SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further review under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 10,817 square
feet (deeded area), 127.54 feet along Village Lane, 71.33 feet along the southerly side
line, 83.28 feet along the northerly side line, and 141.07 feet along the rear lot line
measured at a tie line (at the bulkhead/high water boundary), as shown on the May 13,
2004 survey updated July 27, 2007 by John C. Ehlers. The property is improved with a
two-story frame house with attached garage.
BASIS OF APPLICATION: Requests for Variances under Sections 280-122, 280-124,
280-116B, based on Zoning Code Interpretation #5039 (Walz Application) and the
Building Inspector's July 30, 2007, Notice of Disapproval concerning proposed additions
and alterations to the existing dwelling, which new construction when located less than
35 feet from the front lot line and less than 35 feet from the rear lot line will create an
increase in the degree of nonconformance. New construction is also proposed at less than
75 feet from the bulkhead.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning reply dated October 10, 2007 states that the
application is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
LWRP DETERMINATION: An October 9, 2007 letter was submitted to the Board of
Appeals to confirm inconsistency under Chapter 95, Waterfront Consistency Review of
the Town of Southold Code and Local Waterfront Revitalization Program (LWRP)
standards. Grant of relief in this area variance application will create minimal land
disturbance because the proposed construction on the seaward side of the existing

dwelling will maintain the existing non-conforming setback of the house and soil removal
for the proposed concrete structural posts will be dug by hand and will support exterior
structures made of wood that are lightweight and water permeable (a deck, steps and
trellis above). Drywells are proposed at each of the four corners of the house to contain
roof runoff and a line of hay bales during construction are proposed as noted on the site
plan dated 7-3-07 provided by Gluckman Mayner Architects, as per the recommendation
of the LWRP Coordinator. The existing bulkhead was recently installed and is in
excellent condition. The existing slopes are essentially flat with the exception of the
southwest corner which slopes toward the water.
AREA VARIANCE RELIEF REQUESTED: The applicant proposes to add a total of 250
square feet of habitable space to their existing single family house with existing non-
conforming front and rear yard setbacks. A wood deck with steps on the south end and
an open wood trellis above is also proposed at the current non-conforming setback of the
house from the bulkhead.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law li267-b(3)(b)(3)(1). Grant of the variances as applied for will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby
properties.
The applicant proposes a total of 250 square feet of habitable space to their existing
single-family house. A reduction of the nonconformity of the current 9 ft. front yard
setback from Village Lane is proposed by removing the existing front porch and creating
a new smaller porch and steps with a proposed 16 ft. front yard setback. A small
reduction in the non-conforming rear yard setback of 26 ft. will be accomplished by the
removal of a 23 square foot area of the southwest corner of the existing garage on the
seaward side.
The current non-conforming setback from the road will be increased to create greater
conformity. The new cedar shingles that will replace the existing vinyl siding, the new
windows and roof pitches will all improve the appearance of the existing house and undo

many years of incompatible alterations and additions. The height of the tallest ridge will
remain the same and existing views from the street to the water will be maintained.
The effect of the requested relief for the rear yard and bulkhead setbacks for a proposed
new wood deck, steps and open wood trellis on the south end of the existing house, and at
the current non-conforming setback of the house from the bulkhead, will not adversely
impact Orient Harbor or change the appearance of the house from the street, but will
provide the applicant with a small exterior area to enjoy outdoor activities.
2. Town Law ~267-b(3)(b)(2)' The benefit sought by the applicant cannot be achieved by
some method, feasible for the applicant to pursue, other than an area variance because
the entire lot measures 71.33 feet in depth and it is impossible to create a conforming
setback of 75 feet from a bulkhead and/or a conforming front yard setback of 35 feet
given the lot size and configuration.
3. Town Law ~267-b(3)(b)(3). The variance granted herein is not substantial. The
proposed additions to the house are very small at only 250 square feet (168 square feet on
the first floor which will be taken from interior space in the existing two car garage, and
99 square feet on the second floor), and the proposed lot coverage will remain conforming
at 19.3 percent. The front yard setback will be increased and the rear yard setback will
remain the same.
4. Town Law &267-b(3)(b)(5). The difficulty has not been self-created, but is the result of
an existing house on a shallow waterfront lot with non-conforming setbacks.
5. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance
in this residential community will have an adverse impact on the physical or
environmental conditions in the neighborhood. The applicant has proposed measures to
mitigate any environmental impacts to Orient Harbor as described herein.
6. Grant of the requested relief is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of a slightly larger dwelling and exterior deck and
trellis while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-B, motion was offered by Member
Weisman, seconded by Member Oliva, and duly carried, to
GRANT the variance as applied for, and shown on the 7-3-07 surveyor site plan
revised 8-29-07, floor plan AlO1 revised 9-25-07, roof plan A104 dated 9-14-07
revised 10-1-07, basement plan AlOO dated 7-10-07 reissued 8-20-07, and exterior
elevations A201 dated 9-25-07 reissued 10-1-07 and A202 dated 9-25-07 provided
by Gluckman Mayner Architects, subject to the following:
Condition: A non-turf buffer shall be installed landward of the bulkhead to
protect Orient Harbor.
That the above condition be written into the Building Inspector's Certificate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature
for an alteration that does not increase the degree of nonconformity.

