The reqular meeting of the Board of Town Trustees was held on Wednesday, November 2, 1983 at the Town Hall, Main "Road, Southold. Present were: President Paul Stoutenburgh Vice-President Frank Kujawski Trustee Henry Smith Trustee John Bednoski Trustee John DiVello Clerk Ilene Pfifferling President Stoutenburgh called the meeting to order. On motion made by Henry Smith seconded by Frank Kujawski and carried, the minutes of the October 11, 1983 meeting were Approved. On motion made by Henry Smith seconded by John Bednoski and carried it was RESOLVED that the date for the next meeting, of the Board of Town Trustees will be held on December 13, 1983 at 7:00 P.M. Vote Of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski President Stoutenburgh introduced our new Bay Constable; Mr. Donald A. Dzenkowski, who was appointed at a Town Board meeting held on October 18, 1983 from the Suffolk County Civil Service List. On motion made by John Bednoski seconded by Henry Smith and Carried the mooring renewal permits for the month of December were approved. 575 ~' FREDERICK FALCONER On motion made by Frank Kujawski seconded by John Bednoski it was RESOLVED to Approve the application of Frederick Falconer to maintenance dredge for sufficient depth of water, for boat mooring, fill is to be placed on own premises, in East Creek, Cutchogue. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski FREDERICK FALCONER-WETLAND APPLICATION.#169 n motion made by Frank Kujawski seconded by John Bednoski it was RESOLVED to recommend to the Southold Town Board APPROVAL of the Wetland Application ~169 submitted by Frederick Falconer to mainten- ance dredge for sufficient depth of water, for boat mooring, fill is to be placed on own premises, in East Creek, Cutchogue. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVel~o, Bednoski MARGARET & JOHN WOHLBERG --- On motion made by Henry Smith seconded by John DiVello it was RESOLVED to APPROVE the application of Margaret & John Wohlberg to replace existing deteriorated bulkhead 81' in length and to raise the ext.structure 9", in Jockey Creek, Southold. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski SALVANIA ZAHRA On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to APPROVE the application of Salvania Zahra to place an offshore mooring (100 lb.) in James Creek, with the provision that the boat does not swing into any other boat or impede navigation. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski SALVINIA ZAHRA On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to DENY WITHOUT PREJUDICE the application of Salvinia Sahra to place an offshore stake with pulley line to onshore stake in James Creek, Cutchogue. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski ROBERT C. COCHRAN On motion made by Henry Smith seconded by John Bednoski it was RESOLVED to APPROVE the application of Robert C. Cochran to place an offshore mooring off of Town Creek at the end of Young's Avenue. The Trustees suggested that he place the boat down the creek, on the South side facing out, with the provision that he uses a fore and aft anchor, so that the boat does not swing into the channel or impede navigation. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski 576 HELEN CASE On motion made by Frank Kujawski seconded by John DiVello it was RESOLVED to Approve the application of Helen Case to place broken concrete along the edge of New Suffolk Avenue, with the provision that the permit_from the Trustees will hot be issued until a Wetland AppTication is received. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JUDITH FL~4IO On motion made by Henry Smith seconded by John Divello it was RESOLVED to DENY without prejudice the application of Judith Flamio to place an offshore stake in Town Creek, Southold. Vote of Board: Ayes~- Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski On motion made by Henry Smith seconded by John DiVello it was RESOLVED to RESCIND the aforementioned resolution. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski On motion made by Henry Smith seconded by John DiVello it was RESOLVED to Approve the application of Judith Flamio to request a 50 lb. mushroom anchor, placing her boat up by Founder's Landing, ~_the site is to be determined by Trustee Smith and Mrs. Palmino, as soon as possible, or in the spring. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski THE FOLLOWING WILL BE PLACED IN THE GUIDELINES OF THE TRUSTEES RESOLVED that any boat that is moored at the edge of a dredged c~annel~i~ have to use a fore and aft mooring. LUHRS On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to Approve the application of Richard A. Luhrs to secure a.~ permit for a dock in James Creek, under the Grandfather Clause. