LONE STAR INDUSTRIES, INC., a corporation organized under
the laws of the State of Delaware, having an office at 10401 N.
Meridian Street, Suite 400, Indianapolis, IN 46290, Grantor, and
THE PEOPLE OF THE STATE OF NEW YORK, acting by and through
the Commissioner of Environmental Conservation of the State of
New York, who has an office at 625 Broadway, Albany, New York
12233, Grantees.
WITNESSETH that the Grantor, in consideration of ONE MILLION
FIFTY THOUSAND AND NO/l00 DOLLARS ($1,050,000.00), lawful money
of the United States, paid by the Grantees, does hereby grant and
release to the Grantees, their successors and assigns forever,
BEGINNING at a point at the intersection of the northerly
side of Naugles Drive with the westerly boundary of land now or
formerly of Aycardi;
RUNNING THENCE westerly along the northerly side of Naugles
Drive on a curve to the left having a radius of 349.50 feet and
an arc length of 80.40 feet to a 30-foot-wide right-of-way;
RUNNING THENCE northerly along the easterly side of a 30-
foot-wide right-of-way, across a 30-foot-wide right-of-way and
along the land now or formerly of Philomena Lizza, North 210 33'
00" West 467.71 feet to a metal bulkhead on the Mattituck Inlet;
RUNNING THENCE easterly by and with the metal bulkhead the
following eight (8) courses and distances:
1. North 590 03' 46" East 7.53 feet;
2. North 830 22' 21 East 6.98 feet;
3 . North 640 45' 10 East 171. 02 feet;
4 . North 230 43' 54 West 25.00 feet;
5. North 590 58' 19 East 27.00 feet;
6. North 550 52' 26 East 13 .13 feet;
7. South 250 29' 46 East 4.41 feet;
8. North 530 33' 04 East 24.72 feet to the high water mark
of Mattituck Inlet;
RUNNING THENCE easterly along the approximate high water
mark of Mattituck Inlet the following five (5) courses and
distances:
1. South 290 07' 25" East 21.47 feet;
2. South 870 58' 06" East 24.84 feet;
3. North 61" 48' 57" East 122.43 feet;
4. South 460 29' 34" East 40.32 feet;
5. North 870 04' 08" East 39.90 feet to land now or
formerly of Joseph J. Cavaliere and Dominick Pardo;
RUNNING THENCE southerly along the land now or formerly of
Joseph J. Cavaliere and Dominick Pardo South 21" 33' 00" East
157.54 feet to land now or formerly of Howard Petersen and Edith
Petersen;
RUNNING THENCE westerly, southerly, easterly and southerly
along the land now or formerly of Howard Petersen and Edith
Petersen the following four (4) courses and distances:
1. South 640 49' 00" West 250.50 feet;
2. South 210 33' 18" East 30.06 feet;
3 . North 640 49' DO" East 273.13 feet;
4. South 340 58' 10" East 187.43 feet to land now or
formerly of Dewulf;
RUNNING THENCE westerly along the land now or formerly of
Dewulf, South 530 48' 10" West 157.09 feet to the land now or
formerly of Ellsworth;
RUNNING THENCE northerly and westerly along the land now or
formerly of Ellsworth and the lands now or formerly of Aycardi
the following three (3) courses and distances:
1. North 320 53' 00" West 24.00 feet;
2. South 530 48' 20" West 164.72 feet;
3. South 420 16' 20" West 149.87 feet to the northerly side
of Naugles Drive and the point and place of BEGINNING.
CONTAINING within said bounds 4.814 acres.
BEING the same premises conveyed to the Grantor by Brown
Boveri Corp. by deed dated January 10, 1972 and recorded in the
Suffolk County Clerk's Office on February 4, 1972 in Book 7101
of Deeds, page 157.
TOGETHER with all right, title and interest, if any, of the
Grantor in and to any strips and gores between the above
described parcels and adjoining owners.
TOGETHER with all right, title and interest of the Grantor
in and to all streets, lanes, roads and rights of way, traversing
or adjoining the premises herein above described, and the ponds,
marshes, rivers, lakes, creeks, waters, and lands under water
located in, upon or adjoining the above described premises,. and
all littoral, riparian and shore rights in any wise pertaining
or belonging thereto.
TOGETHER with a 30-foot-wide right of way in common with
others, running from Luther's Road on the west, over lands of
others and the premises herein conveyed, to premises adjoining on
the east, as said right of way is more particularly described in
the deed to the Grantor recorded in Liber 7101 cp 157.
SUBJECT TO the rights of others in and to a 30-foot-wide
right-of-way crossing the above described premises and running
between Luther's Road on the west, and premises adjoining on the
east, as more particularly described in said deed recorded in
Liber 7101 cp 157.
SUBJECT TO the rights of others in and to a 30-foot-wide
right-of-way over the above-described premises running from the
above-described east-west right-of-way in a generally southerly
direction to Naugles Drive, a more particular description of
which is contained in the second right-of-way granted in
connection with Parcel Five in said deed to the Grantor recorded
in Liber 7101 cp 157.
SUBJECT TO the rights of others in and to the waters and the
lands under the waters of Mattituck Inlet abutting the premises
on the north, and all littoral, riparian and shore rights of
others, if any, in any wise pertaining or belonging thereto.
TOGETHER with the appurtenances and all the estate, rights
and interest of the Grantor in and to the premises.
The property described above does not constitute all or
substantially all of the assets of the Grantor.
TO HAVE AND TO HOLD the above granted premises unto the
Grantees, their successors and assigns forever.
The Grantor covenants that it has not done or suffered
anything whereby the premises have been incumbered in any
way, and
That this conveyance is made subject to the trust fund
provisions of Section Thirteen of the Lien Law.
IN WITNESS WHEREOF, the Grantor has caused this instrument
to be signed by its duly authorized officer the day and year
first above written.
