Present Were: Don Wilder, Chairman Jack McGreevy, Member Peter Young, Member Chris Kempner, Member Doug Hardy, Member Glen McNab, Member Bob Ghosio, Jr., Trustee Lauren Standish, Secretary Absent Were: James Eckert, Member Jacob Smith, Student Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 4:30 PM CHAIRMAN'S ANNOUNCEMENTS REPORTS The CAC members discussed the position of the student member and agreed that student members should not vote on Trustee Permit applications, and should be given structured assignments. 2 Member Peter Young distributed a memo relating to a local law requiring retailers to provide recycling programs for their light plastic bags used in their trade. Member Doug Hardy suggested converting the letter from the CAC and submitted it to the Town Board. Moved by Peter Young and seconded by Doug Hardy, to have Chairman Don Wilder write a letter and submit it to the Town Board. Vote of Council: All Ayes Member Jack McGreevy suggested sending a letter to the Town Board regarding the shoaling of Down's Creek, as per the request of Councilman Tom Wickham at a Town Board meeting. He also suggested sending a letter to the Town Board requesting formal training for the CAC members. Member Doug Hardy shared his concern with rising sea levels and the importance of addressing it now and, and the awareness of it. Member Peter Young informed the committee of his position on the environmental committee for the Power Squadron, and was able to obtain some informational packets prepared by the NOAA Coastal Ocean Program, relating to small docks and how to use science based management when reviewing dock applications. He stated he was willing to schedule a seminar if enough people were interested, such as the Town Board, Power Squadron, Board of Trustees, etc. APPROVAL OF MINUTES Moved by Glen McNab, seconded by Jack McGreevy, to Approve the Minutes of December 5, 2007. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL BEHRINGER & VESHA KUMAR to reconstruct 100 If. of existing bulkhead within 18" using C-Loc vinyl sheathing, and install two (2) new 12' returns. Located: 1755 Shore Dr., Greenport. SCTM#47-2-31 Inspected by: Peter Young, Jack McGreevy The CAC Supports the application with the Condition of a 15' non-turf buffer and a site drainage plan. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL BEHRINGER & VESHA KUMAR, AND ELIZABETH GARDNER to reconstruct the existing stairs, 3 repair/replace the existing timber dock and add a new 32"X 20' ramp and 6'X 20' floating dock. Located: 1755 &1665 Shore Dr., Greenport. SCTM#47-2-30&31 Inspected by: Peter Young, Jack McGreevy The proposed dock was not staked, however the CAC Supports the application with the following Conditions: . Appropriate materials are used; . The dock extends no further seaward than the neighboring docks; . Provide public access across the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of NIKOLAOS KATOPODIS to construct stairs from the top of the bluff to the beach. Located: 1540 The Strand, East Marion. SCTM#30-2-65 Inspected by: Peter Young, Jack McGreevy The project was not staked, however the CAC Supports the application with the following Conditions: . Outcome is Consistent with the LWRP and Best Management Practices; . Provide erosion control during construction and thereafter. Vote of Council: Ayes: All Motion Carried Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of BELVEDERE PROPERTY MANAGEMENT, LLC to install approx. 120' of single row rock wall utilizing 2-3 ton rocks. Rocks shall be placed on top of filter fabric and 25-50 lb. hardcore stone foundation. Wall shall then be covered with approx. 85 cy. of dewatered and dry spoil from adjacent dredging project. Area will then be re-vegetated with Cape American beachgrass 12" on center and Rosa Virginica planted 5' on center and bank shall be maintained and replenished annually as needed. Located: First & Jackson Streets, New Suffolk. SCTM#117-8-19 Inspected by: Glen McNab, Don Wilder, Chris Kempner The CAC Supports the application with the Condition provisions are made to not adversely affect the neighboring property, and coordinate efforts with the new property owners. 4 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Glen McNab, it was RESOLVED to SUPPORT the Wetland Permit application of BELVEDERE PROPERTY MANAGEMENT, LLC to reorganize approx. 540' of existing jetty rocks and supplement with 1-3 ton rocks as required to raise elevation to 6' above mean low water. Restore beach area with dewatered and dried spoil from maintenance dredging project. Area will then be re-vegetated with Cape American beachgrass planted 12" on center. Located: First & Jackson Streets, New Suffolk. SCTM#117-8-20 Inspected by: Glen McNab, Don Wilder, Chris Kempner Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of WILLIAM F. BILLMAN, AS TRUSTEE OF THE WILLAM F. BILLMAN REVOCABLE TRUST to construct a single-family dwelling with sanitary system and retaining wall. Located: 10220 Route 25, East Marion. SCTM#31-11-6 Inspected by: Jack McGreevy, Peter Young The CAC does Not Support the application because of the following reasons: . The negative impact on the wetland to the southeast; . The project is being proposed in a natural drainage area; . Consistency with LWRP. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Don Wilder, it was RESOVLED to SUPPORT the Wetland Permit application of EVE SEBER to construct a second-floor addition to the existing dwelling and shift north foundation wall back toward the south to square off the new construction. Located: 3025 Pine Neck Rd., Southold. SCTM#70-6-18 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried 5 Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN & VALERIE KRAMER to install a 103' long armor stone wall revetment on filter fabric, backfill with approx. 