WHEREAS, the Board of Commissioners of the Cutchogue-New Suffolk Park
District has duly petitioned this Town Board, pursuant to Chapter 763 of
the Laws of 1960, to calLa public hearing on the question of authorizing,
on behalf of said District, the acquisition of the real property herein-
after described, and the construction thereon of a building for use as
a comfort station and the acquisition of miscellaneous equipment for
use in connection with a bathing beach including an aluminum boat and a
life guard stand; and
WHEREAS, it is now desired to call said public hearing, now, therefore,
be it
RESOLVED: by the Town Board of the Town of Southold, Suffolk County, New r
York, as follows: l
Section 1. A meeting of the Town Board of the Town
of Southold, Suffolk County, New York, shall be held at Cutchogue School
West, Depot Lane, Cutchogue, New York, in said Town, on the 12th day of
June, 1969, at 7:00 o'clock P;M., Eastern Daylight Saving Time, to conduct
a public hearing for the purpose described in the preambles hereof, at
which time and place all persons interested in the subject matter there-
of will be heard.
Section 2. The Town Clerk is hereby author ized and .~
directed to cause a notice of said public hearing to be published in the
Suffolk Weekly Times, the official newspaper, and posted within said Park
District in the manner and within the time prescribed by Section 193
of the Town Law. Such notice shall be in substantially the following form:

be authorized to advertise for bids and to purchase from the lowest
responsible bidder, the following items, more or less, as needed:-
20,000 lin. feet of snow fence with pickets l~ x ~ inches,
spaced 2 inches apart, 4 feet high stained red, with five
(5) double strands of l2~ gauge galvanized wire, in 100 lin.
foot rolls.

RESOLVED: That Chester Melot, Mattituck, N.Y. be and he hereby is
appointed Attendance Officer, subject to the written approval of the
District Superintendent of Schools, throughout the Town, except such
schools as are otherwise provided for by Section 3213 of the Education
Law, and be it further
RESOLVED: That such attendance officer shall be removable at the
pleasure of the District Superintendent of Schools, and be it further
RESOLVED: That the compensation of such attendance officer be fixed
at $1200.00 per year, payable in regular monthly installments, he to
pay his own expenses, and be it further
RESOLVED: That the Town Clerk be and he hereby is instructed to notify
Chester Melot and the District Superintendent of Schools of the
appointment.

WHEREAS, the Senior Citizens, Southold Town, request the use of four
(4) buses for transportation to Natuee's Gardens, up the Husson,
NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold furnish
transportation for the Senior Citizens as requested.

Moved by Councilman Valentine; seconded by Councilman Demarest;
WHEREAS, the Town of Southold, in order to provide for a planning study
contributing to an overall program for its future community, desires
to participate in the federal-state Urban Planning Assistance Program
as authorized by Section 701 of the Housing Act of 1954, as amended,
and Article 19-k of the New York State Executive Law, and
WHEREAS, the New York State Office of Planning Coordination, under
authority of Article 10-k of the New York State Executive Law, is"
the official state agency designated to administer state funds under
the provisions of Section 701 of the Housing Act of 1954, as amended,
now, therefore be it
RESOLVED: That the Town Board of the Town of Southold hereby requests
the New York State Office of Planning Coordination to provide planning
assistance under authority of Article 19-k of the New York State
Executive Law, with such financial assistance as may be provided by the
united States Department of Housing and Urban Development, under author-
ity of Section 701 of the Housing Act of 1954, as amended, and Article
19-k of the New York State Executive Law. Such planning assistance
is more particularly described in the project application attached hereto

