THIS INDENTURE, made the 25th day of July, two thousand and seven,
BETWEEN
Enzo Cippitelli, 627 Green Lake Road, Catskill, New York 12414, and Agnes Cippitelli, by
David Cippitelli, 8 Raymond Court, Garden City, New York 11530, her attorney-in-fact, said
Power of Attorney to be recorded in the Suffolk County Clerk's Office simultaneously herewith,
party ofthc first part,
and
Agnes Cippitelli and Enzo Cippitelli, 627 Green Lake Road, Catskill, New York 12414, as
Trustee of The Agnes Cippitelli Living Trust, dated 4/20/99,
party of the second part,
WITNESSETH. that the party of the first part, in consideration of ten dollars and no/100
($ i 0.00), lawful money bf-ih'e United States, to them paid by the par~y ofthe second part, does
hereby grant and release unto the party of the second part, the heirs, successors or assigns of the
party of the second part forever,
ALL that certain lot, piece or parcel of land together with the buildings and improvements
located and to be erected thereon, situate, lying and being at Arshamoomaque, Town of
Southold. County of Suffolk and State of New York, more particularly bounded and described
as follows:

BEING the same premises conveyed by Barbara E. Broch, Grantor~ to Enzo Cippitelli and
Agnes Cippitelli, Grantee. by Deed dated August 27, 2003 and recorded in the Suffolk County
Clerk's Office on February 21,2004 in Liber D00012302 of Deeds at page 523.
THE PARTY OF THE FIRST PART named herein is the sole beneficiary ofthe Party of the
Second Part. The Agnes Cippitelli Living TrusL daled 4/20/99, during the lifetime(s) of the
Party ofthe First Pan and is entitled m veterans and senior exemptions as provided under RPTL
subsections 458(7), 458-a(5) and 467(9), and the school tax relief (STAR) exemption as
provided under RPTL section 425.
SUBJECT to covenants, conditions, reslrictions and rights of way of record, if any.
SCHEDULE
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being at Arshamomaque, Town
of Southold, County of Suffolk and State of New York, bounded and described as
follows: /
BEGINNING at a point on the westerly line of land of Ruch, distant, on a course
South 31 degrees 43 minutes 00 seconds East 177.34 feet from a point on the
southerly line of the North Road (County Road 27) (said point marking the
southeasterly corner of land of Georg~ Santis) and from said point of beginning;
RUNNING THENCE alon.q the southerly line of land of said Santis, South 61
degrees 59 minutes 10 seconds West 74.44 feet to a point;
THENCE South 31 degrees 40 minutes 50 seconds East 130 feet more or less,
to the ordinary high water mark of Arshamomaque. Pond (Mill Creek);
THENCE in a general easterly direction, along the ordinary high water mark of
Arshamomaque Pond, about 74 1/2 feet more or less to land of Ruch;
THENCE NoAh 31 degrees 43 minutes 00 seconds West, about 130 feet more
or less, to the point or place of beginning.
TOGETHER with a right of way for purposes of ingress and egress and for the
introduction of utility services, lines, mains, pipes over the northerly 20 feet of the
Land of Irene Miller, immediately adjacent on the west of the above described
premises to a 20 foot right of way known as Beverly Road, and thence, in
common with others northerly over said Beverly Road, about 185 feet to the
southerly line of the North Road;
TOGETHER, also, with an easement over the said dght of way and over the said
lands of George Santis, Beverly Road, Old Cove Boulevard, and other lands of
the party of the first part of the North Road and the water main therein of the
Village of Greenport, to lay, relay, operate and maintain a water supply line
where the same is presently located, and two feet on either side thereof.
TOGETHER, also, with all of the right title, and interest, if any, of the party of the
first part of, in and to the waters and the land lying under the waters of
Arshamomaque Pond in front of and adjoining said premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with thc appurtenances and all thc cstatc and rights of the party ofthe first part in
and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, thc
heirs or successors and assigns of thc party of the second part forever.
AND the party ofthe first part covenants that the party ofthe first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as n trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
Thc word "party" shall be construed as if it rcad "parties" whenever the sense of this indcnturc
so requires.