100 cy. clean sand from an upland source, and plant beachgrass 10' landward of stone wall. Located: 2225 Calves Neck Rd., Southold. SCTM#70-4-45.3 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Chris Kempner, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of ROBERT FRIEMANN to construct one-story, two-story, second-story, garage, porch, and deck additions to an existing one-story, one-family dwelling; remove existing concrete patio; install a drainage system of drywells; and remove an existing sanitary system to be replaced with an upgraded sanitary system located a minimum of 100' from wetlands. Remove and replace (in-place) an existing timber retaining wall with a stone retaining wall to be raised 18" to el. 9.5' MSL; place approx. 60 cy. clean sand landward of new retaining wall to decrease the slope between the dwelling and shoreline; and establish over same area a 23'-40' wide and approx. 3,126 sq.ft. non-turf buffer to be planted with native vegetation in place of the existing lawn. Located: 2935 Pine Tree Rd., Cutchogue. SCTM#104-3-8 Inspected by: Glen McNab, Chris Kempner, Don Wilder The CAC Supports the application with the Condition a plan is submitted for all trees above 8" DBH, and efforts are made to remove as few trees as possible. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of PAMELA J. WILLIAMS REVOCABLE LIVING TRUST to construct approx. 101 linear ft. of vinyl bulkhead in place of existing timber bulkhead; remove and replace (in-place) approx. 16 linear ft. of existing timber retaining wall and remove remaining portions of wall; construct a 10'X 16' deck and 4' wood walkway along bulkhead; backfill with approx. 25 cy. clean sand to be trucked in from an upland source; and reconstruct existing deck and stairs (in-place) as necessary. Located: 1110 Cedar Point Drive East, Southold. SCTM#90-2-20 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried 6 RICHARD & MARY LOU MANFREDI to reconstruct existing wood deck around the existing pool; remove decking and deck framing as necessary; install new motorized pool cover; and install new 48" estate fence around pool area, house and garden area. Located: 170 Hilltop Path, Southold. SCTM#54-1-29 The CAC did not make an inspection, however recommends that all drainage be contained on the property. Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of HENRY TRAENDL Y & BARBARA CADWALLADER to demolish an existing beach cabana and garage and construct a single-family dwelling and garage further landward. Located: 13000 Route 25, East Marion. SCTM#31-14-11 Inspected by: Peter Young, Jack McGreevy The CAC does Not Support the application because of the following reasons: . Concerns with the location of the sanitary system; . Setbacks appear to be minimal; . Whether or not the project can meet the requirements of the LWRP and the best management practices, and . The survey indicates that the applicant owns the property to the east. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of YVETTE LANG EINCZIG to remove and replace, in place, 128 If. of existing smooth faced bulkhead with 128' of navy style bulkhead, backfill with 5 cy. of sand to be trucked in from an upland source, and establish a 10' buffer area extending the length of the bulkhead to be kept in a natural state. Located: 3055 Wells Rd., Southold. SCTM#70-4-11 Inspected by: Doug Hardy The CAC observed that wave reflection off the bulkhead has destroyed the tidal marsh, however, Supports the application with the Condition the marsh is restored, and a 30' non- turf buffer is installed landward of the bulkhead. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS 7 BELVEDERE PROPERTY MANAGEMENT, LLC to Amend Permit #6565 to construct a 6'X 6' cantilevered platform, install a 42"X 14' aluminum ramp leading to a 6'X 60' floating dock to be secured by four (4) anchoring piles, relocate an existing shellfish float, remove two (2) existing 2-pile dolphins, remove two (2) existing pipe anchors and install two (2) new green heart anchor piles. Located: Robins Island, New Suffolk. SCTM#134-3-5 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of SUMMIT ESTATES HOMEOWNERS ASSOC. to Amend Permit #453 to relocate the four (4) pilings from the outside of the "T" dock to the inside of the "T" on the west side. Located: Shipyard Lane, East Marion. SCTM#38-7-12 Inspected by: Peter Young, Jack McGreevy The project was not staked, however the CAC Supports the application provided the proposed modifications stay within the restrictions of a residential dock and do not create a navigational hazard with the dock to the east. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded Don Wilder, it was RESOLVED to SUPPORT the application of MARTIN REGINE to Amend Permit #4367 for the inkind/inplace replacement of the existing stairs and decks/platforms. Located: 675 Hillcrest Drive North, Orient. SCTM#13-2-8.19 Inspected by: Peter Young, Jack McGreevy The CAC Supports the application with the following Conditions: . Consistency with the LWRP; . Mitigation of erosion; . Assurance of a re-vegetation plan; . No treated lumber and vinyl grated platforms. Vote of Council: Ayes: All Motion Carried The next regular meeting of the Conservation Advisory Council has been set for Wed., February 13, 2008 at 4:30 PM at Down's Farm Preserve. 8 There being no further business to come before the Council, the meeting was adjourned at 7:00 PM.