and made a part of this resolution as if fully set forth herein.
RESOLVED, that if the aforesaid application is approved and accepted by
both the Director of the New York State Office of Planning Coordination
and the Department of Housing and Urban Development, the Southold Town
Planning Board shall enter into a formal agreement with the New York
State Office of Planning Coordination to undertake the project described
in the approved application and to pay to the State of New York its
share of the estimated total cost of the said project, together with
such other terms and conditions as may be deemed necessary and appropri-
ate to carry out the said project.
RESOLVED: That the Southold Town Planning Board hereby agrees to have
available, in the year the project is to be completed, the sum of
$367.00 dollars, or so much thereof as may be mecessary to contribute
a sum not to exceed 16 2/3 per centum (16 2/3$)of the total cost of said
project, to be paid to the State of New York, on condition that the
above-mentioned application is approved by both the Department of Hous-
ing and Urban Development and the Director of the New York State Office
of Planning Coordination.
RESOLVED: that the Planning Board shall assume the costs of operating

and maintaining its own planning board or commission including such
services as clerical, personnel; office space, equipment, materials,
communication and travel, as such costs cannot be charged to the Urban
Planning Assistance Program.
RESOLVED: That it is understood that current planning services may not
be charged to the Urban Planning Sssistance Program.
RESOLVED: That the Chairman of Planning Board of the Town of Southold
be and hereby is authorized and empowered to execute in the name of the
Town of Southold all necessary applications, contracts and agreements
to implement and carry out the purposes specified in this resolution.

WHEREAS, the petition of Frank Murphy, Mattituck, ~,Y. and Stephen
Joroski, Southold, for a change of zone from "A" Residentill and Agric-
ultural District to "B" Business District have been sent to the Planning
Board for their recommendation and report, and
IlliEREAS, it is required to send all property within 500 feet of County
Roads or property to the Suffolk County Planning Board,
JOW, TEEREFORE, BE IT RESOLVED: That these petitions be sentto the Suffolk

WHEREAS, a petition was received from Abe Goldrich requesting a change
of zone of certain property on Middle Road, Southold, N.Y. described in
said petition from "A" Residential and Agricultural District to "B"
Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he hereby is directed to transmit this application to
the Planning Board in accordance with Section 901, Subdivision C of
Article IX of the Building Zone Ordinance of the Town of Southold.

WHEREAS, Stephenson Beach Inc. is the owner of real property at Orient
and East Marion, New York, consisting of a beach fronting on Long Island
Sound and meadow and wetlands fronting on Orient Harbor, and
WHEREAS, a meeting of the stockholders of Stephenson Beach, Inc. was
held on July 27, 1969, at which time the following resolution was adopt-
ed, to wit:-
"RESOLVED, that the Officers of the Corporation ate hereby
authorized and directed to take such action as may be appropriate to
arrange for all or substantially all of the real property owned by
this corporation, or all of the stock of this Corporation, to be given
to a new park district to be created for the Orient-East Marion area,

RESOLUTION AUTHORIZING CONTINUING PLANNING ASSISTANCE
PROJECT GRANT AGREEMENT WITH NEW YORK STATE OFFICE OF
PLANNING COORDINATION
WHEREAS, the Town of Southold has heretofore applied to the New York
State Office of Planning Coordination for Federal and State aid in
a continuing planning assistance project under the provisions of the
Federal Housing Act of 1954, as amended, and Section 548 of the Exec-
utive Law of the State of New York, and such application is being
processed for approval' and acceptance by the Department of Housing
and Urban Development and the Office of Planning Coordination of
the State of New York, and
WHEREAS, in order to secure the benefits of said continuing planning
assistance program it is necessary for the Town of Southold to contrib-
ute a sum not to exceed seventeen per centum (17%) of the total cost
and to enter into a Project Grant Agreement with the New York State
Office of Planning Coordinaation, now be it
RESOLVED, that the Town of Southold hereby agrees to have available.
in the year 1970, the sum of Three Hundred and Sixty-seven Dollars
($367.00) or so much thereof as may be necessary to contribute a sum
not to exceed seventeen per centum (17%) of the total cost of said
Project, to be paid to the State of New York, on condition that the
above-mentioned application is approved by both the Department of
Housing and Urban Development and the Director of the Office of
Planning Coordination of the State of New York, and be it further
RESOLVED: That the Supervisor be and hereby is authorized and directed
to execute on behalf of the Town of Southold the project Grant Agreement
to carry the foregoing into effect.

