This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dep!. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of I % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

Property Location: 3945 Camp Mineola Road (Howell Avenue), Mattituck
Parcel CTM 123-5-30
PROPERTY LOCATION: The applicant's property contains 8,997 square feet with 60
feet along Camp Mineola Road (a/k/a Howell Avenue). The property is currently
improved with a 580+/- square foot single-family dwelling (to be demolished).
BASIS OF APPLICATION: Request for Variances under Sections 100-239.4B and 100-
244, based on the Building Inspector's December 5, 2005 Notice of Disapproval,
amended January 17, 2006 concerning a proposed new dwelling, after demolition of the
existing dwelling. The reasons for disapproving the building permit application are that
the new dwelling will be: (1) less than a total side yard (both sides) of 25 feet, (2) less
than 75 feet from the bulkhead, and (3) the lot coverage will exceed the code limitation
of 20 percent for all building area.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 2, 2006
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The building proposed will
replace a dwelling to be demolished. The percentage of coverage of the property will be
reduced from the current 22.3% to 21 +/-% (excluding concrete pads, walks and aprons)
for the new construction. The proposed dwelling will be centered with 10ft. side yards
and is smaller in width than the existing dwelling. The setback from the bulkhead will not
be reduced, and will remain at 28.3 feet and 35 feet to the rear lot line. For these
reasons, the new construction is not out of character with the buildings in the area and is

no more intrusive to adjacent properties or the beach front areas than any of the
surrounding dwelling construction that exist.
2. The amount of relief requested is not substantial, inasmuch as the increase in lot
coverage, to 21 +/- percent will be less than that of the existing dwelling.
3. The proposed dwelling will be located further landward than the existing dwelling.
There will be no reduction in the setback from the bulkhead, and no increase of lot
coverage by building area.
l 4. The side setbacks, ten (10) feet on each side, will result in the building being
. centered on the lot and an increase from the existing nonconforming side yards.
5. Grant of the requested variance is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a replacement dwelling, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the
community.
BOARD RESOLUTION: On motion by Member Simon, seconded by Chairwoman Oliva,

RESOLVED, to GRANT the variances as applied for, as shown on the May 17,
2005 survey, amended January 12, 2006 by Joseph A. Ingegno, and

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3 '- ~
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
October 19, 2005 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of PAUL LONG applied to
the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 7,2005, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 19, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of PAUL LONG to
demolish the existing dwelling and construct a 38'X 41' two-story frame dwelling on
pilings, with 10'X 32' porch attached to southern side, and to install a new sanitary
system, with the condition drywells and a french drain are installed to contain the roof
run-off, and a line of staked haybales is installed before the project begins, and all as
depicted on the survey prepared by Joseph A. Ingegno last dated October 28, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Based on the information your agent submitted, the New York State Department of Environmental
Conservation has made the following determination.
The portion of the referenced property landward of the functioning bulkheads greater than 100 feet in
length and constructed prior to 8/20/77, as verified on AeroGraphics Corp. aerial photograph dated
4/6/76, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence,
barrier, or hay bale berm.

DECLARATION OF COVENANTS AND RESTRICTIONS

to as the DECLARANT, as the owner of premises described in Schedule ''A" annexed
hereto, also known and designated as SCTM# 1000-123-5-30, (hereinafter referred to as
the PREMISES) desires to restrict the use and enjoyment of said PREMISES and has for
such purposes determined to impose on said PREMISES covenants and restrictions and
does hereby declare that said PREMISES shall be held and shall be conveyed subject to
the following covenants and restrictions:
1. WHEREAS, DECLARANTS have made application to the Suffolk County
Department of Health Services (hereinafter referred to as the (DEPARTMENll for a
permit to construct and/or approval of plans for a single family residence, a subdivision
or development or other construction project on the PREMISES; and
2. The DECLARANT appeared before the Board of Review requesting a variance for
the installation of the subsurface sewage disposal system wWch does not conform to
the residential construction standards of the Suffolk County Sanitary Code to wit: will
not meet the separation distance of ten (10) feet from a building foundation and
twenty (20) feet from a drainage system, and the Board of Review of the County of
Suffolk Department of Suffolk Department of Health Services granted a variance by
letter dated August 21, attached hereto and made a part hereof, provided a covenant is
filed, the DECLARANT, its successors, heirs or assigns, agrees:
a) As a condition of approval by the DEPARTMENT of the application, the
DECLARANT covenants that the garage on the premises shall not be
used as a living space.
b) DECLARANT, its successors, heirs or assigns, further agrees to hold
harmless, indemnify and defend the County of Suffolk, its employees,
offices, or agents harmless from any claim for damages or injuries that
may arise out of the installation or use of the sewage disposal system.
3. The DECLARANT, their successors and/or assigns, shall set forth these
covenants, agreements and declarations in any and all leases to occupants, tenants
and/ or lessees of the above described property and shall, by their terms, subject same
to the covenants and restrictions contained herein. Failure of the DECLARANT, their
successors and/or assigns to so condition the leases shall not invalidate their
automatic subjugation to the covenants and restrictions.
4. All of the above covenants and restrictions contained herein shall be construed
to be in addition to and not in derogation or limitation upon any provisions of local,
state and federal laws, ordinances and/or regulations in effect at the time of execution
of this agreement, or at the time such laws, ordinances and/ or regulations may
thereafter be revised, amended or promulgated.
5. This document is made subject to the provisions of the laws required by law or
by their provisions to be incorporated herein and they are deemed to be incorporated
herein and made a part hereof, as though fully set forth.
6. The aforementioned restrictive Covenants shall be enforceable by the County of
Suffolk, State of New York, by injunctive relief or by any other remedy in equity or at
law. The failure of said agencies or the County of Suffolk to enforce the same shall not
be deemed to affect the validity of this covenant nor to impose any liability whatsoever
upon the County of Suffolk or any officer or employee thereof.
7. These covenants and restrictions shall run with the land and shall be binding
upon the DECLARANT, their successors and assigns, and upon all persons or entities
claiming under them, and may be terminated, revoked or amended only with the
written consent of the DEPARTMENT.
8. If any section, subsection, paragraph, clause, phrase or provision of these
covenants and restrictions shall. by a Court of competent jurisdiction, be adjudged
illegal, unlawful. invalid or held to be unconstitutional, the same shall not affect the
validity of these covenants as a whole, or any other part or provision hereof other than
the part so adjudged to be illegal, unlawful. invalid or unconstitutional.
9. Local Law #32- I 980 - the DECLARANT represents and warrants that he has not
offered or given any gratuity to any official, employee, or agent of Suffolk County, New
York State, or of any political party, with the purpose or intent of securing favorable
treatment with respect to the performance of an agreement, and that such person has
read and is familiar with the provisions of Local Law #32- 1980.

