LPC discussed potential purchase and whether this should be a public/private partnership as is
sometimes done with non-subdividable “small” lots. Melissa instructed to consult with the Town Board
during their next work session.

Reviewed appraisal [executive session]
Melissa had been unable to reach landowners by phone prior to meeting. Appraisal reviewed and a
difference from other observations in one comp was noticed.
MOTION
made by John Sepenoski, seconded by Eric Keil, to authorize Melissa Spiro to present an
purchase offer to landowners per buildable acre for a development rights easement on agricultural
land owned by Casmo Carucci. The LPC’s offer is based on concept plan sketch that was prepared
by Melissa Spiro for appraiser noting approximate area of a 1.5 acres reserve area around residential
home and a 0.5 acre reserve area around existing farmstand, and a development rights easement on
the remaining approximately 10 acres. There will be restrictions for the location or allowance for
agricultural structures around the existing ag structures as indicated on said sketch plan. The purpose
for the acquisition is for farmland protection and scenic protection. This parcel is located within the A-
C zoning district. Septic Credits are not applicable to this purchase as this is farmland.

Melissa recused and absented herself (9:10 p.m.) from any discussions relating to this project.
John Sepenoski presented recap of project from time when landowners first began conversations with
LPC about their pursuit of a subdivision, followed by an LPC application with a reduced yield plan with
no affordable component, to most recent application for possible sale to Town of fee title to open
space properties, including single and separate 2 acre lot. Appraisal reviewed and discrepancies
noted and taken into consideration when establishing a purchase offer.
MOTION
made by Lillian Ball, to present a purchase offer to landowners, Paradise Point Holding
Corp. and VJ Development Corp., for fee title to both parcels for fully appraised values.
Motion not seconded.
Appraisal further reviewed and issues noted and taken into consideration when establishing a
purchase offer.

made by Eric Keil, seconded by Lillian Ball, to authorize John Sepenoski to present a
purchase offer to landowners, Paradise Point Holding Corp. and VJ Development Corp., for fee title to
both parcels for the purpose of an open space acquisition.

Heather and Martin asked for meeting with LPC to go over proposed conservation subdivision. LPC
reiterated that Committee not in favor of layout with lot located at southerly end of property due to its
probable negative influence on farmability. LPC had already sent landowner letter that LPC not in
favor of proceeding with Town PDR acquisition with layout as shown in the proposed conservation
subdivision with a building envelope at south side of property. LPC explained that decision was based
on high agricultural values of the subject property and likelihood that proposed lot layout, by causing
fragmentation of the farmland, would decrease chance that parts of the property would be farmed; the
extent of the existing preserved land adjacent to and in the vicinity of the subject parcel, and the
existing precedent of preservation along the waterfront and south end of properties in the area.