WHEREAS, Southold Town Planning Board has prepared an official report
and recommendation and the County Planning Board has been notified and
has no objections on the application of Frank Murphy, Mattituck, N.Y.
and Stephen Doroski, Southold, N.Y. for a change of zone from "A"
Residential and Agricultural District to "B" Business District,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the Southold Town Board at the Supervisor's Office, 16 South Street,
Greenport, N.Y. on Tuesday, September 9, 1969, at 9:30 P.M. on the
above mentioned petitions and that the Town Clerk be and he hereby is
authorized and directed to cause notice of said hearing to be published
in the Suffolk Weekly Times, pursuant to the requirements of law.

NEW YORK, ADOPTED NOVEMBER 5, 1970, AUTHORIZING THE ISSUANCE
OF A $6,000 NOTE IN ANTICIPATION OF THE SALE OF SERIAL
BONDS OF THE TOWN HRETOFORE AUTHORIZED TO BE ISSUED FOR
IMPROVEMENT OF TOWN ROADS, IN SAID TOWN.
RESOLVED by THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, AS FOLLOWS:
Section 1. A bond anticipation note of the Town of
Southold (herein called "Town"), in the County of Suffolk, New York,
in the principal amount of $6,000 is hereby authorized to be issued
pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York
(herein called "Law"), for the specific object or purpose, as more
fully described by the resolution entitled:
"Bond Resolution of the Town of Southold, New York,
adopted October 6, 1970, appropriating $6,000 for the improvement J

bonds and the Note hereby authorized is not a renewal Note. The period
of maturity of the Note hereby authorized shall not exceed one year
from date, and said Note may be renewed pursuant to the provi~ions of
the Law. Said Note is to be issued in anticipation of bonds for a non

Town Clerk and Deputy Registrar, Town of Southold, to have such powers
and perform such duties as the Town Clerk and the Registrar.

RESOLVED: That Supervisor Albert Martocchia be and he hereby is authorized
to sign a wage contract between CSEA and the Town of Southold as amended
by the Town Attorney and agreed upon by the CSEA and the Town of Southold.

Moved by Justice Suter; seconded by Justice Demarest;
WHEREAS, the late T. Carl Moore of East Marion has served the Town of
Southold and its residents in a very important function as an Eastern
Long Island Hospital Trustee for 26 years, and
WHEREAS, during his many years of unselfish and dedicated service to
our local voluntary non-profit health facility he aided in the growth
and fine reputation of our hospital, and
WHEREAS, by his untiring efforts as vice president of the Eastern'
Long Island Hospital Association for 5 years and its President for
10 years, T. Carl Moore contributed so much to our public good because
of his work and dedication to our local hospital, and
WHEREAS, the So~thold Town Board wishes to record the sincere apprec-
iation of its members on behalf of the Town of Southold and its
residents for the devotion and interest T. Carl Moore gave to our
community by giving so much time and ability in order for the public
to have such a fine howpital, therefore,
IT IS ORDERED that a Resolution of sympathy be adopted by the Southold
Town Board at a meeting held on January 5, 1971 on the loss of T. Carl
K00re and that his widow and family be advised of this resolution as
adopted.

.1rs. Tiedke, Edward Latham, Irving Latham and Lloyd Terry appeared before
the Town Board and discussed the Master Plan at great length. Town Attorney
Tasker discussed the plan with them.
Attorney Richard Lark requested the Town Board to defer any public hearing
on the property of Anna Hansen, Mattituck, New York, until such time as
an Amended Petition can be submitted.

