The subject property is one parcel. The lot dimensions are 224'E on
Lighthouse Road x 456'south. The lot is irregular in shape. The subject has
a total of 1.9 acres. The site is mostly open, few trees. The subject
topography is rolling. The lot appears to be buildable. The subject is
located in Flood Zone C, not considered a hazard flood zone. Long Island
Sound is approximately 1 1/2 blocks north - there is public access. The
immediate area is mostly residential and farmlands. Lighthouse Road is a
macadam road publicly maintained. There are no sidewalks, there are street
lights. Water is provided from public well and there would be private
cesspools. The public utilities are electric and telephone.

Hummel's Pond. It's on the corner of Soundview Avenue, and Lighthouse
Road, just south of Horton Point Lighthouse, and also, one piece of
property just to the south of that, that there is part of an easement to the
Town of Southold, and we're just delighted to acquire this piece it has been

a piece, that people have really wanted it preserved because people have
skated there for years, and it would just allow everybody to have a nice
open view space with a nice pond. So, we're just delighted that we were
able to acquire this.

GENE GAYNOR: My name is Gene Gaynor. You mentioned, there's a
pond down there on that property? Are we covered in that area for liability?
COUNCILWOMAN OLIVA: We will be if it's purchased by the Town. Yes.
SUPERVISOR' WICKHAM: We would be if we purchase it.
GENE GAYNOR: Okay, because I come from an area up in Westchester
County, and we had an accident on one of the ponds in the area, that I was
in, and the Town was sued for over $20,000,000. How does that break up
here if somebody gets hurt on the Pond?

COUNCILMAN TOWNSEND: In general policy we have an Insurance
Consultant, who does risk management, and every year he reviews the
liabilities, and he may come in, and say we might have to monitor when
that... now we're owners of the property, we may have to allow skating or
not allow skating, or have some sort of monitoring, skate at your own risk
signs, which traditionally don't mean anything. We may have to start
managing it a little more than it has been managed, because, in fact, you
know, the thought had occurred to me, and I'm sure that there's lots of
precedents in law on liability of these things. We'll probably have to
follow whatever policy there is. I don't think it's worth not having the
property, because of that particular exposure. I think it adds something
for us, and it was property that was in danger of being lost to the public,
and it's been used by the public.
COUNCILWOMAN OLIVA: It's used constantly.
GENE GAYNOR: Okay, I was just questioning the fact that the Township
or the residents would be responsible for any tax increases because of a
liability. Thank you very much.
SUPERVISOR WICKHAM: Would anyone else like to address the Board on
this public hearing?

J 1M RICH: Ladies and gentlemen of the Town Board, Supervisor Wickham,
my name is Jim Rich. I'm a resident of Southold Town, have been since
1927. I'm in favor of acquiring this, and I think it would only be fair to
say that I am on the committee, that selected this piece of property. It was
brought to our committee, and I think Mr. Gold, our Chairman, will speak
on this briefly, too. It was brought to our Committee by these people, that
own it, and it came to our attention after they offered it to us, that they
had permits to build several houses on some of the property. Now, this is
one of the most unique ponds here in Southold, that is still available. You
know in Mattituck they have Wolf Pit, and across from the high school in

Mattituck, there is a pond, but this pond, excluding Great Pond, which
doesn't have very good access, and is kind of deep, and kind of dangerous,
you know. In relation to what Mr. Gaynor said, Hummel's Pond is not
very deep. There isn't much of it. There's more than perhaps a fellow my
size up to about my waist, if I fell through. People have been skating on
there as long as can remember, and it's always been an excellent place.
Another reason, that I think it would be nice, so that the Town will have
it, and it won't be built on. Mr Bagley, and Mr. Hanauer won't be able
to build their houses there. It would be kept just like it is, I hope, or
almost just like it is. There are about 4,000 people, that go up to the
Horton's Point Lighthouse every summer. I don't know if many of you know
about that, and a lot of those people, and I work up there as a volunteer, a
lot of those people say, gee, this is so beautiful to come up here, and go
past that pond. It's got pond lilies, and if you go up there in the Spring,
you can find 'the tadpole eggs, and the kids like to go up, and look at those
things. There are some swans that nest in there. I hope that the Town will
see it's way clear to pass this resolution. Children skate up there with
their fathers, the twenty-two year old boys, and the twenty-five year old
boys up there having a hockey game, and on the other end of the pond
there are five, and six year olds, seven year old children learning to
skate. It's just a wonderful place for outside recreation in the winter. You
know, we go to the beach in the summer, but this is one of the great places
for the people to have recreation in the winter, and I hope you look
favorable at this resolution. Thank you.