Statement of Problem
Residential construction standards require that a subsurface sewage disposal system be
placed at least ten feet from a building foundation (garage) and 20 feet from other drainage
structures. The applicant is proposing a septic system to serve a single-family dwelling that
does not conform to departmental standards in that portions of the system are located within
ten feet of a building foundation and 20 feet of a drainage structure.
Findine:s and Facts
1. The applicant is proposiI).g to remove an existing single-family dwelling and to
construct a new 4-bedroom single-family dwelling with a new on-site sewage
disposal system and connection to public water.
2. The project is located in Groundwater Management Zone 4.
3. Soil conditions are good with fine sand at 5 feet below existing grade.
4. Depth to groundwater is 4.1 feet below existing grade.
5. The parcel is connected to the public water supply serviced by the Suffolk County
Water Authority (SeW A).
6. The current site is improved with an existing dwelling that is served by one on-site
sewage disposal system consisting of a single cesspool (no septic tank). The existing
cesspool is located in the approximate area of the proposed new septic tank.
7. The applicant is proposing to abandon the existing disposal system and replace it with
an improved system that includes a 1,200 gallon septic tank and five 8-foot <I> by 2
feet effective depth leaching pools with area available for three expansion pools. The
bottom of the leaching pools will be 2 feet above groundwater elevation.
8. The location of the new sewage disposal system is constrained by existing site
conditions including the size of the lot (58 feet wide), the Peconic Bay adjacent to the
rear, and an existing garage at the front that will remain. There is also a 30-foot
square (approximate) driveway at the front of the property.
9. The water line is located at the west side of the property.

10. Portions of the proposed leaching pools and expansion area will be as close as five
feet to the garage foundation.
II. Additionally, the project has been designed with a continuous 18-inch wide by 18-
inch deep French drain along the front and side property lines. Portions of the
leaching pools will be within 3 feet of the French drain.
12. The applicant's consultant claims that the location of the leaching pool system will
not affect the garage foundation or vice-versa.
Determination
It was a 3 to 0 determination of the Board to grant the request for the variance to install the
proposed sewage disposal system closer than 10 feet from the garage foundation provided the
following conditions are met:
· The disposal system design shall be reconfigured and shown on drawings submitted
to the department signed by a licensed professional engineer to maintain an 8- foot
separation from the garage foundation.
· The French drain shall be discontinued in areas within 15 feet ofthe leaching pools.
· The applicant shall covenant the property, in language acceptable to the County
Attorney, that the garage shall not be used as living space.
The Board notes that the disposal system was designed to avoid the unpaved driveway area.
However, reconfiguring the design to place a portion of the leaching pool system under the
driveway area is acceptable to the Board provided that traffic bearing slabs and cast-iron
covers to grade are installed.
The system will be constructed to allow proper routine maintenance of the sewage system.
Therefore, granting the variance will not have any adverse effect on groundwater.
The proposed sewage disposal system is an improvement over the currently installed
facilities and provides for a greater degree of sewage treatment. As per 9760-609 of the
Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in harmony
with the general purpose and intent of the Sanitary Code to protect groundwater and drinking
water supplies, surface water and other natural resources, and public health, safety and
welfare. In compliance with 9760-609(1)(a), the proposed variance is in general conformity
with the Sanitary Code. The uses of groundwater, surface water, and drinking water supplies
will not be impaired, taking into account the direction of groundwater flow and, as such the
granting of the variance is in compliance with 9760-609(1)(b).