Edward Latham, Robert Douglass, a group of men~from the Business Men's
Association, Mrs. Tiedke from the League of Women Voters and others
were present at the Board meeting requesting more information on the
proposed Master Plan, Wetlands, etc. Town Attorney Tasker and the
Town Board explained to them that the Master Plan was not complete,
nor was the map accompanying the Master Plan and that as soon as it was
available it would be placed before the public for discussion.

ed by the Southold Town Planning Board for roads and improvements in the

offices of assessor of the Town of Southold shall continue to be elective

appeared to request the Town approve of raising the benefits in taxes
for Senior Citizens from $3000 to $5,000 as the State and County have done.
Irving Latham, Orient, N.Y. requested that the map and text on the Master
Plan be made available to the public. The Supervisor assured him they
would be available very soon.
Edward Latham reported that he was not happy with the Master Plan in
relation to the wetlands.

The Southold Town Board received a letter from Rodney W. King
thanking Patrolman Fiedler for his professional actions, care,
thoughtfulness, decisiveness, caution, c.alertness, courtesy and
capable driving ability during an emergency situation involving
Mr. King. Mr. King also wrote Chief Cataldo thanking him for the
fine performance and team effort displayed by his men.
A letter was received and read from Chief Cataldo to Patrolman
Henry Stepnoski thanking him for the time he recently spent helping
local Boy Scouts qualify for the fingerprint merit badge, as a~l
of Patrolman Stepnoski's time spent in preparation and teaching was
his off duty hours.
Supervisor Martocchia read a letter from Commissioner John L. Barry
to Chief Cataldo, commending the excellent police work and willing-
ness to aid a neighboring police department displayed by Detective
Sergeant Joseph Sawicki, which lead to llfelony arrests with a total
of 17 narcotics cases being made.

WHEREAS,Sophie Saunders applied to the Town Board for a single
trailer renewal permit dated April 5, 1972,

Mr. David Driscoll, Southold, inquired as to the location of
the proposed launching ramp at Eastern Shores, and who made thr
proposal. Supervisor Martocchia advised that he made the
proposal approximately two years ago, and stated that it will
be a county ramp on property Suffolk County purchased approximately
three years ago. The county has received a petition containing
about 700 names requesting this ramp. The Town Board also is
in favor of this ramp as it will aid in the efficient operation
of the town police boat. It is anticipated the construction
of this ramp will not commence for about two years; however,
it has been appropriated in the Suffolk County Capital Budget.
Mr. Driscoll inquired about the status of his proposal at the
June 24th Town Board meeting relative to a series of informatiOnj
meetings to enlighten the public on the matter of the text for
the Southold Town Development Plan. Supervisor Martocchia
stated that he has discussed the matter with John Wickham, Chair-
man of the Southold Town Planning Board and Mr. Wickham advised
that the material is presently available to be put into text
form, most of which has been adopted by ordinance. The Board
can see no reason for further information meetings, which have
been held many times in the past. The text will shortly be
incorporated into a booklet form, including the map.
Mr. Driscoll complimented the prompt service of the police
department regarding a complaint he made about fireworks over
the 4th of July weekend. He asked how many fines, if any, were
levied against violators of the law, which the chief of police
was quoted in the Suffolk Times as being prepared to enforce.
Justice Demarest and Justice Suter both advised they had no
calls, but something may come forth in their Justice Court.
They prefer to avoid previous knowledge of such incidents, as
they must sit in judgment on the case when it comes before them.
Further discussion was held relative to who may be charged,
how the charges can be made, and what type of charges would be
brought against fireworks violators. Mr. Driscoll then stated
that on the evening of July 3rd over $2,800.00 in damages were
done by fire crackers or bombs on the North Road in Greenport,
at which time the Southold Police and the Greenport Fire Depart- J
ment were called. He feels the Police Committee should receive
reports and investigate such incidents. Each member of the
Town Board stated that they had no knowledge of such an incident.
Mr. Driscoll refused to cite the exact incident he referred to.
Mrs. Gladys Csajko, Greenport, asked for the status on the dog
pound. Supervisor Martocchia advised that the first unit
arrived today (July 8), but a definite completion date cannot
be set at this point as the final two units have not arrived.

