RESOLVED that the Town Board of the Town of Southold hereby sets 8:30

SUPERVISOR COCHRAN: The hearing is on the question of accepting the offer of acquisition of
property that is offered to us.
JUSTICE EVANS: "Notice is hereby given that pursuant to the provisions of Chapter 59, Open Space
Preservation of the Code of the Town of Sotuhold, the Town Board of the Town of Southold will hold
a public hearing on the 12th day of October, 1999, at 8:30 P.M., on the question of the acceptance of
the offer of K. Zahler for acquisition by the Town of Southold for Open Space Preservation Purposes
on the following described properties:
Suffolk County Tax Map No. 1000-116-01-009 comprising approximately 5 acres, located on the

Further Notice is hereby given that a more detailed description of the above mentioned parcel of land
is on file in the Southold Town Clerk's Office, examined by an interested person during business hours.
Dated: September 28, 1999. By Order of the Southold Town Board. Elizabeth A. Neville, Southold
Town Clerk." This was published in the Suffolk Times. There is an affidavit here stating that, and that
it was placed on the Town Clerk's Bulletin Board. There is a Short Environmental Assessment Form,
but there is no correspondence.
SUPERVISOR COCHRAN: Anyone like to address the Town Board in relation to accepting the offer
of this property. Mr. Ryan?
DICK RYAN: My name is Dick Ryan. I am the Chairman of the Town Land Preservation
Commission. Mr. Zahler has offered to give a certain portion of the property by application to the
committee in August of 1999. Subsequent to this application Mr. Zahler made application to the
Planning Board for approval of a two-lot subdivision of the entire property. The Planning Board
advised him that he was exempt from such approval requirements in as much as the subdivision would
be the end result of the gift here proposed. Further the Planning Board has advised the Land

Preservation Committee of its approval of the proposed gift. The area of the proposed gift runs on New
Suffolk A venue and Moore's Lane. It also has frontage on the west side of Down's Creek. It is
comprised of tidal wetlands. It provides northerly views of Downs Fann Preserve, which encompasses
Fort Cortchaug. As you know Downs Fann Preserve is an open space property owned and protected by
the Town of Southold. The Land Preservation Committee urges the Town Board to accept the offer of
the charitable gift of approximately five acres of his property pursuant to the provisions of Chapter 59
of the Town of Southold Town Code. In doing so I ask the Board to also give due acknowledgement to
the charity and concern of their neighboring residents of the Town of Southold by Mr. and Mrs.
Zahler's generous gift. I would also note on record that Mr. Zahler was present here earlier this
e\"ening, but because of the lateness of this hearing he was enable to stay.
SUPERVISOR COCHRAN: I would like Mr. Zahler to, please com back in two weeks, Dick, ifhe
can. We have a Certificate of Appreciation to present to him on behalf of the Town for his generous
offer. We also have oile for the next person, but we will close this hearing first.

WHEREAS, K. Zahler has offered to gift a parcel of land to _ the Town of
Southold under the Open Space program for land preservation; and
WHEREAS, the Town Board of the Town of Southold held a public on the
question of the acquisition of the K- Zahler property on the 12th day of
October, 1999 pursuant to the provisions of the Chapter 59, Open Space
Preservation of the Town. Code of the Town of Southold, at which time all
interested persons were given an opportunity to be heard; and
WHEREAS, the Town Board deems it in the public interest that the Town of
Southold acquire the K_ Zahler property; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold elects to accept
the K. Zahler property, located at the northeast corner of New Suffolk
Avenue and Linden Avenue (Moores' Lane), Cutchogue, New York, SCTM #
1000-116-01-009, consisting of approximately 5 acres, at a total price of
the costs associated with transfer of the title of land to be gifted.

SUPERVISOR COCHRAN: As your Supetvisor I get the privilege of doing presentations many,
many times, and it is certainly on behalf of the Town Board, and on behalf of the community of
Southold, and this is a velY special one tonight. We have had several people, one several weeks ago,
that donated a piece of land to the Town, and this evening we are also saying thank you to Mr. and
Mrs. Kenneth Zahler. Mr. Ryan, why don't you join me, also? Dick Ryan is. Chairman of the Land
Preservation Councilman, and Brian, why don't you join me, too? You are the Board liaison. These
people work hard to put the deals together, but we are especially pleased, because this is a generous
gift that you have given t<;> the town. It is a lovely piece of land on the comer of New Suffolk
Avenue and Moore's Lane in Cutchogue, and it will be forever preserved. I would like to read this in
appreciation. Presented to Mr. and Mrs. Zahler for your generous gift of open space to the Town of
Southold helping us to preserve bur heritage and quality of life, presented by not only the Town
Board, bUI also the 20,000 residents of Southold Town. We are very, very pleased, and we hope
. more people are watching and maybe do the samc. Is that anything you would like to say?
KENNETH ZAHLER: I would just say that my wife and I have always been very much involved in
the community, because we have been residents back about, we go back a great distance. We have
been residents for many years, and we have been very involved there, and I thought by this gift I
would like to get started on the right foot.

Subdivider gifts
wetlands to town
CUTCHOGUE-Five acres of wet-
lands adjacent to Downs Creek on the
northwest corner of Moores Lane and
New Suffolk Avenue will be pre-
served, thanks to Aquebogue resident
Ken Zahler.
Mr. Zahler, who owns Aquebogue
Abstract, a title insurance company,
has an application now before the
Southold Planning Board to subdivide
11.5 acres of land that stretches north-
ward from that corner and to build a
home on the northern six-and-a-half
acres. He will donate the remaining
five acres of the property to Southold
Town.
"I'm well aware that it's open space
that makes the East End so at-
tractive," said Mr. Zahler, a former
member of the board of directors of
the Riverhead Foundation for Marine
Preservation and Research. "I myself
would never want to live in a subdivi-
sion surrounded by other homes."

He also pointed out his property's
proximity to roughly 100 acres of pre-
served open space near Fort
Corchaug. "I thought the donation
would be nice and would go along
with what's going on around it. It just
made sense,"
Land preservation committee chair-
man Dick Ryan also commented on
the ideal
location of
the prop-
erty. "The
commit-
tee's
thrilled to
have that
kind of
offer come to the town," he said. "It
provides another great vista to Downs "-
Creek."
The property itself has a long his-
tory. The acreage is part of what was
once known as Fort Neck Farm,
owned by the Moore family. The prop-
erty was passed from Joseph Hull
Moore to his son, Stuart, who, along
with partner Charles Hudson, built
the adjoining North Fork Country
Club in 1911.
The property was then inherited by
Stuart's son, Douglas Moore, the
Pulitzer Prize-winning composer, who
did some of his best work in a shack
still standing on the property.
Douglas's daughters inherited the
land, eventually selling it roughly 10
years ago to South old realtor Lewis
Edson, who sold it to Mr. Zahler last
spring.
