The regular meeting of the Board of Southold Town Trustees was held at 7:30
Tuesday, October 5, 1982, at the Town Hall, Main Road, Southold, New York.
Present were: President Paul Stoutenburgh
Vice President Frank Kujawski

President Stoutenburgh called the meeting to order at 7:30 PM. On motion mac
by Mr. Kujawski, seconded by Mr. Smith and carried, the minutes of the August
3, 1982, meeting were approved with the exception of the omission of the
wetlands application #99 of M~ry Jane Gross which was approved at the August
meeting To construct a T dock' consisting of a 26 x 4 ft catwalk with a 12 x
4 ft dock at end in West Creek off Goose Creek, Southold.
On motion made by Mr. Smith, seconded by Mr. Bednoski and carried, the minut~
of the September 7, 1982, meeting were approved.
On motion made by Mr. Smith, seconded by Mr. Kujawski and carried, the
mooring renewal permits for the month of November were approved.
Due to the fact the November meeting day is Election Day. the next meeting
of the Board will be held on Tuesday, November 9, 1982, at 7:30 P~.
On the matter of Matt-A-Mar Marina's revised application to construct four
floating docks in Mattituck Creek, Mr. Bednoski inquired of the applicant
as to whether the docks could be shorter. Mr. Kujawski stated he would like
To see a 15 ft free area to adjacent boundary of the Federal Anchorage. Afte
much discussion, on motion made by Mr. Smith, seconded by Mr. DiVello, it was
RESOLVED to approve the pending application of Matt-A-Mar as it stands. Vote
of Board: Ayes: Messrs. Smith and DiVello. Noes: Messrs· Stoutenbur~h,
Kujawski and Bednoski. Motion denied. Further discussion ensued with Mr.
Kujawski and Mr. Bednoski stating they would agree to approve the application
if the three southerly docks were cut back 15 ft, leaving the most north~riy
dock at the requested 80 ft.- A five minute recess was called, allowing the
applicant and his associates to discuss the proposed change. Upon their
return, they agreed to cut back the two southerly docks to 45 ft each, but
stated they couldn't cut back on the 70 ft dock. On motion made by Mr.
Kujawski, seconded'by Mr. Bednoski, it was
RESOLVED to approve the application of Matt-A-Mar ~arina to construct two (2)
45 x 5 ft floating docks, one (1) 70 x 5 ft floating dock with a 40 x 5 ft
section directed northward and one (1) 80 x 5 ft dock with two (2) 40 x 5 ft
outer sections in Mattituck Creek, Mattituck. Vote of Board: Ayes: Messrs:
Stoutenburgh, Kuj awski, Smith, Bednoski, DiVello.
On motion made by Mr. Kujawski, seconded by Mr. Smith, it was
RESOLVED to approve the application of Peter Sterling to construct a timber
dock consisting of a 70 x 4 ft fixed elevated (3 ft above grade of marsh)
catwalk, 12 x 4 ft hinged ramp and 20 x 8 ft float secured by two pilings in
Eugene's Creek, Cutchogue. Vote of Board: Ayes: Messrs. Stoutenburgh,
Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. Kujawski, seconded by Mr. Smith, it was
RESOLVED to recommend to the Southold Town Board approval of wetlands appli-
cation #107 of Peter Sterling as per above application. Vote of Board: Ayes
Messrs. Stoutenburgh, Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. DiVelto, seconded by Mr. Kujawski, it was
RESOLVED to approve the application of Edwin Latson to construct a r~taining

wall approximately 76 ~]~long plus two (2) 15 ft xl~,arns in unnamed Cr~k
Conkling Point, Greenp'~x~, p~o-~iding it is constructed behin(~ the markers
provided. Backfi.ll ~ith. approximately 20 cuyds of clean sand fill to be
trucked in from commercial upland source. Retaining wall will be entirely
landward of the line of MHW. Vote of Board: Ayes: Messrs.. Stoutenburgh,
Kujawski, Smith, Bednoski, DiVello.
On motion made by Mr. DiVello, seconded by Mr. Kujawski, it was
RESOLVED to recommend to the Southold Town Board approval of the wetlands
application #108 of Edwin Latson as per above application. Vote of Board:
Ayes: Messrs. Stoutenburgh, Kujawski, Smith, Bedx~oski, DiVello.
In regard to the above applications of Edwin Latson, the Trustees feel that
if stones and debris were removed from the bank,- the shoreline would go back
to original marsh and correct the erosion problem.
On motion made by Mr. Smith, seconded by Mr, Bednoski, it was
RESOLVED to approve the application of Angelo Spetsiotes to replace 140 ft.
of aluminum bulkhead with timber bulkhead at Budd's Pond, Southold. Vote of
Board: Ayes: Messrs. Stoutenburgh, Kujawski, Smith,. Bednoski, DiVello.
On motion made by Mr. Smith, seconded by Mr. Di-Vello, it was
RESOLVED to approve the application of Domenico LoRe to place an offshore
stake at Narrow River Road, Orient, providing it does not interfere with
other boats or swing into the channel. Vote of the Board: Ayes: Messrs.
Stoutenbur~h, Kujawski, Smith, Bednoski, DiVello.
After the Town Trustees exhausted all avenues of research, on motion made
by Mr. Bednoski, seconded by Mr. DiVello, it was
RESOLVED to approve the application of The Lagoon Association to maintenance
dredge an irregular shaped area within The Lagoon to deoth of 4 ft' below
MLW and place aporoximately 14,000 cuyds of spoil on b~ach north of (
bulkheaded canal~as nourishment. No spoil to ~e placed on orivate prooermy:
Vote of Board: Ayes: ~.~essrs. Stoutenburgh, Kujawski, Bednoski, Smith,
DiVello.
The Board requested a letter be sent to all the ~embers oY TB:e Lagoon
Association to notify th_em the applfcgti.on to dredge, was approved and to
ask them to notify.the Trustees-if they- notice any drastic change i.n theist
water quality after the project is completed.
The Board also requested, as lead agency, that a statement of negative
declaration be sent to the DEC for the dredging project_ £n. The Lagoon,
In regard to the Cedar Beac~ Park Association putting i~ an application for
a pre-existing bulkhead, Mr. Mich~eI Costello appeared before the Board and
explained that all the resfdent~ were not here 'this' time of year, therefore
they would appreciate holding off-nntil spring to'snbmit the appl%cation.
Bay Constable Tom Czelatka reported thgt a Mr~ O~Connor reqnested the
Trustees check Bennett's Pond off ~Yestph. alia Road, ~attituck, as it is'
closing in and the water.is not flowing in. The Trustees ~ill look at it
on their next Yield trio.
Mr. Czelatka also reported that the Seed Clam Program is goin~ along very
nicely. Next month, 1~-12,000 clams will be transplanted in one controlled
area. Possible sites for closi, ng for the transplantin~ are Mill Creek.

The Board agreed to write a letter to the Town '-~oard in support of some
help for Bay Constable Tom Czelatka.

On Wednesday, October 20, 1982, the Board will meet at the home of Mr.
Kujawski to ~o over the file, map and inventory of MattitUck Creek taken by
Lori Brooks this past summer.
The Board requested Bay ConstableCzelatka to follow through on .the Lawrence
Brannigan case and find out why he has not submitted an application for the
dock he constructed, as he has been requested to do so Twice previously.
There bein~ no further business to come before the Board, Mr. Kujawski made
a motion, seconded by Mr. Smith and carried to adjourn. Meeting adjourned
at 9:45 PM. -