Reports continued:
17. Justice Suter reported a request of the Mattituck Park
District to meet with the highway committee and highway superintendent
regarding a parking area at Wickham Avenue.
18. Justice Demarest reported that at the direction of the Town
Board he met with the Oyster Pond's School Board relative to the problem
at the school crossing. They basically settled on a solution that the
speed limit sign to the west of Village Lane where the school crossing is,
be extended some 300 or 400 feet to the west and school crossing signs be
put up the proper distance either side of the school crossing, and if
possible road markings be painted on the rOad. The school crossing is
fairly close to a curve and sometimes motorists fail to observe the
speed limit as they should.
On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that Highway Superintendent Dean contact the New York State
Traffic Safety Department to determine whether the speed limit sign
to the west of Village Lane, Orient, where the school crossing is,
can be extended 300 to 400 ft. to the west; and school crossing signs
be put up the proper distance either side of the school crossing,
and possible markings be painted on the road.

Mr. David Driscoll asked if a decision has been handed down on the
Norris case. Supervisor Martocchia stated he had received the decision
this date but has not read it.---Town Attorney Tasker stated the"
court found in favor of the Town, that basically the rezoning was
pursuant to the comprehensive plan of the Town of Southold. The
decision is 21 pages long.---Mr. Charles Meyer asked what is the
comprehensive plan of the Town of Southold; does it refer to some
master plan?---Town Attorney Tasker stated that in the decision the
judge goes into a discussion of the comprehensive plan.
~I Mr. Driscoll asked about the progress of the planning text Mr. Wickham
~JI is working on.---Supervisor Martocchia stated that the TownJhas the
complete text of the developmentjplan, and Planning Board secretary
Muriel Brush is putting it in propertform.---Mrs. Mabel Lytle
further questioned the title of the "comprehensive or development
plan", as did Mr. Charles Meyer;--he asked if there is something
available in words guiding the future of Southold Town.---Supervisor
Martocchia stated he should go to the Planning Board office in Southold
and he will be provided with such material.
Mrs. Lorraine Terry complimented Supervisor Martocchia on handlmgg the
Fishers Island emergency situation by obtaining the much needed boat.
Considerable discussion was held while briefly examining the ~indings
of the court in the Norris case.

A taxpayer addressed the Board stating he is a permanent resident
attending his first town board meeting. He has enjoyed the meeting
and will come again, however, he understands that at a town meeting
no smoking is allowed; it is hazardous to his health and the smoker.
Couldn't something be done about prohibiting smoking at the meeting?
Justice Suter stated that the smokers are in violation, and if he
would sign a complaint before one of the town justices, something
will be done.
The subject of the dog pound was brought up/ Supervisor Martocchia
stated progress is being made but there are still problems to be
solved. At present the cages do not meet the specifications and must
be corrected.---Mr. Meyer asked if there is not a penalty clause or
final date for this project.--Supervisor Martocchia stated that tor
such a small project amounting to about $25,000.00 it is unrealistic
to put in a penalty clause. The contractor has not been completely
paid and will not until everything is up to specifications.

