money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying

designated Lot No. lOon a certain map entitled, "Map of Little Neck Properties," filed in the office of the Clerk of

TOGETHER with an easement for ingress and egress over and upon the following described premises:
ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the Town of Southold,
County of Suffolk and State of New York, bounded and described as follows: Commencing at a point in the westerly
line of Little Neck Road which said point is located North 14 degrees 06 minutes 37 seconds West a distance of276
feet from the intersection of the Westerly line of Little Neck Road and the northerly line of Moose Trail and from
said point or place of beginning; running thence South 76 degrees 05 minutes 13 seconds West a distance of 436.70
feet to a point; thence North 14 degrees 23 minutes 17 seconds West a distance of 631.53 feet to a point; thence
North 12 degrees 02 minutes 37 seconds West a distance of 294.65 feet to a point; thence North 75 degrees 36
minutes 23 seconds East a distance of 142.81 feet to point; thence South 14 degrees 23 minutes 37 seconds East a
distance of70 feet to a point; thence South 14 degrees 06 minutes 37 seconds East a distance of839.20 feet to a

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part wtll receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the costs of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as jf it read "parties" whenever the sense of this indenture sc requires.

WHEREAS, by Order to Show Cause of this Court, dated the 2nd day of October, 2000,
issued to inquire, among other things, whether or not a Guardian should be appointed for
JOSEPHINE LAMPUS, whose last place of residence was the Riverhead Nursing Home, 1140
W oodcrest Avenue, Riverhead, New York 1190 I, with telephone number (631) 727 -7744, and after
a Hearing was held on the 8th day of November, 2000, at which it was found, among other things,
that a Guardian for the Personal Needs and a Special Guardian ofthe Property should be appointed
for JOSEPHINE LAMPUS, and
WHEREAS, an Order and Judgment in this proceeding was duly made and entered in the
Office ofthe Clerk ofthe County of Suffolk on February 23,2001, appointing KATHY LAGA TT A,
of 103 Oakland Avenue, Port Washington, New York 11050, whose telephone number is (516) 883-
8287, as Guardian for the Personal Needs and Special Guardian of the Property of JOSEPHINE
LAMPUS, for the duration ofthe Personal Needs 'Guardianship which shall be indefinite and for the
duration of the Special Guardianship which shall be until such time as the Special Guardian has

completed her duties, conditioned that said Guardian will in all things faithfully discharge her duties
and obey all lawful directions of any Court of competent jurisdiction pertaining to said trust, and
render a just and true account of all monies received and disbursed whenever required to do so by
a Court of competent jurisdiction, and
WHEREAS, the filing of a surety bond has been waived by the Court, and
WHEREAS, the said Guardian, KATHY LAGATTA, has duly given and filed in the said
Clerk's Office he~ Consent to Act and Designation duly executed and acknowledged by her, in and
by which she accepts said appointment as the said Guardian for the Personal Needs and Special

Guardian of the Property of JOSEPHINE LAMPUS,
NOW THEREFORE KNOW YE, that we have granted, given and committed and by these
presents does give, grant and commit.unto the said KATHY LAGATTA, Guardian, whose address
is 103 Oakland Avenue, Port Washington, New York 11050 and whose telephone number is (516)
883-8287, the care, custody and management of the ofthe estate, real as well as personal, of the said
JOSEPHINE LAMPUS, during our pleasure to be signified in our Supreme Court, and that the said
specific powers granted to the said Guardian with respect to the personal needs and property
management of JOSEPHINE LAMPUS shall include the following:
Personal Needs
(a) To determine who shall provide personal care or assistance to JOSEPHINE
LAMPUS;
(b) To make decisions regarding JOSEPHINE LAMPUS' social environment and other
social aspects of JOSEPHINE LAMPUS' life;
(c) To determine whether JOSEPHINE LAMPUS should travel;
(d) To authorize access to or release of JOSEPHINE LAMPUS' confidential records;

(e) To apply for government and private benefits;
(f) To consent to or refuse generally accepted ibutine or major medical or dental
treatment on behalf of JOSEPHINE LAMPUS, including the continued

administration of antipsychotic drugs but excluding the administration of
electroconvulsive shock therapy; and
(g) T~ choose JOSEPHINE LAMPUS' place of abode.
Property Management
,
(a) To transfer ownership of JOSEPHINE LAMPUS' interest in her marital homestead
located at 515 Moose Trail, Cutchogue, New York 11939 to DAVID LAMPUS (her
spouse); and
(b) To directJOSEPHINE LAMPUS' social security payments to KATHY LAGA TT A,
as representative payee,
AND, all persons are hereby directed and commanded to deliver to the said Guardian, upon
demand and presentation of a certified copy of the said Commission to Guardian, all the property
and income of JOSEPHINE LAMPUS which may be in their possession or under their control,
AND, the duration of the Personal Needs Guardianship is indefinite,
AND, the duration of the ofthe Special Guardianship of the Property shall be until such time
as the Special Guardian completes her duties set forth herein, files an Affidavit with the Court
evidencing the completion of her duties and is discharged by this Court,
AND, the said Personal Needs Guardian shall file an Initial Report in accordance with the
provisions of 981.30 of the Mental Hygiene Law, and mail a copy of said report to the Court
Examiner, who hereby is assigned to review the Initial Report and Annual Reports to be submitted,

AND, the said Personal Needs Guardian shall file during the month of May of each year, in
the office of the Clerk of Suffolk County, an Annual Report [n accordance with the provisions of
981.31 of the Mental Hygiene Law, and shall mail a copy of said report to the Court Examiner

assigned herein, to Mental Hygiene Legal Service and to the Administrator ofthe facility in which
the Incapacitated Person resides,
AND, the said Personal Needs Guardian shall visit the Incapacitated Person not less than four

AND, the said Personal Needs Guardian is required to complete a training program as
provided for under {l81.39 ofthe Mental Hygiene Law,
AND, the said Guardian for the Personal Needs and Special Guardian of the Property is
hereby further required to obey and abide by all Orders relating to said trust and to render a full and
just account of the execution ofthe said trust and ofthe estate, property and effects of JOSEPHINE
LAMPUS which shall come into the hands of said Guardian when and as often as said Guardian
shall be required so to do by our said Court or by any Court of competent jurisdiction,

of the State of New York, at the Supreme Court building located at the Cohalan Court Complex, 400