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello Bednoski JAMES H. SMALL On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to Approve the application of James H. Small to secure a permit for a dock under the Grandfather Clause in Deep Hole Creek. Vote of Board: Ayes. Msssrs. Stoutenburgh, Smith~ Kujawski, DiVello, Bednoski RUSSEL & HELEN D. TUTHILL On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to APPROVE the application of Russel & Helen D. Tuthill to secure a permit for a dock and bulkhead in Deep Hole Creek, under the Grandfather Clause. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello Bednoski 577 KATHERINE LUHRS On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to APPROVE the application of Katherine Luhrs to secure a permit for a dock in James Creek, under the Grandfather Clause. ENRIGHT On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to APPROVE the application of Lillian K. En.right to secure a permit for a dock in Deep Hole Creek, under the Grandfather Clause. Vote of Board: Ayes: Messrs. KIRWIN On motion made by Paul Stoutenburgh seconded by Frank Kujawski it was -'~RESOLVED to TABLE the application of Mary H. Kirwin to secure a permit for a dock and bulkhead in Mud Creek, Cutchogue. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski PETER MICCICHE On motion made by Henry Smith seconded by John Bednoski it was RESOLVED to APPROVE the application of Peter Micciche to reconstruct and enlarge an existing boat ramp and replace 30' of existing bulk- head within 18" of structure. 20 cu. yds. of sand is to be remOved from the boat ramp enlargement. Fill to be placed behind the bulk- head, with the provision that the new construction is to remain in line with the exhisting structure. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski. PETER MICCICHE-WET~AND APPLICATION ~ 162 On motion made by Henry Smith seconded by John Bednoski it was RESOLVED to recommend to the Town Board APPKOVAL of the Wetland Application #162 of Peter Micciche to reconstruct and enlarge an existing boat ramp and replace 30' of existing bulkhead within 18" of structure. 20 Cu. yds. of sand is to be removed from the boat ramp enlargement. Fill to be placed behind the Bulkhead, with the provision that the new construction is to remain in line with the exhisting structure. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski. HOWARD PETERSEN A discussion was held in reference to this application. It was decided that a letter will be sent to Mr. Petersen, telling him that the application he had on file is no longer valid. If in the future he wishes to do work in town waters, he will have to re-apply. DANIEL SILVERM3~ At the November 2, 1983 meeting of the Board of Town Trustees the following Resolutions were made in respect to the application of Daniel Silverman for Trustee and Wetland Permits. On motion made by Henry Smith seconded by John Bednoski it was RESOLVED to rescind the Resolution adopted on June 7, 1983 granting Daniel Silverman a Trustee permit. Vote of Board: Ayes: All On motion made by Henry Smith seconded by John Bednoski it was RESOLVED to rescind the Resolution adopted on June 7, 1983 recommending to the Town Board Approval of the Wetland Applicaiton of Daniel Silverman. Vote of Board: Ayes: All _.-On motion made by John Bednoski seconded by Frank Kujawski it was RESOLVED to deny without prejudice the Application o~ Daniel Silverman for a Trustee Permit, whereas the two adjoining land- owners could not come to agreement. Vote of Board: Ayes: All On motion made by John Bednoski seconded by Frank Kujawski it was RESOLVED to recommend to the Town Board Denial withou~ prejudice the Wetland Application of Daniel Silverman, whereas the two adjoining landowners could not come to agreement. Vote of Board: Ayes: All Correspondence In response to Town Clerk, Judith T. Terry's letter requesting recommendations to amend the Shellfish Ordinance concerning Mussels and Scallops~ it was ~he consensus of the Board of Trustees to leave this Ordinance in it's present context. A letter is to be sent to the Long Island Lighting Company concerning overhead power lines that migh~ cross town waters. It was suggested in the letter that LtLCO make up a sign about tha power lines ahead, and the trustees suggested that Mattituck Creek would be a good area for such a sign. A letter will be sent to Mr. Daniel Larkin, of the Dept. of Envir. Conservation, voicing the Trustees strong concerns about the proposed groin/jetty at Stirling Eastern Shores, Greenport. 579 ~ A letter is to be sent to the Goose Creek Civic Association, advising them that their application for dredging is not valid. If in the future they wish to do this work, they must re-apply to the Trustees. On motion made by Frank Kujawski seconded by John DiVello it was RESOLVED that the Trustees subscribe to the Environmental Notice Bulletin, Published by the New York State Department of Environmental Conservation, at 50 Wolf Road, Albany, New York 12233 at the cost of $12.00 Annually. Vote of Board: Ayes. Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski Moved by Trustee Kujawski, seconded by Trustee Smith, it was RESOLVED that this Trustee Meeting be and hereby is adjourned at 8:40 P.M.