Mr. Graham also asked if a date has been set for the Southold Senior

Mrs. Gladys Csajko asked about the land purchased by the State at
Laurel Lake, won't the situation be worse than in previous years
when the police were called down there so frequently?---Supervisor
Martocchia stated it will be worse.---Mrs. Csajko asked if there
is any truth to the story the land was offered to the Town first?---
Supervisor Martocchia stated it was not offered to the Town.---
Justice Suter said that several years ago there was talk about it
and it was looked at, but nothing came of it at the time.
Mrs. Csajko asked when the Master Plan is coming out in booklet form?---
Supervisor Martocchia said the Planning Board Secretary, Muriel Bursh
has been putting it together, but he does not know what the status
is at this time. Mr. Martocchia will look into it.
Mrs. Csajko asked if any decision has been made on the various
suggestions submitted relative to the pound?---Supervisor Martocchia
said he is planning to meet with both wardens tomorrow. He has
read Mrs. Csajko's report twice and there are several points that
must be resolved and items that must be looked into. One of the
department heads was asked to set up guidelines for the pound.
The reports of Dr. Zitek, and dog wardens and Town Clerk do not mesh,
and must be studied. There will be some corrections.---Mrs. Csajko
suggested at the last meeting, that items be put into the paper for
dogs to be adopted,' and would like to see that followed through. It
would be much easier to drop a note at the newspapers rather than
just killing the dogs after the prescribed time.
Mrs. Csajko asked why the highway amendment is being proposed?---
Supervisor Martocchia explained that in the event someone breaks a
spring on a car or run over something, the individual can sue. This
amendment says that the Town must be notified of such a defect, and
it it is not corrected the town is liable. Of course, the town can
be sued anytime, but if they are not notified-in advance the law
suit would not be as effective.

11. More correspondence has been received relative to the
cut-back by the State of New York on snow removal on Route 25. The
Town has exhausted most of their contaats , including the County, who
will not enter into a contract with the State of New York, as Suffolk
County must go into loans to pay contracts to remove snow. The only
con~raat the State of New York signed is with Shelter Island Highway
Department. The Town is still trying to get snow fencing and to keep
the local contractors, but the State has just about made up their mind
to buy new equipment and store two pieces of equipment in Greenport
and one in Riverhead. This is going to be a problem as the only service
the State has in in Riverhead, and there is no backup equipment. The
Yown will try to keep up with what the State can't handle, but there
are many Town roads to look after. A letter has been received from
the Orient Fire Department written to Givenor Carey asking that the
problem be rectified.
12. Notification has been received that in the matter of Patrolman
Crimi vs. the Town of Southold, the attorney for Patrolman Crimi has
withdrawn the appeal.
Mr. Hartofelis asked the Board about the application he submitted
at the last meeting for an addition to his snack bar at his tourist
camp in East Marion, requesting a determination.---Supervisor
Martocchia stated it was submitted to the Building Department for
review as far as density is concerned. Mr. Terry's report says
that Mr. Hartofelis would not be increasing the density because
he is requesting a slab with a canopy roof and he has no disagreement
with the application. It is now up to the Town Board. The Board
has not discussed it as yet and will do so after this meeting.

Mr. Weinheimer asked to what extent the new HUD resolution going to
change the requirement of low cost housing?---Supervisor Martocchia
stated that originally HUD wanted to by-pass local zoning. Hud has
indicated they have taken out that stipulation.---Town Attorney Tasker
stated his concern is that it requires unanimous agreement of all members
of the consortium. The basic objection that was raised by most of the
municipalities was the form of the resolution that they required all
municipalities to adopt, which really said that we agree to change our
zoning ordinance without any regard to our master plan in order to
permit low cost housing, and we are bound by State Law which requires
us to rezone according to comprehensive zone and the affects it has
on the community, and we can't agree to give them a blank check to
permit any type of use be located any where in the town, and that is
the objection of all the other towns. Now, they have removed the
reference to zoning ordinances. The question is whether the remaining
towns and vil19ges are agreeable to go along with the new form of
resolution that has been submitted and they do require all of the
municipalities to agree.
Mr. William Pell asked Mr. Tasker where he can get a copy of the master
plan?--- Mr. Tasker stated we already have a master plan. He is not
going to find the master plan in one little document. The masterplan
consists of all of the studies, surveys reports submitted by Raymond
& May consisting of four volumes, study, and report of Malcolm Pirnie,
two studies and report of Cornell, the study and report by Mr. Sullivan
on agriculture, the zoning ordinance of the town and the zoning map of
the town. All of these together constitute the master plan. All of
are filed here in the Town Clerk's office. The Raymond & May master
plan is filed in all of the local libraries, the Malcolm Pirnie study
is also filed in the local libraries. The zoning map is filed here
and the zoning code is in the code book. All of these comprise the
master plan or comprehensive plan or comprehensive plan for future
development or development plan.---Mrs. Csajko stated some of the
things in the matter Mr. Tasker referred to were highly objectionable.
---Mr. Tasker stated that when you hire a planning consultant to do
the study he is hired to make recommendations, we are not required to
accept every single recommendation he makes. A form of zoning code was
proposed by Raymond & May and was rejected out of hand and the town
drafte~ their own. The proposed zoning map proposed by Raymond & May was

