DECLARATION OF COVENANTS AND RESTRICTIONS

DECLARATION, made the {7i(P ~ day of July, 1999, by
RICHARD REINHARDT, residing at noff Main Road, P.O. Box 603,
Laurel, N.Y., referred to as the Declarant.
WHEREAS, the Declarant is the owner of certain real
property situate at Alvah's Lane, Cutchogue, Town of
Southold, County of Suffolk and State of New York, more
particularly bounded and described as set fOTth in Schedule
"A" annexed hereto, and
WHEREAS, the Declarant has made application to the
Planning Board of the Town of Southold for approval to
subdivide the said real property into three (3) parcels in a
subdivision known as Subdivision Plat for Richard Reinhardt,
and
WHEREAS, for and in consideration of the granting of
subdivision approval, the Planning Board of the Town of
Southold has deemed it to be in the best interests of the
Town of Southold and the owner and prospective owners of
said parcels that the scenic vistas from Alvah's Lane be
maintained, and as a condition of said approval, the
Planning Board has required that the within Declaration be
recorded in the Suffolk County Clerk's Office, and
WHEREAS, the Declarant has considered the foregoing and
determin~d that the same will be for the best interest of
the Declarant and subsequent owners of said parcels.
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
That the Declarant, for the purposes of carrying out
the intentions above expressed, does hereby make known,
admit, publish, covenant and agree that the said premises
herein described shall hereafter be subject to the following
covenant which shall run with the land and shall be binding
upon all purchasers and holders of said premises, their
heirs, executors, legal representatives, distributees,
successors and assigns, to wit:
1. DECLARANT agrees and consents that there shall be
no visual obstruction (including but not limited to a solid
fence, hedge or trees) erected along the Alvah's Lane
frontage described in the following course in Schedule A
attached hereto:
Along the easterly side of Alvah's Lane North 47
degrees 35 minutes 51 seconds West 730.24 feet to land now
or formerly of Best.
2. The owners of each building lot shall be
responsible for construction of driveway and apron from the
boundary line of the lot across the Town of Southold road
way (or right of way) to the paved road. The owners of Lots
2 and 3 shall construct and maintain driveways which do not
conduct runoff generated by new site improvements on such
lot onto the existing Town roadway, or shall install
drainage on such lot as necessary to prevent such runoff.
Installation of such driveways, aprons/or and drainage shall
not be the responsibility of the Town of Southold.

3. Prior to issuance of a building permit for
construction on Lot 2 or Lot 3, Declarant will install a
fire well on or near Bridle Lane as required by the Planning
Board, or obtain a waiver of same from the Planning Board or
the Commissioners of the Cutchogue Fire District.
4. These covenants and restrictions can be modified
only at the request of the then owner of Lot 1 with the
approval of a majority of the Planning Board of the Town of

Southold after a public hearing. Property owners of other
lots in the subdivision shall be entitled to notice of such
public hearing but their consent to such modification shall
not be required.

All that certain plot, piece or parcel of land, situate, lying and
being at Cutchogue, Town of Southold, Suffolk, New York, bounded
and described as follows:
Beginning at a monument on the easterly side of Alvah's Lane,
on the dividing line between the subject premises and land now or
formerly of Lademann; from said point of beginning
Running thence along land of Lademann and land of now or
formerly of Long Island Vineyards, Inc. North 42 degrees 49' 59"
East 222.26 feet;
Running thence along land now or formerly of Long Island
Vineyards, Inc. (1) North 42 degrees 58' 39" East 525.03 feet to a
monument; and (2) South 47 degrees 56' 51" East 1068.74 feet;
Running thence along Map of Highland Estates subdivision
South 46 degrees 41' 11" East 359.36 feet to a monument;
Running thence along lands now or formerly of Kaloski (1)
South 07 degrees 31' 49" West 394.88 feet to a monument (2) North
49 degrees 23' 31" West 706.98 feet to an iron rod; and (3) South
48 degrees 35' 19" West 407.28 feet to the easterly side of
Alvah's Lane;
Running thence along the easterly side of Alvah's Lane North
47 degrees 35' 51" West 730.24 feet to lands of Best;
Running thence along lands of Best (1) North 42 degrees 24'
