HomeMy WebLinkAboutL 11919 P 699 RC1( EASEMENT FOR l WATER MAINS AND APPURTENANCES i Authorization No. GW 13 THIS AGREEMENT, made the 27th day of July, 1998, between MATTITUCK-CUTCHOGUE UNION FREE SCHOOL DISTRICT, SUFFOLK COUNTY, NEW YORK, a municipal corporation, having its principal office at Main Road, P. O. Box 1438 , Mattituck, New York 11952-0987, Grantor, and SUFFOLK COUNTY WATER AUTHORITY, a public benefit corporation, having its principal place of business at 4060 Sunrise Highway, Oakdale, County of Suffolk, State of New York, Grantee . WITNESSETH: The Grantor, in consideration of other good and valuable consideration and TWO ($2 . 00) DOLLARS, lawful money of the United States, paid by the Grantee, does hereby grant and convey unto the Grantee, its successors and assigns, forever: The perpetual and exclusive right to lay, relay, operate, maintain and remove a water main or mains, both supply and distribution, and appurtenances, including domestic services and , fire hydrants, in an "easement area" owned by the Grantor at Cutchogue, Town of Southold, County of Suffolk, State of New York, as more fully described in Schedule A which is attached hereto and made a part hereof . TOGETHER with the right to use such easement area for such purposes; together with such similar rights and easements as the Grantor can grant in and to such easement area. TO HAVE AND TO HOLD, the rights and easements herein granted unto the Grantee, its successors and assigns forever. ALL mains and appurtenances laid or to be laid by the Grantee, its successors and assigns, shall be and remain personal property of the Grantee, its successors and assigns, forever. AND said Grantor covenants as follows : FIRST: Not to plant or erect, without the written consent of the Grantee, its successors or assigns, over any portion of 1 I SCHEDULE A EASEMENT AREA ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk and State of New York, being bounded and described as follows : BEGINNING at a concrete monument located at the intersection of the southerly side of Main Road (N.Y.S. Route 25) with the northeast corner of premises of the Grantor; running thence from said point of beginning. along land now or formerly of Jerome Swann and Rose Swann, South 610 21 ' 00" East 390 . 00 feet to a point; thence through land of the Grantor the following two courses and distances : (1) South 280 39 ' 00" West 20 . 00 feet; and (2) North 610 21 ' 00" West 402 . 18 feet to the southerly side of Main Road (N.Y.S . Route 25) ; running thence along the southerly side of Main Road (N.Y.S. Route 25) North 590 54 ' 30" East 23 .40 feet to the concrete monument at the point or place of BEGINNING.