not accepted totally, changes were made.---Mrs. Csajko asked Mrs.
Brush prior to this meeting if she could find the original zoning
map that was accepted by the Planning Board by resolution, and on
that map there is a big industrial area near where she lives; on
subsequent maps that disappeared. Mrs. Brush showed here that as the
original map that was accepted.---Mr. Tasker stated that to begin with
the Planning Board does not accept or approve the map, the Town Board
does. Here again, the Planning Board could submit 50 maps that in
the course of the evolution of the plan the maps were constantly
being changed, ultimately the map got to the point that was acceptable
to the Town Board and that is the map that was accepted in 1971 by
the Southold Town Board.---Mrs. Csajko stated Mrs. Neville could 1
only find an adoption by the Planning Board.---Mr. Tasker stated
they could have a map before them and decide to approve it and the
Town Board disapprove it. The adoption of the map by the Town Board
is right in the zoning code on the first page. The zoning ~ap lli
actually signed by members of the Town Board.---Mrs. Csajko stated
she was trying to determine whether the original map was still in
tact and available to look at.---Town Attorney Tasker stated it is,
and each time a change of zone is made the map is updated, but the
original map signed by the Town Board members is retained in its
original state in the Town Clerk's Office.---Mr. Tasker stated that
John Wickham brought to his office a couple of weeks ago a compilation
of every~hing that was encompassed in the process of preparing ana
putting into effect the master plan studies. It is believed the
Board plans to have that printed and circulated so you can read a
summary of what took place and what the various studies were and
what they showed.---Mrs. Csajko stated that they are still not saying
what parts of the reports they are accepting and rejecting.---Mr.
Tasker stated they don't really accept or reject a study You have
a study made f5r the purpose of steering you in the right direction
in the future development of the town. It is called a master plan
or development plan. All of these things combined could be called I
the master plan study. You do not have to actually implement. You
can implement pa~ts of it and refuse to implement other parts of it.---
Mcs.Csajko asked who and how do you de~ide which parts you are going
to impelm~nt?---Mr. Tasker stated that if you looked at the sLudies
and they said we think the whole of Orient should be two acre zoning
and when the map is finally adopted is is one acre, I think you could
conclude 'they .didnot accept the master plan as suggested at two acre
zoning, because they zoned it ODe acre. So you could follow the
studies through and compare the ultimate result in determining whether
they particularly accepted this recommendation or that they didn't.
the Basic change the Town did not accept was the proposed ordinance
that was submitted. The entire ordinance that was in existence before
1971 was redrafted. SOEle of the Raymond & May suggestions were embodied
and others were rejected.---Supervisor Martocchia stated that the study
and summary being prepared by John Wickham will be examined by the
Town Attorney and Town Board and other interested parties and when
the Board feels it is ready it will be printed for distribution.---
Mr. Walter Kohnle asked whether the master plan does not ever become
actually a master plan until the Town Board adopts it/---Town Attorney
Tasker stated that is right. The law permits the Planning Board to
conduct studies provided they receive the funds from the Town Board,
and one of the studies the Planning Board conducts is future develop- J
ment plans or master plans and that is what our Planning Board did
To assist them they retained planning experts, water experts. When
the plan is completed they submit it to the Town Board for implementation.
There is nothing in the statute that says you adopt a master plan. The
21anning Board may prepare a master plan, but they do not adopt it.
They submit it to the Town Board for their consideration. He thinks
that by the time the final submission to the Town Board by the Planning
Board took place they pretty well impelmented everything that they
ultimately suggested.---Mr. William pell asked if what Mr. Tasker is
saying is that we never will have a fixed master plan because every
time the Board adopts a resolution for another amendment, what they
have already voted on is amended.---Mr. Tasker said not necessarily,

