THIS INDENTURE, made the July 9, 2001,

party of the first part. and

party of the second part.
WITNESSETH, that the party of the first part. in consideration ofTen and 00/100 ($10.00) dollars,
lawful money of the United States, paid by the party of the second part. does hereby grant and rclease unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
ALL that certain plol. piece or parcel of land. with the buildings and improvements thereon erected, situate. lying
and being at Cutehogue, in the Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and described as follows:
BEGINNING at a point on the southeasterly side of Main Road (N.Y.S Route 25) distant 396.99 feet northeasterly
from a found monument in the Road at the point where the dividing line between lands now or formerly of Antone
and Mary Wysocki and Lands now or f0I111er'" of Edward A. luboski and Denise Marie luboski intersects said
southeasterly side of Main Road (NY.S. Route 25). said point also being where the northwesterly eOl11er of
premises to be described herein intersects with said southeasterly side of Main Road NY.S. Route 25). said point
also being where the northeasterly line of premises now or f0l111erly of Joan A. Eickhoff and Walter A. Stepnoski
intersects with said southeasterly side of Main Road (N.Y.S. Route 25);
RUNNING THENCE along said southeasterly side orMain Road (N.Y.S. Route 25) North 59 degrees 48 minutes
40 seconds East 82.0 feet to a found monument where said southeasterly side of Main Road (NY.S. Route 25) is
intersected by the southwesterly line of lands fOl11lerly of Barndorfand Rizzo (now or formerly of Kit Realty Inc.);
THENCE and along said lands South 42 degrees 23 minutes 10 seeonds East 314.85 feet to a concrete post;
THENCE and along the westerly line of lands f0l111erly of Bal11dorf and Rizzo (now or formerly of Kit Realty Ine.)
South 7 degrees 10 minutes 50 seconds West 218.22 feet to a concrete post where the dividing line between the
southwesterly line of premises described herein and the northeasterly line of premises now or fonnerly of Joan A.
Eickhoff and Walter A. Stenoski intersects with said westerly line of land now or f0l111erly of Kit Realty Inc.
THENCE along said dividing line north 32 degrees 09 minutes 40 seconds west, 481.45 feet to the said
southeasterly side of Main Road (NYS. Route 25) atlhe point or place of BEGINNING.
Said premises being known as 36020 Main Road. Cutehogue. New York.
Being and intended to be the same premises eonveved to the party of the first part by Deed dated 12-14-92,
recorded 12-24-92 in Libel' 11596, Page 148.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the s~cond part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to he applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
The word "party" shall be constmed as ifit read "parties" whenever the sense of this indenture so
reqUIres.