INSTRUCTIONS
a. This application MUST be CQmpletely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location ofIot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim. the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 6:
Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A, Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
I. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The distance to the proposed steps and deck from the tidal wetland
boundary/wood bulkhead is 21.3 feet: a minimum setback distance of 100 feet
from the wetland line is reauired pursuant to Chapter 275-3. Findinl!s: purpose;
iurisdiction; setbacks.. In addition. a minimum setback distance of 75 feet is
reauired pursuant to Chapter & 280-116 B. All buildinJls or structures located on
lots upon which a bulkhead. concrete wall. rip rap or similar structure exists and
which are adiacent to tidal water bodies other than sounds shall be set back not less

than 75 feet from the bulkhead. Please require that the applicant amend the
application to meet the above policv to the l!reatest extent practical.
Additionally, if the action is approved and to further Policy 5: Protect and Improve Water
Quality in the Town of Southold
1. Require drywells to contain drainage for the residence.
2. Require a non-turf buffer landward of the bulkhead to protect Orient
Harbor.
3. Install a hay bale line during construction.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 22, 2007 regarding the above matter:
WHEREAS, Gluckman, Mayner Architects on behalf of LAURA A. WElL applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated August 1, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront
Revitalization Program toJpe greatest extent possible through the imposition of the
following Best Management Practice requirements: installation of gutters and drywells to
contain roof runoff, a line of staked hay bales to be installed prior to construction, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 22,2007, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
South old Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of LAURA A. WElL to
construct a 168 square foot addition to the landward side of the existing dwelling,
remove existing porch and construct new porch, construct new deck and steps on the
seaward side of the dwelling and covered by a trellis, extend a portion of the second-
floor over an existing one-story mass, and CMU access well to be removed and filled on

This Site Plan prepared by our office, supersedes that by John Ehlers, licensed Surveyor, dated 07-27-
2007.
The site plan was amended to reflect changes required by the Town of Southold Board of Trustees, in
order to obtain a permit from them. A permit was issued on August 22 2007, a copy of which was sent
to the ZBA under separate cover. These changes include:
1. Deleting the proposed steps on the west (seaward) side of the dwelling.
2. limiting the number of proposed steps to the south of the proposed deck (on the south side of
the dwelling), such that they project only 5'-0" from the edge of the deck.
3. The installation of 4 drywells, one at each corner of the dwelling.
FIRST FLOOR PLAN - A.I01 and EXTERIOR ELEVATIONS - A.201 and A.202. dated
September 25. 2007
8 copies of these drawings are enclosed herein and replace those submitted on September 21,2007. As
per the Z BA's suggestions, we have clearly annotated what is new and what each change is. The Z BA
may discard the sheets dated September 21,2007, if desired.
These three drawings were amended to reflect requests made by the landmarks Preservation
Commission during our meeting with them on September 18, 2007. It was indicated that if we made
changes reflecting theese requests, we would be approved at their next public hearing. The changes
include:
1. The addition of windows on the north fa<;ade at the garage level, room 109 Garage / Storage.
2. The enlargement of the upper story window on the north fa<;ade, room 201 Studio.

N umber of floors and qeneral characteristics BE FO R E alterations:
The existing building is composed of three volumes. The Main two-story volume in the center, the
two-story Garage to the north, and the Secondary one-story volume to the south. All three volumes
have pitched roofs with asphalt shingles and vinyl siding. There is a front porch along the entire
length of the east side of the Main volume. The Main volume has a full basement, while the
Secondary volume has a crawl space. The basement and crawl space walls are block masonry.
The Garage is slab on grade. To the best of our knowledge, all three volumes are wood frame
construction, although the Garage may have some steel.
On the first floor of the Main volume is a living room, kitchen, dining area, powder room, and
enclosed rear porch. On the second floor is a full bathroom and four bedrooms. The laundry / mud
and utility rooms are in the Secondary volume. Above the ground-level two-car Garage is a studio
space.
Number of floors and chanqes WITH alterations:
The Main volume remains a two-story volume with pitched roof and basement. The front porch
will be removed. The vinyl siding and asphalt shingles will be replaced with cedar shingles. New
windows and doors will be installed. The first floor will contain the living room, kitchen, and
enclosed rear porch. The second floor will contain a master bedroom, guest bedroom, bathroom,
and sitting area.
The Secondary volume gets a partial second-floor addition (99 sf) and a new pitched roof. The
vinyl siding will be replaced with cedar shingles, and the new pitched roof will have cedar shingles.
New windows and doors will be installed. A study will be on the first floor. The partial second
floor will be the master bathroom. A emu access well attached to east fa<;-ade shall be demolished
and filled.
The Garage remains a two-story structure, with a 168 sf addition to the east (the second level of
the addition is an attic / uninhabited space). The roof of the addition will follow the slope of the
existing roof. The vinyl siding and asphalt shingles will be replaced with cedar shingles. New
windows and doors will be installed. Part of the ground floor level of the Garage will be raised to
the levei of the Main volume and incorporated into the first floor dwelling area to accommodate a
new entry, full dining room, and powder room. A new porch will be added off the entry on the east
fa,ade. A 23 sf area of the south west corner of the current Garage will become exterior space (a
deletion of interior square footage) and form a planter outside of the dining room. The resultant
one-car Garage will have a mechanical equipment area, raised above flood level. The second floor
of the Garage volume wili have a guest bedroom, laundry room, studio, and mechanicai / storage
area.
For all three volumes, the new structural elements will be both wood and steel. Also, the bedroom
count will be reduced from 4 to 3.

As co-owners of the property located at 50 King Street, Orient, NY, we are
aware of the renovations that our neighbor, Laura Weil, is planning for her
house at 2760 Village Lane. We did receive her notice of the ZBA hearing
and returned the green postcard indicating receipt of the information.
Because the card was initially sent to our Orient address rather than to our
usual mailing address in Queens, we did not receive it until a few days ago.
We do not plan to be present at the upcoming hearing and, consequently,
waive our right to attend.