the Town already does have what he refers to as thick books, there
are three or four of them. The recommendations of the planners is
a broad bursh recommendation. It may say, for imtance, that they
recommend low density development along the north shore of our town-
ship and a higher density along the south shore, and business uses
be confined to the hamlets. Take Schriever for example - the planners
said we recommend business and industry be confined to the hamlets,
raises a question in his application, does this conform to what they
suggested, where is the boundary of the halmet? or is the proposed
property separated from the hamlet, so they don't necessarily, every
time you make a change, conflict with the recommendations, most of the
time you are in conformity with them. They don't go out and look at
every single peice of property and suggest how it should be used, they
take areas.---Mr. Pell brought up the Norris property on the opposite
end of town.---Mr. Tasker stated the master planners recommended and
the courts have determined that the change in the Norris property was
in conformity with what the master plan suggested.---Mr. Pell asked
what Master Plan?---The Board stated they had just explained that.---
Justice Suter stated that just as in the Norris case, the people who
feel the master plan has not been followed have a right to appeal to
the County Court. The judge will review it to see if the Town Board
stayed within the guidelines, if the judge ways you went way out, he
can reverse that decision. If you are not satisified with the judges
decision, you can do as they did in the Norris case, go to the Appelate
Division ans ask them to review that judge's decision, and the Appellate
Division said unanimously, yes, they did follow the plan, they did
conform to all the rules and regulations and upheld us five to nothing.
If you are not satisfied with that decision, you go to the Court of
Appeals, the highest court in the State of New York, and they will
review it to see that what was done was done properly, and legally.
Therefore, the Town Brnrd is not final there are three courts to
sit over us to determine we acted properly.

Mr. Hartofelis asked when he could expect a dicision from the Town
Board on his snack bar?---Supervisor Martocchia stated he will know
at the next board meeting.
On motion of Councilman Rich seconded by Justice Doyen it was
RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 4:15 P.M.

14. There has been a budget submissionfrom the Supervisor to
the.Town Clerk, and the Town Clerk to the Town Board on October 3rd.
The budget will be studied for the next week or so. When the preliminary
budget is prepared copies will be available for the public. A date
. get hearing will be set at the next meeting.
e Planning Board has submitted the Development Plan
which they accepted and approved on September 14th. All members
of the Town Board have a copy for review.

Greenport, dated October 10, 1978, for permission to locate a single
family trailer on her property on the east side of Sterling Place,
Greenport, New York, be and hereby is granted for a six month,
non-renewable period, for a leased trailer, to be occupied while
Mrs. Bertolini's residence is being rebuilt due to fire damage.

~nEREAS John F Reeve and John T. Reeve has made application to
the Town Board of the Town of Southold to dedicate a certain road
in Mattituck, New York, to be known as "BENNETT'S POND LANE" as
shown on subdivision map entitled "Map of Bennett's Pond at Mattituck,"
filed in the Suffolk County Clerk's Office on June 12, 1970, as Map
No. 5483, togther with release ececuted by the owners thereof, and
WHEREAW the Southold Town Highway Superintendent has inspected the
said highway and has advised the Town Board that said proposed highway
complies in all respects with the speificiations for the dedication of
highways in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED that in accordance with Section 171
of the Highway Law of the State of New York, consent be and the same
is given to the Superintendent of Highways to make an order laying
out the aforesaid highway, to consist of lands described in said
application as shown on certain maps attached to said application, and
BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is
authorized and directed to forthwith cause the dedication,release
and deed to be recorded in the office of the Clerk of the County of
Suffolk, New York.
