permit expiration. whichever comas first. The spproved methodologies are as follOWll:
a. Stebllizatlon of the entire disturbed area with appropriate vegetation (grasses. etc.).
b. Stabilized 8S per specifications identified on approveo plans.
c. Temporarily stebllized with straw or hay mulch or jute matting or other similar natural fiber matting wtthln 1 week
of final grading. Temporary lllabilizatlon shall be maintained until a mature vegetative cover Is established.
v 5. The storage of construction equipment and materials shall be confined to within the projac;t work site and or upland
areas greater than 75 linear feel from the tidal we~and boundary.

6. All disturbed l!raas where soil will be temporarily exposed or stockpiled for longer than one (1) week ahall be
contalneo by a con~nuous line of steked hay balea/sllt curtain (or other NYSOeC approved method) placed on the
_ward sid. between the fill and wettand or protected buffer area. Tarpa are aulhol'lzld to supplement these
approved methods.
If seeding is Impracllcable due to the time of year, a temporary mulch must be applied and final seeding performed
at the earliest opportUnity when weather conditions favor germination and growth. but not more than six months after
projac;t completion.
7. To protact the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall
be no disturbance to the na\Ural vegetation or topography within an area extending 50 linear feet landward of lhe tidal
wetland boundary.
B. A row of steked hay biles or approvable erosion control devtces shall be placed at the IlInmvard edge of the buffer
area lit commencement of regulated actlvRllIS snd remain In place until project Is completed and all disturbeQ ereas
stabilized with vegetation.
9. Roof runoff shall be directed to drywells a minimum of Feet Il!lndwerd of the tidal watland boundary forlmmedl8ta
on-site recharge.
10. Driveways and parking arees shall be constructed of pervious milterial.
11. Roads, driveways. and/or pel1<lng areas shall be graded to direct runoff away from tldel wetlands and protected
buffer areas.
12. Sanitary system (bottom of tank and leaohlng pools) shall be located a minimum of 2' above seasonal high
groundwater.
13. No 1111 Is authorized.

MARLON AND KIM RUSSELL request a Wetland Permit clear lot 100' to 70' from the
wetlands and maintain a 25' non disturbance buffer. Located: Long Creek Dr., Southold.

Please note: Hashamomuck Pond is a New York State impaired waterbody. The known
pollutant is pathogens and the known contributing source is urban runoff. In addition, the
pond is a NYSDEC designated Critical Environmental Area and a NYS DOS Significant
Coastal Fish and Wildlife Habitat. The 200+ habitat acres oflocal, state wide, and
regional significance support osprey, hawks, diamondback terrapin, bay scallops, and
hard clams, several finfish and a large array of nesting birds. Severalland/habitat
preservation and wetland restoration projects have been undertaken in the watershed, but
point and nonpoint sources of pollution need to be reduced or eliminated to enhance the
habitat for shellfish, fish, and wildlife species.
The proposed clearing and buffer have been reviewed to Chapter 268, Waterfront
Consistency Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (L WRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is
INCONSISTENT with the LWRP.

Policy 6 Protect and restore the qnality and fnnction of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other
lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set
forth in Trustee permit conditions.
The distance from the proposed landward end of the non disturbance buffer
to the wetland boundary is 25 feet; a minimum setback distance of 50 feet is
required pursuant to Chapter 275-3.D.l.a.6. Findings; purpose; jurisdiction;
setbacks. Please require that the applicant amend the application to meet the
above policy to the greatest extent practical.
If the action is approved the following best management practices (BMP's) are
recommended:
1. Maximize the non disturbance buffer to a minimum of70' landward of the
wetland line. The width would support the buffer located on the property
to the west. See photo below.
The BMP's will further Policies 5, Protect and improve water quality in the Town of
Southold and 6.3 Protect and restore tidal and freshwater wetlands, item D (below).
D. Provide adequate buffers between wetlands and adjacent or nearby uses and
activities in order to ensure protection of the wetland's character, quality,
values, and functions.
