BERNARD KAPLAN AND THEODORE KAPLAN, as Trustees under trust
agreement dated November 19, 1991 referred to as the "Dawn
Estates Trust", residing at 115 Lake Shore Drive, North Palm
Beach, Florida 33408, and 14170 Steeple Chase Row, Rancho Santa
Fe, California 92067, respectively, Grantors, and
THE PEOPLE OF THE STATE OF NEW YORK, acting by and through
the Commissioner of Environmental Conservation of the State of
New York, who has an office at 625 Broadway, Albany, New York
12233-4256, Grantees.
WITNESSETH, that the Grantors, in consideration of ONE
MILLION TWO HUNDRED FORTY-FIVE THOUSAND AND NO/100 DOLLARS
($1,245,000.00), lawful money of the United States paid by the
Grantees, do hereby grant and release to the Grantees, their
successors and assigns forever,
ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND situate,
lying and being in Mattituck, Town of Southold, County of
Suffolk, State of New York, and bounded and described as
follows:

BEGINNING at the corner formed by the intersection of the
northerly side of Naugles Drive with the easterly side of Luthers
Road;
RUNNING THENCE along the easterly side of Luthers Road the
following two (2) courses and distances:
1. North 090 36' 30" West 101.21 feet;
2. North 00 47' 00" East 146.15 feet to land now or
formerly of Carey;
THENCE along said last mentioned land, North 650 54' 10"
East 350.0 feet to the mean high water mark of Mattituck Inlet;
THENCE along the mean high water mark of Mattituck Inlet the
following two (2) tie line courses and distances:
1. South 530 18' 00" East 102.46 feet;
2. North 770 00' 00" East 140.00 feet to land now or
formerly of Asphalt's, Inc.;
THENCE along said last mentioned land South 2"_ 0 33' 00" East
375.0 feet to the northerly side of Naugles Drive;
THENCE along the northerly side of Naugles Drive the
following two (2) courses and distances:
1. Westerly along the arc of a curve bearing to the right
having a radius of 915.86 feet a distance of 363.73
feet;
2. Northwesterly along the arc of a curve bearing to the
right having a radius of 479.22 feet a distance of
307.35 feet to the corner at the point or place of
BEGINNING.
Parcel identified as District 1000, Section 099.00,
Block 04.00, Lot 002.000 of the Suffolk County Tax Map.
CONTAINING 5t acres.
BEING and intended to be the same premises conveyed to the
Grantors by Bernard Kaplan and Theodore Kaplan by deed dated
December 16, 1992 and recorded with the Clerk of Suffolk County
on December 31, 1992 in Book 11600 of Deeds, page 100.
TOGETHER with all right, title and interest, if any, of the
Grantors in and to any strips and gores between the above
described parcel and adjoining owners.