SUPERVISOR WICKHAM: Thank you, Jim. Would anyone else like to
address the Board on the subject of this public hearing?
WHITNEY BOOTH: Whitney Booth, Southold. I've been pretty much a
lifelong resident. I was away a long time, but, I was also raised by
Hummel's Pond. I skated there off and on for fifty years. I would say it
was thirty years ago, approximately, that I discussed seriously with the
late Bill Smith about the acquisition of this place. Bill tried. I was then
involved. We both did our best, but there wasn't much listening done. You
can't call it a dream come true, but I know my brother, and other members
of my family, many of the neighbors up there, really dozens of young
people, who maybe have some excess energy, this is going to be a real plus
factor. The preservation of open space is always desirable, but this time
it's more than just preservation. It's something that can be used as well,
and I think that's the most important of it. Thank you very much.
SUPERVISOR WICKHAM: Thank you, Whitney. Would anyone else like to
address the Board on this proposed acquisition of open space? (No
response. ) I see no further. Would anyone on the Board like to make a
comment?

COUNCILWOMAN OLIVA: I just wanted to make one comment. There are
two ladies, that died this year, who had been trying to purchase Hummel's
Pond, too, since the early 1970's, and the one thing that they asked me to
do, when I came into office, was to, please, to buy Hummel Pond for
them, and this is for Virginia Bennett Moore, and Terry Harnan, and to
this I kind of dedicate my efforts to have this come to fruition. Thank you.

SUPERVISOR WICKHAM: I like to just compliment the Committee on land
Preservation, who has worked diligently on this. I see the Chairman, and
several members, the committee has worked productively. They
commissioned the appraisal. They worked quite steadily on it, and it's a
tribute to their efforts, also, that this has come to us at this time. So,
with that, I declare this hearing closed.

RESOLVED that the Town Board hereby elects to purchase the property of Sue
Hanauer and Joan Bagley, described as follows:
1. SCTM# 1 000-50-6-4, comprising approximately 4.945 acres, located on
the southwest corner of Soundview Avenue and Lighthouse Road, Southold,
N.Y., $150,000.00.
2. SCTM#l 000-50-6-5.7, comprising approximately 1.9 acres, located on

On February 3 the Town acquired two properties at Lighthouse Road, Southold.
The tax map numbers are 1000-050-06-001l and 1000-050-06-005.007.
The property owners had not paid 1995 taxes, so the following adjustment was
made in the purchase price:
$150,000 purchase price less $379 taxes from 12/1 to 2/3
$75,000 purchase price less $192 taxes from 12/1 to 2/3
We need to check with the Assessors as to manner in which we should handle
these part-year taxes.
The smaller property was taken with the covenant that it would share a
driveway with the adjoining lot. Removal of this covenant requires Planning
Board approval. The owners of Lot 2 have agreed to apply to the Planning
Board for removal of this requirement and the placement of the driveway
entirely on Lot 2. This will take place only after review of the purchase with
the Open Space Committee and a decision as to whether the Town wants to keep
the driveway as an option.
The title company marked a copy of the title insurance at the closing. They
will resubmit a corrected title policy in a few weeks, which will be filed with
the Town Clerk. Similarly, the title company (Commonwealth) is recording the
deeds and will send us the originals, also to be filed with the Town Clerk.

I received a call last week from Ed & Margot Booth asking about the feasibility of
putting a 4' wide "nature trail" around the perimeter of Humrnel Pond and they indicated
that they were willing to flag the proposed trail.
People in the area know nothing about the project because there is no project and we have
no plans to even consider this proposal in 2003.
Margot Booth has worked for US Fish & Wildlife, the Peconic Land Trust and the Nature
Conservancy so I doubt that her proposal would be detrimental to wildlife, but this is a
moot point because this was only a paper exercise.
I will put your letter in the Hummel Pond file and you will be notified if this proposal
ever moves forward.
